The Council of the City. of Palo Alto m
7:30 p.m., pursuant to adjournment of January 8,
Cooley presiding. Roll call as follows:
Present: Ackley, Congdon, Cooley, henry, Jordan
Roller, Snyder, Swain, Thoits.
Absent: Cramer, Peterson, Vail.

A report to the Council from the City ";ngineer reviewing
the operations of the Diesel en,oire and accompanied. by curve dia-
gram showing the record of operation of the power plant from .'uiy
1914 to January 1916, was read and ordered filed.
Resolution tJoncss) o-. Passes.
A resolution "Deter:rtir:in, tnat t •e public interest and
public necessity dema}.nd certain public municipal improvements in
and for the City of Palo Alto, the cost of which will be too great,
to be paid out of the ordinary income and T.evenue of said city, to
wit, the acquisition by purchase of two Diesel engine generating
sets,b" was introduced. Thoits and C;ongtion moved that •the resolu'•
tion be adopted.
The question was discussed at length, Councilman Snyder
using that - a consulting engineer Should be employed. Cc .nci1 a.".
Ackley desired to be recorded as demanding more time before decid-
ing the question. The vote was -as follows:
Ayes: Congdon, Cooley, henry, Jordan, ::? er, .:'ocher, Roller,
Swain, Thoits.
Noe : Ackley, Snyder.
The Mayor declared that as an affirmative vote of ten
was .necessary to adopt the• resolution, the motion was lost.

A resolution entitled "Relating to the requisite vot: to
create a bonded indebtedness," finding that a orange in the state
law is desirable, was rend and on motion of :os-her and Jordan vas
passed by unanimous vote on roll call.
Ordinances:: Passed.
Ordinance #149, entitled "A...endinr4: Ordinance #91 of the
City of Palo Alto, relating to the Passage, Publication and '.er+'
f ication of Ordinances of the City of Palo Alto, was given second
reading and on motion of, Thoits and Ackley, was passed by uneu (-
mous vote on roll call.
Clams of Referee Tyler Allowed.
The bill of J .F.Ty1er of 162.5C, one-half the refer
fee in the case of 1`r oits vs 1,yxbee, was on potion of Swain and
Ackley allowed and a Warrant authorized in payment of the same oY
unanimous vote on roll call.
