WHEREAS, pursu an t to Resolution of Intenti on No. 3141,
a dopte d by this Council on September 2d, 1959, this Council did,
on October 26, 1959, adopt its Resol utio n No. 3149 ordering
a cquisitions an d improvements;
WHEREAS, sa id Resolu tion of Intention and said proceedings
were ha d a nd ta ken pursuant to Article V of Ordina nce No. 844 of
sa id City, commonly design ated the Pa lo Alto Improvement P rocedure!

Co de, adopted January 13, 1941;
NOW, THEREFORE, IT IS FOUND, DETERMINE D and ORDERED, as
follows:
1. The public interest and ne cessity r equire the acquisi-
tion, construction, and completion , by said City, of the public
Nmprovements desc ribed in said Resolution of In tention a nd in the
proceedin gs relating thereto, an d the ea sements and proper ty pro-
posed to be acquired described therein, and hereinafter described
in Exhibit "A" hereto attaohed and incorporated herein by r eferenc,
are nece ssary therefo r.
2. The public inter est and necessity requ ir e the ta kin g of
imm ediate possession in conn ection with the emin ent domain pr o-
ceedings.
3. The pu blic necessity requ ires said a cquisitions an d im-
pr ov eme nts; said proposed aequiaition a an d impr ove ments are plan ne4
and located in the m anner w hich will be most compa tible with the I
greatest public good an d the least priva te injury, an d all of said!
acqu isitions ar e located within the territo ria l lim its of the City
of Pa lo Alto.

4. The City Attorney and the law firm of Messrs . Kirkbride,
Wilson, Harzfeld & Wallace, employ ed f or that purpose, are hereby
dire cted to institut e a nd conduct to oonolusion an action in emi-
nent domain for the acquistion of said easeme nts, to u ndert ake the
n ecessary action to obtain i mmediate possessio n thereof, and to
ta ke su ch action as is necess ary the rein .
5. The City Manager is he reby a uthorized a nd directed as
alte rnative to tria l of any action in eminent dom ai n initiat ed
hereunder, to expen d from the proceeds of assessments and s ale of
assessment bon ds to be issued in said proceedi ngs such mo neys as
are necessary a nd in his o pinion may constitute the f air market
value of said parcels, based upo n appraisals of duly qualified and
competent rea l estate appra isers.
