HomeMy WebLinkAboutRESO 3149• KWRW:KIJ:cwh 10/22/59 10 ir RESOLUTION N0. 3149 A RESOLUTION ORDERING ACQUISITIONS AND IMPROVEMENTS AND CONFIRMING ASSESSMENT PROJECT NO. 58-1 RNiOLVED, by the Council of the City of Palo Alto, California that WHEREAS, the Council• did-oa the 28th day f September, 1959, adopt its Resolution of Intention No. 3141. to order certain acqui- sitions and improvements to be made in said City, under and pursu- ant to Artldle V of Ordinance No. 844 of said City, adopted January 13, 1941, entitled "Palo Alto Improvement Procedure Code", and to issue bonds pursuant to Part 4, Bond Plan C of Article IV of said Ordi,anoe No, 844, reference to which resolution is hereby made for a partioular deseription of the improvements to be made, the boundaries of the assessment dietriot and the bonds to be issued; W E REAS, said Resolution of Intention has been duly published twice in the Palo Alto Times, a newspaper of general circulation printed and published in said City, wherein all persons interested, having any objections to the proposed acquisitions and improvements or against the slaps and descriptions of easements to be acquired o: against the district to be assessed for the costar and expenses thereof, or to the Engineer's estimate of the costs and expenses thereof, or against the grades at which said work shall be done, or against the diagram or assessment, were notified of the time and place of the hearing as contained in said resolution of inten- tion, was duly published within the time and in the manner provide in said Improvement Procedure Code, and as directed by said resolu tion of intention, as appears from the affidavits of publication on file in the office of the Clerk of said City; MARAS, at the time and place fixed for said hearing protests or objections were made or presented to the amoiminamonsue proposed acquisitions and improvements, or to the maps and descriptions or to the district to be assessed, or to the grades at which said work was to be done, or to the bonds to be issued to Pay the costa and expenses thereof,. or to the Engineer's esti- mate of the,coste and expenses thereof, or against the diagram or aeseeenent, and all peri.gns Interested desiring to be heard were given an opportunity,to be heard, and all matters and things pertaining to said proposed acquisitions and improvements were duly heard and considered by said Council; and were overruled, and said Council has acquired jurisdiction to order said acqui- sitions aig improvements apd to oppfi m said assessment to pay the coats and expenses thereof; NOW, THEREFORE, said,,Qoun.il deep hereby FIND, DETERMINE and ORDER, as follows: 1. That the plans and apeelficatione for street improve- ments under said resolution of intention be, and they are hereby, finally adopted and approved as the plans and specifications to which said work and improvement shall be done as called for in said resolution of intention. 2. That the maps and descriptions of the lands and easement to be acquired, as prepared by the City Engineer, ba, and the same are hereby, finally approved and confirmed. 3. That the Engineer's estimate of the itemized and total post and expenses f.,r said improvements be, and it is he.^eby, finally adopted and approved as the Engineer's total and detailed estimate of the costa and expenaea of said improvements. 4. All public streets, alleys and ways in use in the per- formance of the public function shall be omitted from the aesees- ment hereinafter to be made to cover the coat of said improvements 5. That the public interest and convenience require, and said Council does hereby order the itprove,snts to be made as described in and in acocrdance, with said resolution of intention, -2- 1 on file in the office of the City Clerk of said City, reference to which is hereby made for a more particular description of said improvements and also for further particulars, pursuant to the provisions of Article V of said Improvement Procedure Code. 6. That the map of the assessment district be, and the same is hereby, finally adopted and approved as the map of the assessment district, and the boundary of said assessment district as shown thereon is hereby determined and established to be the boundary of the assecaw.ent district ,to pay tgr the costs and expenses of said improvements. 7. That the assessment and diagram for the cost and expenses of the improvements described in said resolution of intention be, and the same is hereby, ratified, approved and confirmed as the assessment and diagram to pay the costs and expenses of said improvements. 8. That the City Clerk of said City shall deliver said diagram and assessment to the Superintendent of Streets of said City, together with a certified copy of this resolution thereto attached, and said Superintendent of Streets shall thereupon record ouch assessment and diagram in his office in a suitable book to be kept for that purpose and append thereto his certifi- cate of the date of such recording, and such record shall be the assessment roll to pay for the costs and expenses of said improve- ments. 9. Immediately upon such recordation eaid Superintendent of Streets shall give notice thereof by two publications in the Palo Alto Times, a newspaper printed and published in said City, which notice shall set forth, among other things, that all sums assessed therein are due and payable at his office immediately, and that payment thereof is to be made to him within thirty days after the date of recording said assessment, which date shall be stated in said notice, and such other matters as are required by Section 7 of Article V of said Improvement Procedure Code. -3- • • • e I hereby certify the foregoing to be a true copy of resolution adopted by the Council of the City of Palo Alto, California, at a regular meeting thereof held on the 26th day of October , 19 59, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Ball, Bishop, Byxbee, :Davis, Evans, Giffin, ldhrshall, Iditchell, Navis, Porter, Rodgers, Stephens, ',''oodward, Zweng.
