RESOLUTION NO . 4123
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
DECLARING ITS INTENTION TO ORDER THE VACATION OF A
PORTION OF AMARILLO AVENUE AND GIVING NOTICE OF THE
TIME AND PLACE FOR HEARING THEREON
The Council of th e City of P alo Alto does RESOLVE as
follows:
SECTION 1. It is the i nte nti on of the Council of the
City of Palo Alto to v acate a portion of a publi c stre et
commo nly known as Amarillo Av enue in the City of Palo Alto,
County of Santa Clara, St ate of Calif ornia, as shown on a
map on file in the o ffice of the City Clerk and further des-
cribed in EXHIBIT A a ttached hereto and by ref erence made a
part her eof.
SECTION 2. It is fur ther the intention of the Coun cil
of the City of Palo Alto to re serve and except from said vaca-
tion an easement over, unde r a nd acro ss ;aid street
for the. purpo se of co nstr ucting, maintaining, oper ati ng,
replac ing, removing, and re newing sanitary se wers and storm
drains and public utilities as described in sa id EXHIBIT A.
SECTION 3. Mo nday, the 27th da y of May, 1968, at
7:30 p. m. in the Council Chambers, City Hall, Palo Alto ,
Ca lifo rnia, is set as the time and place of hearing where and
when a ny pe rson having an interest in such pr ocee dings ma y
appe ar a nd prese nt e vidence either for or a gainst such vaca -
tio n.
SECTION 4. All of the proc eedings for the vaca tion of
said street, and said re servation of easement, shall be con-
ducte d pursuant to Section 8300 et seq. of the Stree ts and
Highwa ys Ccde.

SECTION 5. Tne City Engi nee r is directed to post
notices of street vacation a nd reservati on of easement con-
spicu ously along the street to be vacated as d escribed in
Section 1 here of at least ten days bef ore the hearing, p asting
them no more than 300 feet apart, but there shall be at least
three notices posted. Such notices shall st at e the p ass ag e of
this Re solution of Intention, and the time and pl ace of the
hea ring.
SECTION 6. The Clerk is directed to publish a copy of
this resolution in the Pal o Alt o Times twice p rior to date
of hearing.

from Byrtee Wallace to the Stat e of Calif ornia dated May 26, 1958,
rec orde d July 21, 1958 in Book 4127 of Offi cial Rec ords, page 329,
with the Northwesterly line of Am arill o Avenu e, formerly East Willow
R oad, as said ro ad is shown on that cert ain Map entitled, "Map of S ub-
division No . 5 Se ale Tract," which Map wds filed f or record in the
o ffice of the R ecorder of the County of S anta Claia, State of C alifornia on
June 26, 1917 in Book P of Maps, pages 26 and 27; th ence from said point
of be ginning, along the Northweste rly line of said Amarillo Avenu e, S outh
39°20'10" West 146. 43 feet, to the point of interse ction thereof with the
No rthea ster ly line of tha t certain parc el of land described as Pa rcel 1
in sa id Deed to the State of California, first herein mention ed; thence
along the Southeaste rly prolonga tion of said last named line, South 38°55'40"
East 40. 85 fe^t, to the point of interse ction thered with the Southe asterly
line of said Ama rillo Avenue ; thence along sa id Southe asterly line N orth
39°20'10' East 127.42 fee t, to the point of intersectio n thereo f with th e
Southeaster ly pro longa tio n of the Southweste rly line of P ar ce l 2, as
describe d in said Deed to the State of California, first he rein mentioned;
thence along pa id la st named line North 16'19'50" West 48. 44 feet, to
the point of beginning, being a portion of said Amarillo A ve nue.
Re serving therefrom an easement for public utilities, sto rm
drainage and sanitar y se wer purpose s o ver, under and across the entire
parce l described above.
