By unanimous consent the Council wen.t into executive
The regular order of business was resumed..
One-half oa Court Coats Authorized:
Wing moved that proceedings in the case of Paul & Cold.
well .75 J.r.Byxbee, Jr., be carried forward in the Superior Court
and that t2 e City pay one-half of the court costs. The 'lotion
was seconded by Mosher and passed by unanimous vote on roll call.
x'eterson and 1 -;eery moved that such payment oe made on
the basis that the cost to the city shall not exceed. K500.
The Motion was lust on roll call, all voting; no except hen=
and Peterson, who voted aye.
As to Spur Track and R. Cros4ns.
'Councilman Winc; ca1le', attention to the fact that the
members of the Raa.iroad Commission on their visit here had been
shown the spur track across •Lniverz ity Avenue and the bad condi-
tion of the crossings on that avenue.
Or. motion of Cramer and Congdon Committee 4:1 and the
City Attorney were instructed to draft a Resoluticn as to these
matters to be sent ' to the Southern Pacific Co., and the Penin-
sular Railway Compvny..
