A RESOL UTION REJECTING MRS PRESCRIBED BY
THS Td%lf OA Leh AVMS RILLS
RESOLVED, by the Cou ncil of the City of Palo Alt o, C aliforni a,
that
WIC&REAB, this Council has he retofore determined th at it is
n ecessary to construct and maintai n sanit ary and storm sewers,
wa ter mains, ge e maina,,eleetrioal li nes a nd app urte nant facil-
ities in Page 11511 Road and,Ara atradero Road fo r thei r entire
lengths within the City limits of the Tow n of Los Altos Hills in
orde r to pro vide adequa te service to the porti on of the City of
Palo Alto known as Foothills Ar,asxa tion No. 1-A;
WHEREAS, on Octo ber 5, 1959, the City Council of the T own of
Lo s Altos Hills adopted its Reso lution,No. 101, wherein it g rant ed
to the City of Palo Alto permissio n to construct a nd maintain said
utilitie a as requested, bu t pr escribed as a condition that the
City of Palo Alto shall agree to make a vailable san ita ry sewer
service to all property within the Town of Los Altos Hills within
the na tural dra inage a rea of the r.:a in trunk line that ca n be
serv ed by gravity flow, and wa ter se rvice w ithin per missible pres-
su re zones, ,fu rthe r pr ov idin g as a condition of con nection that
the parties so serviced shall pay fair and equita ble char ges,
helping to compensa te the City of Pa lo Alto for its capita l invest-
men t and agree to pay fair cha rges for said se wer a nd
NOW, THEREFORE, IT I3 ORDERED as follows:
1. That the terms prescribed by the Town of Los Altos Hills,
as set forth in said Reso lution loo. 101, are unacceptable to this
City for the fo llow ing reasons:
(a) All property within the Tow n of Los Altos Hills
within the natu ral drain age area of the main trunk line that can
be served by gravity flow , referr ed to in sa id Resolu tion No. 101,
water service,

the City of Pal o Alto a nd would therefore require a subst anti al
incr ea se in the desig n capacity of said m ai n t ru nk li ne, the
ca pital cost of which would ha ve to be bor ne by the City of Palo
Alto pending such time as payments a re made by parties se rviced
un der the terms of-s&id resolutio n.
(b) W ate r bervioe to any pr operti es outside of the
City limits of the City of Palo Alt o is impossible, becaus e the
City's a greemen t fgr wa ter purchase Z rom.the.C.tr .a nd County of
Sa n Fran cisco limits service to property within the said City
limits of Palo Alto.
2. That the ter ms prescribed by the Tow n of Los Altos Bills
in said Resolution No. 101 be, and they are hereby, rejected.

Ca lifornia, at a regul ar meeting thereof held on the 9th
day of November , 19 59, by the following vote of
