A RESOLUTION DETERMINING CONVENIENCE AND NECESSITY, ORDERING
CHANGES AND MODIFICAUQNE AWp APPROVING ESTIMATE OF COST
CALIFORNIA AVENUE DISTRICT
OFF-STREET PARKING PROJECT NO. 55-5

WHEREAS, on September 28, 1959, this Council adopted its
Resolution No. 3143, A Resolution of Preliminary Approval of
Estimate of Cost and of Preliminary Determination and of Intention
to Make Changes and, Modifications, wherein it did preliminarily
determine that the public interest, convenience and necessity
require, and that it intends to order certain changes and modifica-
tions therein particularly described in the estimate of coat and
the amount of bonds.to be issued under Resolution No. 2628 of
Preliminary Determination and Resolution of Intention No. 2650,
Fdopted by this Council on June 27, 1955 and September 12, 1955,

WHEREAS, pursuant to said Resolution No. 3143, notice has
0 been duly given of the time and place when and where said Council
will consider and finally determine whether the public interest,
convenience and necessity require said changes, and when and where
it will consider and finally act upon the matter of making said
changes and modifications and when and where it will hear all
protests in relation thereto;
WHEREAS, no written objections to the undertaking of
said proceedings without fir..t complying with the provisions of
the Special Assessment Investigation, Limitation and Majority
Protest Act of 1931, have been filed with the City Clerk at or
before the time fixed for this hearing by persons interested, own-
ing or having an interest in real property within the assessment
district, bearing their signature, a description of their property,

and a statement of the nature of their interest therein; and
WHEREAS, all persona interested have been given an opportun-
ity to be and were fully heard. and ta11 Council has duly consider-
ed any and all objections and protssts made, •and the said proposed
changes and the public convenience and necessity for making same;
NOW, Tim MEL, IT I8. H!IIUND, DETERMINED and ORDERED, as
followst
1. The public convenience and necessity require the changes
and modifications deeeflbe'd in ali+d lieeolution No. 3143 adopted
by this Council on September 28, 1959.
2. Any and -ell objection3 and protests made pursuant to
said Resolution No. 3143 are hereby overruled and denied.
3. Said changes and modifications are hereby ordered to be
made and had, all as more particularly set forth in said Resolution
No. 3143.
4. The Special Assessment Investigation, Limitation and
Majority Prbtest Act of 1931 shall not apply to said proceedings.

resolution adopted by the Council of the City of Palo Alto,
California, at a regular meeting thereof held on the 12th
day of October , 19 59 , by the following vote of
the members thereof:
