HomeMy WebLinkAboutRESO 4122mh 3-12-68-40 ORIGINAL RESOLUTION NO. 4122 A RESOLUTION OF PRELIMINARY DETERMINATION AND OF INTENTION MISCELLANEOUS STREET IMPROVEMENTS PR OTECT NO. 67-3 RESOLVED, by use c ouncil of the City of Pal o Alt,- , Califo rnia, that 1. It does hereby preliminarily determi ne that the public interest, co nvenience and necessity requi re a nd th at it intends to or der the wo rk to be done and acquisiti ons and improvements to be made, as more pa rticula rly described in E xhibit "A " he reto att ached and by r efe rence incor porated herein. 2. All of the blo cks, streets and alleys herein mentioned ar e sho wn on maps of reco rd in the office of the County Rec orde r of the Co unty of Santa Clar a, State of Califo rnia, and shall be sho wn on the pla ns here in r efe rred to and to be filed with the City Clerk of sa id City . 3. Whe never a ny public way is herein referred to as running between two public ways, or from or to an y public way, the intersec- tions of the public w ay s r eferred to a re in clu ded to the extent that work shall be shown on the plans to be don e therein. 4. All of said w ork and impro vements a re to be constructed at the pla ces and in the particular locations, of the fo rms, sizes, dimensions and materia ls, and at the lines, grades a nd elevatio ns as shown an d delinea ted upon the plans, profiles e,.nd spe cifications to be made therefor , as here inafter pro vided. 5. There is ex cepted fro m the w ork descr ibed an y of such w ork alre ady do ne to line and grade and marked excepted or sho wn not to be done on sa id plans, profile s a nd specifications. 6. Said Coun cil does here by a dopt and establish as the offi- cia l grades for sa id work the grades and elev ations to be sho wn upon sa id plan s, profiles and specifications. All such grades and eleva tions are to be in feet and decimals thereof with re ference to the datum place of the City of Pa lo Alto. 7. It is the inte ntion of this Council to e nter i nt o an agree- ment with the Pacific Telepho ne and Teleg raph Company, which ag ree- ment will provide for the ownership by said Company of und erground telephone facilities in said City to be inst alled by said Compa ny, an d for the providing of se rvice to the properties in s aid area by said Company in accordance with its rates, r ules and regulations, and that said agreement sh all bec ome effective afte r proc eedings have bee n taken for the levy of the assessments and Sale of bonds and fu nds are available to car ry out its t erms . 8. Notice is hereby given of the fact that in many cases said work and improvement will bring the finished w ork to a g rade diff er- en t from that formerly existing, and that to said e xtent said grades are her eby c hanged and that said wo rk will be done to said changed gra des. 9. The descriptions of the acquisitions and improvements and the termini of the work containe d in this Resolution are gene ral in nature. All items of wor k do not necessarily extend fo r the full length of the description thereof. The plans a nd profiles of the wor k and maps and descriptions, as contained in the Engineer's report, shall be contr olling as to the correct a nd deta iled descrip- tio n ther eof. 10. Said contemple;ed acquisitions and improvements, in . the opin io n of said Council, are of more than lo cal or or dinary public benefit, and the c osts and expenses ther eof are made cha rgeable upon an a ssessment distr ict, the exterior boundaries of which dis- trict are the composite and con solidated ar ea as mo re particular ly shown on a ma p thereof on file in the o ffice of th e City Clerk, to which reference is hereby ma de for fur ther pa rticula rs. Sa idmap indicates by a bo undary line the extent of the terr itory included in the pro po sed distr ict an d sha ll gov ern for all details as to the extent of the assessment distr ict. 2 11. Said Council fu rthe r decla res that all public streets, highw ays, la nes and alleys within said assessment district in use in the performa nce of a public f unction as such, sh all be omitted fro m the assessment h ereafter to be m ade to cove r the costs and expenses of sa id acquisitions and imp rov ements. 12. Notice is hereby given that serial b onds to represent unpaid assessments and bear interest at the rate of n ot to exceed si x per ce nt (6%) per a nnum, will be issued hereunde r in the manner pro vided in the Impr ovemen t Bond Act of 1915 (Divisio n 10 of th e St reets and Highw ays Code), the last installment of which bonds shall m ature not to exceed nine (9) years fro m the second d ay of July n ext succeeding ten months from their date. The provisi ons of Part 11.1 of the Streets a nd Highways Code providin g an alternative p rocedu re fo r the advance payment of assessments a nd the calling of bonds, shall apply. 13. Except as he re in othe rwise provided for the issua nce of bo nds, all of said w ork shall be done as pro vided In the Municipal Improvement Act of 1913, Divisio n 12 of the Streets and Highways Co de, a nd Sectio n 17 of Article XIII of the Co nstitution of the State of California, 14. Said acquisitions and impr ove men ts are hereby referred to the City Engineer of sa id City, as the officer having charge and co ntrol of the a cquisitio ns a nd constr uctio n of public impro veme nts in and for s aid City of the kind de scribed herein, being a competent 'erson employed by said City for that pur po se; a nd said Engineer is hereby dire cted to ma ke and file with the City Clerk a r epo rt in w ritin g, presenting the follo wing: a) Ma ps and descriptions of the lan ds an d easements to be acquired; b) Plan s a nd specifica tion s of thz proposed improvements to be made pur suant to this REsolution; c) Engineer's estima te of the tota l costs and expenses of sa id acquisitions and improvements a nd of the in cide ntal expen ses in co nnec tion ther ewith; 3 • • d) Diagram sho wi ng the assess ment district above referred to, and also the bou ndaries and dimensions of the respective subdivi- sions of land within s aid district as the same existed at the time of the passage of this Resolution, e ach of which subdivisions shall be given a separate number up on said di agr am; e) A prop osed assessment of the t otal amou nt of the cost a nd expenses of the pr op osed acquisitio ns and impr oveme nts upon the sev era l su bdivisions of l and in said dist rict in proporti on to the estima ted ben efits to be received by such subdivisions, respectively, from said acqu isition s an d improvements. When any portion or perc entage of th e cost and expenses of the acquisitio ns and improve men ts is to be p aid fr om sou rces other than asse ssme nts, the a mo unt of such portl_on or percentage shall fir st be deducted fro m the total estimated cost and expenses of said a cquisition s an d impr ovements, a nd sa id a ssessment shall incl ude only the remainder of the estimated co st an d expenses. S aid assessment shall refer to said subdivision s by their respective numbers as assigned pursua nt to su bdiv ision (d) of this section. 15. If any excess shell be realized fro m the assessment it sh all be used, in such amounts as the Council may determine, in accordance with the provisions of law, for the maintena nce of the improv
