HomeMy WebLinkAboutRESO 4117411 • WJML:KJmh 4-30-Gu-40 ORIGINAL RESOLUTION NO. 4117 A RESOLUTION AMENDING RESOLUTION NO. 4077, A RESOLUTION OF PRELIMINARY DETERMINATION AND OF INTENTION TO ACQUIRE AND CONSTRUCT IMPRO VEMENTS OLD TRACE ROAD, ET AL PROJECT 64-4 RESOLVED, by the Council of the City of P alo Alto, California, that 1. Sectio n 11 of the Res olutio n cited in the titl e, adopt ed by this Council on Febr uary 5, 1968, is a=rded to read as follo ws: " 11. Notice is hereby gi ven that the total c ost of the project will be sprea d a gainst properties benefited withi n the asse ssme nt district in the form of specific lie n assessments pursuant to Section 13. 12.040 of Chapte r 13.12 of Titl e 13 of the Palo Alto Municipal Co de, and that serial b onds -t o rep re sent unpaid assessments and bea r intere st at the rate of not to ex ceed six per c ent (6%) per annum, will be issu ed he reund er in the mann er pro vided in Bo nd Plan B, Section 13.16.110 of Chapter 13.16 of Title 13 of said Code, the la st -installment of which bonds shall mature not to ex ceed twen ty-fo ur (24) years from the se co nd da y of July next succeeding te n months from their da te." 2. Section 12 of said Resolution is amended to rea d: "12. Said Co uncil further declares that all public streets, highways, lanes an d alleys within said assessment district shall be omitted fro m any spe cific lie n assessments to be ma de to cover the co sts and expense s of sa id acquisition s a nd impr ovements. " 3. Se ction 14 of said Reso lutio n is amended to re ad: "14. Said acquisitions a nd improv ements are hereby referre d to the City En gine er of sa id City, as th4 officer hav- ing cha rge a nd con trol of the acquisition a nd constru ctio n of public improvements in an d for said City of the kind de scr ibed he rein, bein g c competen t person emplo ye d by sa id City for tha t purpose; and said Engin eer is h ereby directed to make and file with the City Cl erk of this City a report in writi ng, presenting the foll owi ng: a) Plans and specifications of the proposed improvements to be m ade pursu ant to thin. Resolution; b) Engineer's estimate of the total c osts and expenses of said acquisiti ons and impr ovements a nd of the inci- de ntal e xpenses in connectio n therewith; c) Dia gram showing the assessment district ab ove referred to , and also the boundaries and dimensi ons of the r espective subdivisions of land within said district as the same existed at the time of the passage of this Resol ution, each of which subdivision s shall be given a separate number upon said diagram; d) A pro po sed assessment of the costs a nd expe nses of the propo sed acquisition s and improvements upon the several subdiv isio ns of land within said distr ict in proportion to the estimated be nefits to be receive d by such subdivisions, respec- tively, fro m said acquisitions and improvemen ts, and of the expe nse s incidental there to ; and e) Maps an d description s of the ].ands a nd ea se- me nts to be acquired." 4. Se ction 15 of said Resolution is amended to re ad: "15. If any surplus shall be re alize d from the specific lien assessment or fro m the proceeds of sale of bonds issue d un der Bond Plan B, it sha ll be spen t for the maintena nce of said acquisitions a nd impro vements." 2 by the following vote of the members thereof: AYES and in favor thereof, Councilmen: Ar nold, Beah rs, Berwald, Clark, Comst ock, Cooley, Pearson , Spaeth, Wheatley
