RESOLUTION NO. 4120
A RESOLUTION DESCRIBING PROPOSED BOUNDARIES
OF ASSESSMENT DISTRICT, DIRECTING FILING OF
MAP AND DIRECTING RECORDATION OF NOTICE OF
ASSESS MENT AND ASSESSMENT DIAGRAM
OLD TRACE ROAD, ET AL .
PROJECT NO. 64-4
RESOLVED, by the Co uncil of the City of Palo Alto, Califor nia,
that
WHEREAS, this Council p rop os es to underteze pr oceedings fo r
the for mation of an assessment district p ursua nt to Resoluti on
No. 4077 of Pr eliminar y Determinatio n and of Intentio n adopt ed by
said Council on Febr uary 5, 1968;
NOW, THEREFORE, IT IS ORDERED, as f ollows:
1. That the proposed boun daries of said assessment district
to be assessed in sa id pro ce edin gs are hereby described as shown
on a map of said assessment district on file in the office of the
City Clerk, which sho ws the lo ts, pieces or pa rcels of land pro-
po sed -to be assessed and which in dicates by a boun dary line the
extent of the territory included in the proposed assessment dist rict
-and which shall govern for all details as to the e xte nt of such
district, r eference to such map being hereby made for particu lars.
Sa id ma p co ntains the name of the City and a distinctive designa -
tion in wor ds or by number of the district shown thereon.
2. Tha t on the original and at least one copy of sa id map
the City Cle rk shall endo rse her certificate evidencin g the date
and adoption of this resolution . The Cle rk shall file the original
of such ma p in he r office and within fifteen days aft adoption
of the re solution fixing time and place of he aring on the for ma tion
or extent of said district, and in no ev ent later than fifteen days
pr ior to such hearing, sha ll file a copy thereo f with the Cou nty
Recorder of the County of Santa Clara in which all of such pro posed
assessment distr ict is lo cated.

3. That the Co unty Recorder shall endorse on the copy of
said map the ti me a nd date of filing and sh all fasten the same
securely in a book of maps of assess ment districts which he sh all
keep in his office. The Co unty Recorder shall i nde x such map by
the name of=the entity cond ucti ng the proceedings and by the dis-
tinctive designation of the district as shown on said map.
4. After confirmatio n of the assess ment by this Cou ncil,
the Clerk shall cause to be filed in the office of th e County
Recor der a copy of the ass essment di agram and shall execute and
r ecord a notice of assessment in the offic e of the Cou nty Rec order
of the County of Sa nta Cla ra , such n otice to be in subst anti ally
the form provide d in Section 3114 of the Streets and Highways Code.
Fro m the da te of such recordin g, all persons shall be deemed to
have notice of the co ntents of -su ch assessment, and each of such
assessments shall thereu pon be a lien upon the prope rty against
which it is made, and unless sooner discharged such liens shall so
co ntin ue for the period of fou r (4) yea rs from the date of said
recordation, or in the e vent bo nds are issued to represent said
assessmen ts, then such liens shall co ntinue until the expiration
of four (4) years after the due date of the last installment up on
said bonds or of the last principa l coupon attached thereto .
5. Tha t the a ppropriate officer or officers a re her eby
a utho rized t. o pay any an d all fees requ ire d by law in connection
with the above.
