HomeMy WebLinkAboutRESO 3173• KW1iVtKIJ:owh 11,8/59 10C RESOLUTD1N WO. 3173 A RESOLUTION OVERRULINO PROTESTS AND DS TEAMI iING TO PROCEED WITHOUT Cq!!lx.I4NOB, WITH IDIVRATIOATION ACT IfiguasUkRIAMON dr NO. 59-9 RESOLVED, by the Cdu hci'1 of the City of Palo Alto, California,' that WHEREAS, on November 23, 1959, this Council adopted its Reso- lution No. 3160 of Preliminary Deter mination to make c ertain acqui4 actions and impr ov ements mor e partic ul arly described therein and did fix Monda y, December 14, 1959, at the Co uncil Chambers in the City Hall, as the time and pla ce when and whe re any and all pe r- sons intereste d may appear and show ca use, if any they ha ve, why the Council should not find and determine that the p ublic c onven- ience and necessity' require the acquisition s and impr oveme nts described an d r eferr ed to in said resolution, without compli anc e with the Special Assessment Investigation, Limita tion and M aj ority Protes t Act of 1931; WHEREAS, n otice of the ado ption of said preliminary re solution' and of said time end place of hear ing was given by the City Clerk by publication an d posting for the time and in the manner prov ide d in said Reso lution of Preliminary De ter mination and Article 1 of the Palo Alto Improv ement Pr ocedure Co de, as appears from a ffida- v its on file w ith the City Clerk; WHEREAS, no written objection s to the un der taking of said proceedings withou t first oompiying with the provisions of said Investigation Act n ave been filed w ith the City Clerk at or before the time fixed fo r this hea ring by per son a intereste d, owning or havin g an inte rest in r eal prope rty w ithin the pr oposed assessme nt distriot, bea rin g their signatur e, a description of their proper ty, and a stateme nt of the n ature of theia interest ther ein; and • • 'v 7 WHEREAS, all persons interested have been gi ven an opp ortun- ity to be and were fully hea rd, and said C ouncil has duly co nsid- er ed any and all objections and p rotests m ade, and th e a aid propos acquiaitiune and improveme nts, and the p ublic convenience a nd necessity ,for making came. NOW, THEREFORE, IT IS . POUND, aMEONINSD and ORDERED, as follows: 1. The public convenience a nd necessity req uire the acquisi- tion and im prov ements described in Ita1 4 Re sol ution of Preliminary Deter mination; 2. Any and all objections and protests made p ursuant to said Reso lution oi'Pr elimin ary Deter mination are hereby, overruled and denied; 3.
