RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
UR.JING SUPPORT OF S. B. 231 CLARIFYING CERTAIN BAY
CONSERVATION AND DEVELOPMENT CO MMISSION CONTROLS
WHEREAS, the San Francisco Bay C onservati on and Development
Commissio n (hereinafte r refe rred to as BCDC) was creat ed by th e
State Legisla ture to p repare a plan for the futur e d evelopment
of San Fr ancisc o Ba y that would minimize any fu rthe r filling
and diminution of the Bay; and -
WHEREAS, in order to forestall f urther chang es of the Bay
while the plan was being pr epared, the Legislature als o granted
the BCDC the po wer to prev ent all filling th at was not found to
be of imme diate nec essity and ben efit to the wh ole B ay r egi on;
and
WHEREAS, the BCDC is required to submit to th e Legislature
its proposed plan a nd its reco mme nda tions fo r carrying o ut the
pla n in Januar y 1969, but is to co ntin ue in ex istence until 90
days after the te rmina tion of the 1969 se ssion of the Legislature
in or der to maintain co ntr ol ove r Bay filling until the Legis-
lature acts on the BCDC re commenda tions; and
WHEREAS, am biguity in the present BCDC statute makes
possible the interpretation that BCDC's power to contr ol filling
termina te s when the BCDC plan is completed (at the e nd of 1968,
instead of upon the expiration of BCDC itse lf, raising the
spectr e of ma ny mor e fills be ing initiated to obtain "grandfather
rights" before the Le gislature has time to act; and
WHEREAS, Se nate Bill #231 has been intro duce d into the
Legislature with the e xpress purpose of clarifying the or igina l
BCDC Act and making certain the fill co ntrol po wer extends fo r
the life of the Co mmission; and

WHEREAS, San F rancisco Bay is a nati onal and state s cenic,
ecol ogical and economic asset th at should n ot be further changed
by indiscriminat e additional filling and dredging.
NOW THEREFORE BE IT RESOLVED that th e Co uncil of the City
of Palo Alt o strongly end orses S en ate Bill #231 and urges its
speedy and timely enactment .
BE IT FURTHER RESOLVED that the City Clerk of the City of
Palo Alto is hereby di rected to send copies of this resolution
to the Gov ernor, the Honorable Sen ator Bradley and Assemblymen
M ilias and Va sconcellos.
