RESOLVED, by the Council of th e City of Palo Alto, Calif orni
tha t
1. The public in terest a nd convenience requi re, and it
inten ds to o rder the acquisitions and improvements desc ribed as
follows., to -wit:
(a) The acquisition of easeme nts necess ary to
achieve a u niform width of 80 feet along Vest Ch arleston
Road from the S. P.R.R. ROW to E1 Camino Real and the
improv in g thereof, by grading, r emoving trees, bush es
and existing structu res, constr ucting or reconst ructing
Portland cement concrete curbs, gu tters, sid ewalks and
driv eway aprons, storm w ater catch basins, manholes and
drain pipe, eonstr u'oting cru shed roost base pave+eent with
plant mix wearing surface, an d constructing /sanita ry
sew er, water and gas sexwicee wher e requ ired.
(b) The acqu isition of all easemen ts and the
co nstruction of all impr ov emen ts incidental to a ny of
the above an d n ecessary to co mple te same.'
2. Whenever any public way is herein r eferred to as running
between two pu blic ways, or frem or to an y public wa y, the inter-
sections of the public ways re fer red to are in clu ded to the exten t
that w ork shall be shown on the plate to be done therein .
3. Said str eets and highways are more particularly show n in
the records in the Office of the County Recor der of Santa Clara
Cou nty, California, an d shall be shown u pon the plane herein
referred to to be filed w ith the City Clerk of sa id City.
4. A11 of said work an d im provements are to be con stru cted
at the places an d in the particular location s, of the for ms, sizes
dimen sion s an d materials, and at the lin es, grades and elevations
as shown and delineated u pon the plans, profiles and s pecification
to be made therefo r, and filed in the o ffice of the City Clerk,
referen ce td which is hereby made for a full, detailed de scr iption
of such pro posed work an d fo r further particula rs.

5. There is to be exc ept ed from th e work he rei n described
any of such work al ready don• to line and grade and marked e xcepte
or sho wn not to be done on s aid pla ns, profiles and specificati ons
6. Notice is hereby given of the fact that in many cases
said work and improveme nts will b ring the finished w ork to a g rade
different from that forme rly existing, and th at to said extent
sa id grades ar e hereby changed a nd that s aid work will be done to
sa id changed gr adea.
7. Said Council does hereby adopt and establish as th e
o fficial gra des for said w or k the grades and elevations to be
sho wn upon said plan s, pr ofiles and specifications . All such
grades and elev ation s ar e to be in feet and decimals there of with
reference to the datum plane of the City of Palo Alto .
8. The descriptions of the acquisitione and improveme nts
an d the termini of the work co ntained in this resolution ar e gen-
e ral in nature. All items of work do not necessarily exte nd for
the full length of the description thereof. The plans and pr ofil e
of the w ork and the map and descr iption s of the acquisitions, as
containe d in the Engineer's repo rt, snail be contro lling as to the
correct and detailed description the re of.
9. All of said work a nd impr ovemen ts shall be done un der
the super vision of the City En gineer of said City a nd all said
wor k and materials ahall be do ne and fur nished to his sa tisfactio n
10. The estima ted co st of said pr oje ct is $130,421. 81. The
City w ill co ntr ibute all co sta of acquisition a nd improvement
invo lve d in w idenin g to in excess of 60 feet.
11. Said contemplated acquisitions and improvements, in the
opinion of this Coun cil, are of more tha n lo cal or ordinary public
benefit, a nd the balance of the costs and expenses of doing said
wo rk an d the e xpen ses incide ntal thereto, ahall be made chargeable
upon the distr ict ben efited ther eby, which district shall con sist

of the consolidated, and composite areaa of all of the parc els of
pro perty fronting on said work, together with oth er adjacent are as,
and the exterio r bou nda ries of said district are he reby declared
to be the cotermino us bounda ries of :said comp osite and consolidateC
area. The property so benefited, and the bounda ries th ereof, are
more par ticular ly shown on the m ap of said assessme nt dist rict on
file in the office of the City Cle rk, to which r eference is hereby
made for a more detailed description thereof,
12. Said Council fur ther declares that all public st reets
and highw ays within said assessment district in use in the perf orm-
ance of a public function as such, shall be omitted f rom the assess
men t herea fter to be made to cover the costs a nd expe nsee of s aid
a cquisitions and improvements.
13. Notice is here by given tha t bon ds to represent the
u npa id a sae samente and bear in ter est at the r ate of not to exceed
six per cent (6%) per annum w ill be issued pu rsuant to Bond Plan
C, Part 4, Article IV of the Palo Alto Improve ment Pro cedure Code,
the last installment of which bo nds shall matur e n ine (9) years
fr om the secon d day of July next succe edin g te n months fo llowin g
their date.
14. Exce pt as here in othe rw iee provided for the is suance
of bon ds, all of sa id w ork and improvements, and the pr oceedin gs
ther efo r shall be had pu rsu ant to Article V of said Co de .
15. Notice is here by giv en tha t Mon day, the llth day of
Januar y, 1960, at the hour of 7:30 o'clock P.M. at the Council
Cha mber s of the Council of said City, in the City Hall of eaid
City of Palo Alto, ar e hereby fixed as the time and pla ce when
an d w here an y an d all per son s having any objections to the pro-
posed acquisitions a nd impr ovemen ts or a ga inst the distr ict to
be assessed for the co sts and expenses ther eof, or to the City
Engineer's estimate of the costs and expensee thereof, or a gainst

the gr ades at which said work shall be do ne, may appe ar before
sa id Council and sh ow caus e why said proposed acq uisitions and
improv ements sho uld not be c ar ried out in accordanc e with this
Re solution of Inte ntion .
16. The Clerk of said City shall cause this Resolution
of Inte ntion to be published twice in the P al o Alto Times, a
daily newspaper, published and ci rcul ated in the City of Polo
Alto, which said pa per is hereby designated fo r that pu rpose,
and which is hereby deeigna ted as the newspap er in which all
further notices required to be made herein shall be published.

resolution adopted by the Council of the City of P alo Alto,
California, at a re gu la r meeting thereof held on the 14th d ay
of December, 1959, by the following vote of members thereof:
