did pre liminarily determine that the public i nterest, convenience
and neoessity require, an d that it intends to orde r certain chang e
and modifica tions therein par ticularly described in the proceeding
bein g conducted pur suant to Resolution No. 3129 of Preliminary
Determination and Resolution oiInten tion No. 3141, adopted by
this Council on Au gust 24, 1959, en d Se ptember 28, 1959, respec-
tiv ely;
WHEREAS, pursuan t to sa id Resolution No . 3158, notiee has
been duly given of the tithe an d pled(' when a nd where bald Council
will conside r an d fina lly de ter mine whether the puhlio interest,
convenience a nd necessity require said cha nges, and when and w here
it will consider and fin ally set upon the matter of peaking said
cha nges a nd modifications an d when and wher e it wi11 hear all pr o -
teats in re lation thereto;
WHEREAS, no written objection s to the un derta king of
said proceedings without fir st complyin g with the provisions of
the Spe cial Assessmen t Investiga tion, Limitation an d Major ity
Protest Aot of 1931, have been filed with the City Clerk at or
before the time fSx ed for this her ring by per sona in ter ested,
o wning or ha ving an inte rest in real pro perty Within the assess-
m ont district, bear ing their signa tu re , a descr iption of their
pr oper ty, a nd a statement of the n a.;. ur e of their intereat ther ein;
and
WHEREAS, all p erso ns interested have been given an oppo rtun, .
ity to be a nd we re f ully hea rd, a nd said Cou ncil has duly c onsid-
ered any and all objections and p rotests m ade, and the said
proposed changes and the public convenie nce and necessity f or
making same;
NOW, THEREFORE, IT IS POUND, DETER MINED and ORDERED, as
follows:
1. The pu blic con venience a nd necessity require the changes
an d mo dification s described in s aid Resolution No. 3158, adopted
by this Council on November 23,.1959.
2. An y and all objections and protests m ad e pursuant to
sa id Resolution No. 3158 ar e hereby overrul ed a nd d enied .
3. Sa id chan ges an d mo dification s are hereby orde red to be
ma de and ha d, a ll as more particularly se t forth in s aid Resolu-
tion No. 3158; provided, that the description of the acq uisitions
and impr ov ements on Gary Court shall rea d as follows:
The acquisition of a right of service in an electrolier
w ith co nduit, conductor cable an d pull boxe s in Gary Cou rt .
4. The Special Assessment Investiga tion, Limitation and
Majority Prote st Act of 1931 shall n ot a pply to said pro cee dings.
I here by certify the foregoing to be a tr ue c opy of r esolu-
tion adopted by the Council of the City of Palo Alto, California ,
at a regular meeting thereof held on the 14th day of December ,
1959, by the followin g vote of the members thereof:
