The Council of the City of Palo Alto rnet on this date at 7:33 p.m.
with Mayor Dias presiding.
Present: Beahrs, Berwald, Clark, Comstock, Cooley,
Dias, Gallagher, Pearson, Spaeth, Wheatley
Absent: Arnold
Approval of Minutes
The Minutes of the Council meeting of February 5, 1968 were
approved.
Naming of 13aylands
MOTION: Councilman Wheatley moved, on behalf of the Public
Works Committee, (1) that the dedicated parklands within the City
at the baylands be consolidated excluding the sewage treatment
plant; (2) that the entire area be named and designated the John
Fletcher Byxbee Recreation Area; (3) that the recommendation
re the naming of the area be referred to the Public Facilities .laming
Committee for forrnal action; and (4) ::hat the staff be directed to
develop appropriate master plans for signs for the area and come
back with the study to the Committee.
The motion carried unanimously by voice vote.
Civic Center Bid Proposals (CMR 195 and CMR 203)
City Manager Morgan presented his report on Civic Center bids,
noting that $106, 829 has been granted by the federal government
toward costs of the emergency operating-e:eriter, , -
Mrs. Mildred C. Justesen, 420 Seale, Palo Alto, urged the Council
to reverse their decision as to building a new civic center, and
recornnnended only the underground garage be built with a street
level park.
Arthur Covitt, 3324 Middlefield Road, Palo Alto, urged the matter
of the civic center be referred to the electorate again and another
vote taken.
MOTION: Councilman Cooley moved, seconded by Councilman
Beahrs, that Dillingham Construction Corporation be declared the
lowest responsible bidder on the Civic Center project, and that the
contract be awarded to them on the basis of their low bid, with the
modifications in the plans and specifications made by the contractor
and recommended by the architect and staff.

In response to question from Councilman Berwald, Mayor Dias
ruled that it is proper to vote on the award of contract before vot-
ing on the appropriation ordinance, because it will be necessary
to know what amendments may be made which will effect the
appropriation amount.
CHALLENGE: Councilman Berwald cLallenged the ruling.
Discussion followed and City Attorney Hildebrand replied to
questions concerning the desirability of considering an appro-
priation ordinance before an award of contract and the necessity
in the particular case of knowing what items are to be included
in the contract.
Councilman Berwald withdrew his challenge.
John Hill, architect from Edward D. Stone, Inc., came forward
to respond to questicns from Council members.
AMENDMENT: Councilman Wheatley moved, seconded by
Councilman Comstock, to delete deduction "2-3 Aluminum Ex-
posed Window Frames" in the amount of $4, 000.
Discussion followed concerning the difficulty of considering
alternatives to be offered as amendments until all such proposed
amendments are known, and at the request of Councilman Clark,
each member made known any amendments he planned :o offer.
The amendment regarding item 2-;l carried by majority voice vote
AMENDMENT: Councilman Berwald moved, seconded by Coun-
cilman. Comstock, to delete deduction "Z -E Carpet" in the amount
of $36, 300.
The amendment regarding item 2-E failed on the following tie
roll call vote:

Noes: Clark, Dias, Pearson, Spaeth, Wheatley
AMENDMENT: Councilman Constock moved, and it was duly
seconded, to include " l -A Pneumatic Tubes" in the amount of
$52, 940.
The amendment regarding item l -A carried on the following roll
call vote:
Ayes: Beaters, Clark, Comstock, Cooley, Dias, Pearson
Noes: Berwald, Gallagher, Spaeth, Wheatley
AMENDMENT: Councilman Comstock moved, seconded by Council
Beahrs, to include "1-B Paint Parking Garage" in the amount of
$25,700.
The. amendment regarding item 1-13 failed by majority voice vote.
AMENDMENT: Councilman Comstock moved, seconded by
Councilman Beahrs, to include "1-D Police Elevator" in the
amount of $15, 000.
The amendment regarding item 1 -D failed by majority voice vote.
AMENDMENT: Councilman Comstock moved, seconded by
Councilman Beahrs, to include "1-E One Parking Garage Elevator"
in the amount of $26, 000.
The amendment regarding item 1-E failed on the following roll
call vote:

Noes: Berwald, Clark, Dias, Gallagher, Spaeth, Wheatley
AMENDMENT: Councilman Constock moved, seconded by
Councilman Beahrs, to include "1-G Drapes and Tracks" in the
amount of $10, 750.
The amendment regarding item 1-G carried by majority voice vote.
AMENDMENT: Councilman Comstock moved, seconded by
Councilman Beahrs, to delete deduction "Z -It 148 Parking Garage
Lights" in the amount of $3, 800.
The amendment regarding item 2-F, carried by majority voice
vote,

The motion to reconsider carried on the following roll call vote:
Ayes: Berwald, Clark, Gallagher, Pearson, Spaeth,

Noes: Beahrs, Comstock, Cooley, Dias
MOTION: Councilman Wheatley moved, and it was duly seconded
to reinstate deletion of "1-A Pneumatic Tubes."
Mayor Dias ruled that the motion was not needed as reconsider-
ation of the vote automatically returned the item to the status it
had before any vote was taken, and Councilman Wheatley withdrew
hie motion.

AMENDMENT: Councilman Berwald moved, seconded by Council-
man Clark, to "rough in" facilities for a future pneumatic tube
at a cost of approxirnately $21,300,
MOTION: Councilman Spaeth moved to continue the matter for
two weeks. The motion failed for lack of a second.
The amendment then failed on the following roll call vote:

Noes: Beahrs, Clark, Comstock, Cooley, Dias, Gallagher,
Pearson, Spaeth, Wheatley
AMENDMENT: Councilman Comstock moved, seconded by
Councilman Beahrs, to include "1-A Pneumatic Tubes" in the
amount of $52, 940.
The amends, -lent regarding item 1-A carried on the following
roll call vote:
Ayes: Beahrs, Berwald, Clark, Comstock, Cooley, Dias,
Pearson
Noes: Gallagher, Spaeth, Wheatley
The motion as amended to include items 1-A and 1 -G and delete
deductions of items 2-3 and 2-R then carried on the following
roll call vote:
Ayes: Beahrs, Berwald, Clark, Comstock, Cooley, Dias,

Wheatley

MOTION: Councilman Cooley introduced the following ordinance
and moved, seconded by Councilman Beahrs, its adoption with the
amount indicated in the first blank to be $4,330,837 and in the
second $698,337:
Ordinance No. 2405 entitled _"Ordinance -of -the -Council of the
City of Palo_ Aitc -Arr;ending the Budget for the Fiscal Year
1967-1968 to Make an Additional Appropriation for Construction
of the Civic Center, Project 65-6."
The ordinance was adopted on the following roll call vote:
Ayes: Beahrs, Berwald, Clark, Comstock, Cooley, Dias,
Gallagher, Spaeth, Wheatley
Noes: Pearson
(The Counc't recessed from 9:55 to 10:14 p.m. Councilman
Wheatley did not return.)
Councilman Pearson requested that her "aye" vote on award of
contract (Note: see above) be changed to "no."

Human Relations Council Appointment
Mayor Dias advised that the Council had met in executive session
during the recess to consider an appointment to fill the vacancy
on the Human Relations Council.
MOTION: Councilman Berwald moved, and it was duly seconded,
to ratify the appointment of the Mayor of Reverend Jun W. Jue
thr ,acant three year term on the Palo Alto Human Relations
Council and to make recommendation to the Fair Employment
Practices Commission that Reverpnrt .rile. hp apnnirt d

Gas Main Easement - Southern Far_ fic Cr_sRinte (CMR 202)
MOTION: Councilman Comstock moved, and it was duly seconded,
to authorize the Mayor to execute a document prepared by the
Southern Pacific Company granting an easement at their right-of-
way near Eribar•cadero Road and requiring payment of $25. 00
per annum.
The motion carried unanimously by voice vote.
Girl Scout Lease (CMR 2& 4)
MOTION: Councilman Spaeth moved, seconded by Gallagher, to
authorize the Mayor to execute the lease of land in Rincon:ada
Park to be used for a Girl Scouts clubhouse for an additional ten
year period.
The motion carried unanimously by voice vote.
Palo Alto Municipal Code - Supplemental Service
__MOTION: Councilman Spaeth moved, seconded by Councilman
Beahrs, to approve the contract with Book Publishing Company
fnr supplemental service to bring the PAMC into effective
operating status and authorize the Mayor to execute the agreement.
MOTION: Councilman Pearson moved, seconded by Councilman
Berwald, to refer the matter to the, Finance Committee.
The motion to refer failed by majority voice vote.
The motion to approve the contract then carried by majority voice
vote.
MOTION: Councilman Comstock moved, seconded by Councilman
Beahrs, that the method of printing revisions to the PAMC be
referred to the Finance Committee.
The motion carried unanimously by voice vote.

Association of Bay Area Governments
MOTION: Mayor Dias moved, seconded by Clark, that a resolu-
tion regarding the Association of Bay Area Governments be
considered at this time, stating the urgency related to the ABAG
meeting to be held on February 23, 1968.
The motion carried by majority voice vote.
MOTION: Councilman Gallagher introduced the following
resolution and moved, seconded by Councilman Clark, its
adoption:
Resolution No. 4082 entitled "Resolution of the Council of
the City of Palo Alto Reaffirming Support of the Association
of Bay Area Governments"
AMENDMENT: Councilman Comstock moved, seconded by
Councilman Beahrs, that (1) in the sixth paragraph the words
following "support" be deleted and "of the regional for
the solution of the compounding problems of the area;" be sub-
stituted; and (2) the seventh paragraph be deleted entirely.
At the request of Councilman Berwald, Mayor Dias ruled the vote
on each pact of the amendment would be separate.
The first part of the amendment carried by majority voice vote.
The second part of the amendment carried on the following roll
call vote:
Ayes: Beahrs, Clark, Comstock, Parson, Spaeth
Noes: Berwald, Cooley, Dias, Gallagher
The resolution as amended carried unanimously by voice vote.
Ordinance re Working on Motor Vehicles
MOTION: Councilman Cooley moved, and it was duly seconded,
to place the correspondence received from Roger F. Berg,
770 Gallen Court, Palo Alto, concerning working on motor
vehicles and storage of parts cnthe next Council Agenda.
MOTION: Councilman Gallagher moved, and it was duly seconded,
to refer the correspondence to the Planning and Procedures
Committee.
The motion to refer carried by majority voice vote.
