RESOLUTION NO. 4UL
A RESOLUTION OF INTENTION TO AMEND SECTION 12.16 .020
OF CHAPTER 12 .16 OF TITLE 12 OF THE PALO ALTO
MUNICIPAL CODE BY ESTABLISHING UN DERGROUND UTILITY
DISTRICT NO. 7
OLD TRACE ROAD, ET AL.
PROJECT NO. 64-4
RESOLVED, by the Council of the City of Palo Alt o, Calif ornia,
as follows:
1. That in its opinion the public necessity, health and safety
require and tna t it is the inte nti on of said Council, pursuant to
Section 12.16.040 of Cha pter 12.16 of Title 12 of the Palo Alt o
Municipal Code, to amend Section 12.16 .020 of said C ode by o rdering
the esta blishmen t of an undergrou nd utility district and to pro-
hibit the con struction 4.n and require the removal f rom said proposed
district of all pole s and overhead lin es and associated ove rhead
structu res used or useful in supplying e lectric, co mm unication or
similar or associated services.
2. That the name of the proposed district is Und erg round
Utility District No. 7 of the City of Palo Alto.
3. That the descr iption of the area co mprisin g said proposed
district is as follows:
All la nds within the Old Trace Road area
a ll as more pa rticularly delinea ted on that certa in map entitle d
"Undergroun d Utility District No . 7", on file in the office of th.e
City Clerk.
4. That fr om an d after the effective date of the establish-
ment of said pr oposed district no per so n or utility shall er ect or
construct w ithin sa id district any pole, overhea d line or a ssoci-
a ted overhea d structure used of useful in supplying electric, com-
mu nication or similar associa ted services.
5. That within ninety (90) days from the date of the comple-
tion end acceptance of the pro po se d undergroun d electric an d tele-
phone facilities in the public streets within said district to be

constructed by the City of Palo Alto and The Pacific Telephone and
Telegraph Compa ny, all poles and overhead lines a nd associ ated struc-
tures used or useful in s upplying elect ric and similar or associ ated
services in said p roposed dist rict sh all be remo ved, and from and
4fter said date no person or utility shall use or m aintc.i.1 such f acil-
ities within said p roposed district . Additio nal n otice shall be give n
after sa id completion date has been precis ely determined .

6. Tha t NOTICE IS HEREBY GIVEN that Monday, the =Oh day of
Jam, 1968, at the hour of 7:30 o'clock P. M., in the reg ular meeting
pla ce of said Council, City Hall, Palo Alt o, California, are hereby
fixed as the time a nd place when and where s aid Council sh all hear
all prote sts an d receive evide nce for a nd ag ai nst the action herein
pro pose d, a nd when and where said Council shall consider and finally
determine whether the public nece ssity, health and s afety require
the esta blishmen t of said district an d the removal of p oles, over-
he ad w ires a nd a sso ciated ov erhead stru ctur es and the underg round
installation of wires and facilities for supplying elect ric, comm uni-
cation or similar asso ciated ser vices in the distr ict herei nabove
de scribed.
7. That at said hear ing a ll per so ns interested sha ll be
giv en an o pportunity to be he ard. Said hear ing may be continued
from time to time as may be determined by said Council.
8. That the Clerk of this City shall give notice of said
hear ing by mailing copie s of this resolution to all pr operty owners
within said propose d distr ict as sho rn on the last equa lized tax
roll of the City, and to a ll utilities supplying e lectric, communi-
cation or simila r rr a ssociated ser vices w ithin said proposed
district, sa id mailin g to be completed at lea st thir ty (30) da ys
prior to the da te of sa id hea ring.
