RESOLUTION NO . 4104
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
INITIATING PROCEEDINGS TO ANNEX TO SAID CITY OF PALO
ALTO CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN
AND DESIGNATED "EL CAMINO REAL ANNEXATION #7:1-68"
AND GIVING NOTICt JF THE TIME AND PLACE FOR HEARING
PROTESTS THERETO
The Council of the City of Pal o Alto d oes RESOLVE as fol-
lows:
SECTION 1. That, pu rsuant to th e provisions of th e Ann exa-
tio n of Uninhabited Te rrito ry Act of 1939, proceedings are h ereby
initiated by the Council of the City of P al o Alto, on its own
mo tion, to annex to the City of Palo Alto all that uninhabited
terr itor y situa ted in the County of Santa Clar a, Stat e of
Ca lifornia, her eby designated as "El Camino Real Ann exation #7:
1-68" a nd mo re fu lly described in EXHIBIT A attached her et o and
made a part he reof.
SECTION 2. That the Council of the City of Palo Alto
desire s to annex said uninhabited territor y to the City of Pal o
Alto for the following reasons: California State Highwa y 82,
kno wn as El Camino Re al, between a po int in the vic inity of
Curtner Ave nue and a point in the v icinity of M aybe ll Avenue, a
dista nce of a pproximately 2,450 feet, mor e or less, and the
portio ns of sa id El Camino Real to the so utheast and to the
northwest of the a bove po rtion, all de scribed in said EXHIBIT A,
ar e within the incorporated limits of the C.ty of Palo Alto,
the said terr itory is contiguous to and bounded to the north-
east by sa id City; it would be in the public inte re st to a nnex
that portion of El Camino Real described in EXHIBIT A to the
City of Palo Alto to co ntribute to the orderly gr owth of the.
City, and provide the proper contro l of street layo ut, design,
and ins ure the p roper use of land in conformity with the over-
all zoning plan of the City; the Bo are of Supe rviso rs of the
County of Sant a Clara by resol ution adopted April 10, 1967
r equested the City of Palo Alto to initiate annexation proceedings
of this territory.
SECTION 3. Th at the Sant a Clar a Local Ag ency Formation
Commissio n did in session duly assembled on March 5, 1968 appr ove
said proposed annexation in the manner pro vided by law.
SECTION 4. That Monday, May 6, 1968, at the hou r of 7:30 p.m.
in the -Council Chambers in the City Hall in the City of Palo
Alto, County of Santa Clara , California, is hereby fixed as the
time and place when and where a ny person owning r eal property
within the u_inhabited terr itory a bove des'ribed and pr op osed to
be annex ed to the City of Palo Alto , and ha ving any obje ctions
to the proposed a nnexation; may a ppear before the Council of the
City of Palo A lto and sho w cause why su ch uninhabited ter ritory
should not be so annexe d to said City of Pa lo Alto. Such pro-
test mu st be in writing, ma y be filed at any time prior to fin al
adjo urnme nt of the hearing on protests to the propo sed annexati on,
and.shall state the name or names of the o wner or owners of property
affe cted, and the street.addess or other description of the pros
perty:su£ficien t to ide ntify it on the last e qualized asse ssment roll.
SECTION 5. The City Clerk of the City of Palo Alto is he reby
authorize d and dir ected to c ause a copy of this resolution to be
published at lea st twice , but not o ftene r than once a we ek, in
the PALO ALTO TIMES, a newspaper of general circulation pu blished
in said City of Palo Alto, the city to which it is pr oposed to
annex the a foresaid territory, and a lso in the SAN JOSE MERCURY,
a newspa per of ge ne ral circulation published outside the City of
Palo Alto , but in the Co unty of Santa Clara, Califo rnia, the
County in which is locate d the territory proposed to be ann ex ed
to the City of Palo Alto, said publicati on to be completed at
least twenty days p ri or to th. date set for hearing.
SECTION 6. The City Clerk is further authorized and directed
to cause written notice of such proposed a nnex atio n to be wailed
to each person to whom la nd within the territ ory proposed to be
an nex ed is assessed in the last equali zed county assessment roll
av ailable on the date the abo ve said proceedings we re initiated,
at the address sho wn an said assessment roll or known to the Clerk,
and to an y person who has filed his n ame and address and the
designation of the lands in which he h as an interest, either
legal or e quitable, with the Clerk, such notic e to be giv en n ot
less tha n twenty (20) days before the first public h earing on
the propo sed annexation.
SECTION 7. The City Cle rk is further di rect ed to cause
written notice of such propo sed annexation_ to be mailed to the
Board of Supervisor s of the Co unty of Sa nta Clara, such n otice
to be give n not less than twe nty (20) days before the first public
hea ring on the propose d annexatio n.
SECTION 8. The City Co uncil of the City of Pa lo Alto he reby
de signates the da te of adoption of the o rdinance approving the
annex ation as the date when this annexation will become effective.
SECTION 9. The City Cle rk is dir ected to ca use written
notice to be given to such other persons as ma y be legally en -
titled thereto, in the ma nner requir ed by law.

Be ginning at the point of intersection of the Southw est erly
lu te of El CP o Real (State Highway) with a Corporat e Limits Lin e
of the City of Palo Alto lying o pposite Enginee r's stati on 158 + 77.50
as surveyed by the C alifornia Division of Highways, said Co rp orat 3
Limits Line be ing as e stablished by Annexation " El Camin o R eal N o. 4",
rec orded with the Se cretary of State on April 28, 1961; thence along s aid
Corpora te Limits L ine , N. 33. 17' E. 96.0 fee t to a point on the No rth-
easte rly line of El Camino Re al, s aid Northeas terly Line being also the
Cor porate Limits Line of the C ity of Palo Alto; thenc e So utheasterly
along said Nor th easte rly line S. 56? 43' E. 864.95 feet to a point;
the nce So utheasterly along a curve to the r ight, having a ra dius of 3050
feet; thro ugh a c entral angle of 23' 53', for an a rc distance of 1271.37
