A RESOLUTION OF PRELIMINARY DETERMINATION AND OF
INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS
OLD TRACE ROAD, ET AL.
PROJECT NO. 64-4

RESOLVED, by the Council of the City of Palo Alto, California, as
follows:
1. That it does hereby preliminarily determine that the public
interest, convenience and necessity require and that it intends to orde'
the following work to be done and acquisitions and improvements to be
made, to -wit:
a) The widening and improving of all of that portion of Manuela
Avenue within the boundaries of the City limits of the City of
Palo Alto from the Foothill Expressway to the northerly City
limits of the Town of Los Altos Hills, by the acquisition of
easements necessary to achieve uniform right of way widths of
6o feet and by grading and the construction therein of base pave-
ment and wearing surface, together with Portland cement concrete
curbs and gutters to a width of 32 feet from curb to curb,
together with an 8 -foot rustic path and a 12 -foot reserve for
equestrian use, and together with such storm sewerage and drain-
age facilities as may be required for adequate drainage, and
street lighting facilities.
b) The widening and improving of Oak Hill Avenue from Arastradero
Road to Mesa Avenue and Mesa Avenue from Manuela Avenue westerly
about 700 feet by the acquisition of easements necessary to
achieve uniform right of way widths of 50 feet and by grading
and the construction therein of base pavement and wearing surface,
together with Portland cement concrete curbs and gutters to a
width of 30 feet from curb to curb, together with an 8 -foot
rustic path and a 12 -foot reserve for equestrian use, and together
with such storm sewerage and drainage facilities as may be re-
quired for adequate drainage, and street lighting facilities.
c) The improving of Robb Road from Manuela Avenue westerly to its
westerly terminus by the construction of street lighting facili-
ties.
d) The opening and improving of an unnamed cul-de-sac between Manuela
Court and Robb Road from Manuela Avenue westerly about 550 feet,
by the acquisition of easements necessary to achieve uniform right
of way widths of 25 feet and by .grading and the construction there-
in of base pavement and wearing surface together with Portland
cement concrete curbs and gutters 20 feet in width from curb to
curb, together_with a 4.5 -foot rustic path and together with
such storm sewerage and drainage facilities as may be required
for adequate drainage, and street lighting facilities.
e) The opening and improving of Old Trace Road from Arastradero Road
southeasterly and southwesterly about 1350 feet by the acquisi-
tion of easements necessary to achieve a uniform width of 50 feet
except for a cul-de-sac turnaround area at the southwesterly
terminus thereof, and by grading and the construction therein

of base pavement and wearing surface, together with Portland
cement concrete curbs and gutters to a width of 30 feet from
curb to curb, together with an 8 -foot rustic path and a 12 -foot
reserve for equestrian use, and together with such storm sewer-
age and drainage facilities as may be required for adequate drain-
age, and street lighting facilities.
f) The opening and improving of Clark Drive from Arastradero Road
southeasterly to the northwesterly corner of the proposed park
property of the City of Palo Alto, by the acquisition of easements
necessary to achieve a uniform width of 50 feet except for a cul-
de-sac turnaround area at the southwesterly terminus thereof and
by grading and the construction therein of base pavement and wear-
ing surface together with Portland cement concrete curbs and
gutters to a width of 30 feet from curb to curb, together with an
8 -foot rustic path and a 12 -foot reserve for equestrian use, and
together with such storm sewerage and drainage facilities as may
be required for adequate drainage, and street lighting facilities.
g) The opening and improving of Manuela Court from Manuela Avenue
westerly about 850 feet and an unnamed cul-de-sac from near the
southwesterly terminus of Old Trace Road southeasterly about 350
feet, by the acquisition of easements necessary to achieve uniform
right of way widths of 44 feet except for a cul-de-sac turnaround
area at the southeasterly terminus of the cul-de-sac, and the con-
struction'therein of grading, base pavement and wearing surface
and Portland cement concrete curbs and gutters to a width of 24
feet from curb to curb, together with an 8 -foot rustic path and a
12 -foot equestrian reserve and together with such storm sewerage
and drainage facilities as may be required for adequate drainage,
and street lighting facilities.
h) The opening and improving of emergency fire protection roads from
Clark Drive to Old Trace Road and from the cul-de-sac running off
of Old Trace Road to the westerly end of Manuela Court by the
acquisition of easements necessary to secure a uniform right of
way width of 23 feet, and the construction therein of grading and
base pavement improvements to a 15 -foot width and an 8 -foot
equestrian reserve.
i) The construction of water mains, valves, hydrants, services and
appurtenances within streets and public easements to be acquired
herein as is necessary to provide a complete domestic and fire
protection water system to serve all properties within the bounda-
ries of the assessment district which are not already served by a
permanent connection to a permanent standard -size water system of
the City of Palo Alto.
j} The construction of sanitary sewer mains, wye branches, laterals,
manholes and appurtenances in such streets and public easements
as are necessary to provide a complete system of sanitary sewerage
facilities to provide service to all properties within the assess-
ment district which are not now connected by a permanent connection
to a permanent standard -size sewer system of the City of Palo Alto.
k) The construction of a new gas distribution system within the
streets and public easements within the assessment district in
order to provide adequate facilities for extension of gas service
to properties not now served in said district.
The acquisition of all lands and easements necessary to accomplish
any of the foregoing work.

m) The conversion of existing overhead electric power facilities of
the City of Palo Alto and the existing overhead telephone facili-
ties of The Pacific Telephone and Telegraph Company to underground
locations to serve all of tha properties within the proposed
assessment district, by the construction of primary and secondary
facilities, splice boxes, transformer vaults and appurtenances.
n) The acquisition of all lands and easements and the construction of
all work auxiliary to any of the above and necessary to complete
the same, including the removal and disposal of all overhead
electric and telephone poles and facilities.
2. It is intended by the Council of said City to enter into an
agreement with The Pacific Telephone and Telegraph Company, which agree-
ment will provide for the ownership by said Company of underground tele-
phone facilities in said City to be installed by said Company, and for
the providing of service to the properties in said area by said Company
in accordance with its rates, rules and regulations, and that said
agreement shall become effective after proceedings have been taken for
the levy of the assessments and sale of bonds and funds are available
to carry out its terms.
3. All of the blocks, streets and alleys herein mentioned are or
will be shown on maps of record in the office of the County Recorder
of Santa Clara County, State of California, and shall be shown on the
plans herein referred to and to be filed with the City Clerk of said
City.
4. Whenever any public way is herein referred to as running
between two public ways, or from or to any public way, the intersec-
tions of the public ways referred to are included to the extent that
work shall be shown on the plans to be done herein.
5. All of said work and improvements are to be constructed at
the places and in the particular locations, of the forms, sizes, dimen-
sions and materials, and at the lines, grades and elevations as shown
and delineated upon the plans, profiles and specifications to be made
therefor, as hereinafter provided.
6. There is to be excepted from the work above described and of
such work already done to line and grade and marked excepted or shown
not to be done on said plans, profiles and specifications.

7. Said Council does hereby adopt and establish as the official
grades for said work the grades and elevations to be shown upon said
plans, profiles and specifications. All such grades and elevations are
to be in feet and decimals thereof with reference to the datum plane of
the City of Palo Alto.
8. Notice is hereby given of the fact that in many cases said
work and improvement will bring the finished work to a grade different
from that formerly existing, and that to said extent said grades are
hereby changed and that said work will be done to said changed grades.
9. The descriptions of the acquisitions and improvements and the
termini of the work contained in this Resolution are general in nature.
All items of work do not necessarily extend for the full length of the
description thereof. The plans and profiles of the work and maps and
descriptions of the acquisitions, as contained in the Engineer's report,
shall be controlling as to the correct and detailed description thereof.
10. Said contemplated acquisitions and improvements, in the
opinion of this Council, are of more than local or ordinary public bene-
fit, and said Council does hereby make the costs and expenses thereof
chargeable upon an assessment district, which district said Council
declares to be the district benefited by said acquisitions and improve-
ments, the exterior boundaries of which are described as the area
bounded northerly by Arastradero Road, easterly by the Foothill Express-
way and the city limits of the City of Palo Alto, and southerly and
westerly by the City limits, all as more particularly shown on a map
thereof on file in the office of the City Clerk, entitled "Map Showing
Boundaries of Proposed Assessment District, Old Trace Road, et al.,
Project No. 64-04", which indicates by a boundary line the extent of
the territory included within the assessment district and which shall
govern for all details as to the extent of said proposed district.
11. Notice is hereby given that the total cost of the project
(other than the water system to serve that portion of the district
within the boundaries of the Purissima Hills County Water District)
will be spread against properties benefited within the assessment

d) A proposed assessment of the costs and expenses of the
proposed acquisitions and improvements (other than the amount of said
Bond Plan D issue) upon the several subdivisions of land within said
district in proportion to the estimated benefits to be received by such
subdivisions, respectively, from said acquisitions and improvements, and
of the expenses incidental thereto; and
e) Maps and descriptions of the lands and easements to be
acquired.
15. If any surplus shall be realized from the specific lien assess-
ment or from the proceeds of sale of bonds issued_under Bond Plan B, it
shall be spent for the maintenance of said acquisitions and.improvements;
and any surplus remaining from the proceeds of sale of the bonds to be
issued under Bond ..an D shall be deposited in the bond Interest and
redemption fund for said bonds.
16. Resolution No. 3777, A Resolution of Preliminary Determination
and of Intention, adopted by this Council on October 5, 1964, and Reso-
lution No. 3778, A Resolution Requesting Consent of the City Council of
the City of Los Altos Hills, adopted October 5, 1964, are hereby
rescinded.
I hereby certify that the foregoing is a full, true and correct
copy of a resolution duly passed and adopted by the Council of the City
of Palo Alto, California, at a meeting thereof held on the 5th day
of February, 1968, by the following vote of the members thereof:

district in the form of specific lien assessments pursuant to Section
13.12.0+0 of Chapter 13.12 of Title 13 of the Palo Alto Municipal Code,
and that serial bonds to represent unpaid assessments and bear interest
at the rate of not to exceed six per cent (6%) per annum, will be issued
hereunder in the manner provided in Bond Plan B, Section 13.16.110 of
Chapter 13.16 of Title 13 of said Code, the last installment of which
bonds shall mature not to exceed twenty-four (24) years from the second
day of July next succeeding ten months from their date.
Notice is further given that serial bonds to represent that
portion of the total cost of the project which represents the water
system to serve that portion of the district within the boundaries of
the Purissima Hills County Water District and which is not financed by
specific lien assessments, shall be issued pursuant to Bond Plan D,
Section 13.16.130 of Chapter 13.16 of Title 13 of said Code, the last
installment of which bonds shall mature not to exceed twenty-four (24)
years from the second day of July next succeeding ten months from their
date.
The estimated cost of that portion of the project to be
represented by bonds under said Bond Plan D is $ 56,000 and the
portion of said assessment district within the Purissima Hills County
Water District which will be subject -co annual ad valorem land assess-
ments to pay principal and interest on said Plan D bonds is more par-
ticularly shown on said map and identified as the "Bond Plan D Area".
It is the intention of said Council to order the purchase of
said Plan D bonds by the City of Palo Alto at the same interest rate
at which said Bond Plan B bonds are sold and to hold same without the
levy of any annual ad valorem assessments to pay principal and interest
thereon until the first fiscal year next succeeding the exclusion of
the lands within said Bond Plan D Area from the Purissima Hills County
Water District and the relief of said area from any taxes levied by
said County Water District. Interest coupons and bonds maturing prior
to such exclusion and relief will be cancelled without payment. Levies

of ad valorem land assessments to pay principal and interest on said
bonds accruing after such exclusion and relief will be made in said
fiscal year next succeeding such exclusion and relief.
12. Said Council further declares that all public streets, high-
ways, lanes and alleys within said assessment district shall be omitted
from any specific lien special assessments to be made, and that all
public streets; highways, lanes and alleys and other publicly -owned
lands within said assessment district shall be omitted from the annual
ad valorem assessments to be made to cover the costs and expenses of
said acquisitions and improvements or to pay principal and interest on
bonds, respectively.
13. Except as herein otherwise provided for the issuance of bonds,
all of said work shall be done as provided in Section 13.12.040 of
Chapter 13.12 of Title 13 of said Code and Section 17 of Article XIII
of the Constitution of the State of California.
14. Said acquisitions and improvements are hereby referred to the
City Engineer of said City, as the officer having charge and control
of the acquisition and construction of public improvements in and for
said City of the kind described herein, being a competent person
employed by said City for that purpose; and said Engineer is hereby
directed to make and file with the City Clerk of this City a report
in writing, presenting the following:
a) Plans and specifications of the proposed improvements
to be made pursuant to this Resolution;
b) Engineer's estimate of the total costs and expenses of
said acquisitions and improvements and of the incidental expenses in
connection therewith;
c) Diagram showing the assessment district above referred
to, and also the boundaries and dimensions of the respective subdivi-
sions of land within said district as the same existed at the time of
the passage .of this Resolution, each of which subdivisions shall be
given a separate number upon said diagram, and showing the boundaries
of said Bond Plan D Area;
