The Council of the City of Palo Alto met in regular ses-
sion on this date at 7:30 p.m., with Mayor Cooley presiding.
:toll call as follows:
Present: Cooley, Cramer, Henry, Jordan, Miller, er, Peterson, Snyder
Swain, Thoits, Vail, Wing.
Absent: Ackley, Congdon, Mosher, Roller.
The minutes of the regular meeting of January 8th and of
the adjourned meeting of January 22, 1917, were read and approved
as read.
Westall-Boyce Offer of Land.
A communication was received from the Boyce. and Westall
estate, offering to sell to the City for 17,000 the property
fronting 225 feet on Lytton Avenue between Emerson and Ramona
streets to a depth of 100 feet.
On motion of Vail and Swain, the proposition was re-
ferred to the City Planning Commission.
A communication was received from Chas. Ed. Hodges,
arabitecto offering to furnish free designs and superintendence
for the improvement of the plaza entrance.
On motion of Wing and -Swain the matter was referred to
the City Planning Commission .and the clerk was. instructed to
write a letter of thanks to Mr. Hodges.
Letter from P.G. E.Co.
A-co:oniunication' from the Pacific Gas and Electric Co.
requesting the Council to delay action in calling an election
to vote bonds for Diesel engine sets pending an offer from said
company to furnish current to the city was, on motion of Vail and
Peterson, referred to the Board of Public Works.
As Change in hi0-1 Tension Lines.
A report from the Board of Public Works. transmitting
a proposal of the Pacific Gas and Electric Company, to make
certain changes in its high tension Lint-:, and recommending said
changes was on motion of Wing and Thoits referred to the City
Planning Commission to report.
Gas Complaint to ?.R.Co rmis i.on. .
A report was received from the i;oard of Public Works
transmitting the following resolution, passed by said Board on
r 6c glary 5, 1917:
'"Resolved, That the Board of Public Works recommends to the
City Council 'th.a t the City of Palo Alto file a formal complaint
with the State Railroad Commission as to the quality of gas
furnished to censurers by the Palo Alto Gas Company and as to the
rates charged therefor."
The repoz°t was accompanied by correspondence between.
Prof. C. Cross -and the State Railroad Commission and a tabula`
tion of testa of gas furnished by said company, said tests having
oee'n made by Prof. Cross in the laboratories at Stanford :7niver-
sity during each year since 1911. Prof. Cross addressed
Council in regard, to the matter
On motion the report was approved.
As to Garbe.r,e CoIlcction.
A report was received from the Board of7' ub1ic Safety
recommending that provision be made in the budget for the fiscal
Year 1917-1918 for the collection of garbage by the city instead
of under contract.

On motion of Vail and Jordan the recommendation was

power to act, reported that it had 'peen arranged to pay $17.50
a month for said purpose, said police judge to provide at his
own expense s, room for holding court.
On motion of Wing and Thoits an appropriation of said
sum monthly from the general fund woes made by unanimous vote on
roll call.

On motion of Vail and Swain the report was received
and the recommendation approved.

Wing introduced and roved the passage of a resolution.
entitled "Determining that the public interest and the public
necessity demand certain public municipal improvements in end
for the city of Palo Alto, the cost of which will be too great
to be paid out of the. ordinary income and revenue of said -city,
to wit: the acoui.uition by purchase of two Diesel engine gen-
erating sets." The motion was zeconded by Swain and was lost or,
roll call by the followingvote, ten votes being required for
its passage:

A resolution . entitled "Resolution of the Council of the
City of Palo Alto relating to quality of and rates for gas mad
by the Palo Alto Gas Co :parry to its customers," was introduced
and its passage moved by Vail. The motion was seconded by
and carried by unanimous vote on roll call.
Re -ports Received,
The. report of the Department of Public Works for fie^
cember,. 1916, and the reports of tae Auditor and Treasurer for
January, 1917, were received -and ordered filed.
' The City Attorney made a verbal report in regard to the
progressof the suit of Thoits vs Byxbee anal that of the City vs
the Palo Alto Gas Company.
As to• Loaning Cif Funds.
The City Attorney Repotted that the amendments to the
city charter recently adopted have been approved by the State
-Legislature.
On motion of Vail and Cramer Committee #4 was instruct-,
ed to find means of placing on interest funds now in the City
Treasury.
At this time Councilman Congdon took his seat.

The City Attorney reported that a claim of W.H.Otta
for work done on Middlefield road bridge in 1914 in the vom of
$844.03 had been referred to him for adjustment by the 'hoard of
Public -Works. He had arranged to settle said claim by the pay'
ment of $400 upon the signing by said Otto of a release in full
of all demands.against the City of Palo Alto, the City Council,
the Board of Public Works, the individual members: of said Coan-
cii and said Board, the City Engineer oath in his official and
individual -capacity, and all other officials of said city.

Miller called attention to the fact that the large
flag owned by the city has been worn out and that a new one is
needed.
On motion of Wing and Peterson .::appropriation not to
exceed $140 from the general fund was made for the purchase of
a flag, by unanimous vote on roll call.
