February 14, 1916
The Council of the City of Palo Alto met in regular,
session on this date at 7:30 p.m., with Mayor Swain presidia,.
On roll call all members of the Council were present.
The minutes of the regular meeting of January 10th,
1916, the calle meeting of January 17th, 1916, and the called
meeting of February 3rd, 1916, were read and approved as read.
Petition.,._ to Remove Tree Refe_, e'a.
The petition of Loretta B. hart for permission to re-
move a tree from in front of her property on Alma Street was, on
motion of Cramer and Ackley, referred to the Eoard of Public
Works.

This being the time for the hearing of the protest of
Loretta B. hart against a charge of ;J;rade on Alma Street and
Palo Alto avenue, the matter was taken up. Attorney W.ii.H.H rt
requested that the hearing be postponed and on motion of Ackley
and Snyder the request was granted an the time of the hearing
was postponed to February :.kith,, 1916, at 7;30 p.m.

A petition filed with the City Clerk, was presented

The City Attorney gave a verbal opinion that it was not

endum election on the table.
The Mayor ruled that the motion to lay the petition
fora referendum election on the table was out of order.
Cramer and Ackley appealed from the ruling of the Mayor
and the,oroll call, vote on the question, "'Shall the chair be sus-
tained? was as follows:
Ayes: Condon, Jordan, Thoits, Vail, Wing.
Noes: Ackley, Cooley, Cramer, Henry, Miller, Mosher, Peterson,
Roller, Snyder.
Not Voting: Swain.
The Mayor declared the appeal sustained and the deci-
sion of the chair overruled.
Jordan and Vail moved as a substitute to the original
notion that the petition for a referendum election be granted,
and the substitute motion was lost by the 'following vote on
roll call:
Ayes: Congdon, Jordan, Swain, Thoits, Vail, Wing.
Noes: Ackley, Cooley, Cramer, Henry, Miller, Mosher, Peterson
Roller, Snyder.

Reports Received.
A. report was• received from the .Board of Public Safety
recommending that the Mayor be authorized to name some member
of the Council and the Health Officer to confer with the -Stud-
ents' Guild in regard to the use of the Guild isolation hospital,
and the recommendation was granted on motion of Vail- and Miller.
A report from the Board of Public Work was received
and its recommendations referred as follows: Engineer's recom-
mendations as to appropriations to Committee #1; and the matte'_
of traffic. signs to Committee #2.
The report of -Committee #1 recommending the enactment
of a City Planning Commission ordinance was received and filed.
Committee #2 was given further time to report on matters
• referred to it.
Street Pay in.&.ction Postponed:
The adoption of specifications and a resolution of
intention to pave certain streets was deferred to a meeting to

ordinance relating to the collection of water, power and
rates was given first reading, and referred to Committee
Ord:i.na.nce (Cit. Plans..
An ordinance entitled °An ordinance providing for the
establishment, government and maintenance of a city planning -
commission -in and. for the city of Palo Alto and prescribing its
powers and duties" introduced at a called meeting -on January 17,
1916, was again introduced as a committee ordinance. Miller and
Mosher moved its adoption. On motion of Vail and Peterson the
ordinance was amended by striking. out at the end of Section 17
the words: "and for this purpose the Council, by unanimous con-
sent._ hereby declares that all rules provided by Article 2 of
Codified:Ordinance #1 of the City of Palo Alto are suepended."
On motion -of Cramer and Ackley the ordinance was amended to pro-
vide that the same shall be posted instead of published. -
The ordinance as amended was passed by unanimous vote
on roll call.
Reports Received.
The report of the Board of Public Works for December
and of the Treasurer and Auditor for Tanuary were received and
ordered filed.
A report of the Auditor as to the condition of the
Budget appropriations was referred to Committee #1.
As to Spur Track:
A motion by Peterson and Mosher was passed that the
Attorney and Engineer be instructed to request the State Rail-
road Commission to investigate the obstruction and danger, cause:
by the spur track of the Southern Pacific Company crossing
University avenue and running back of present passenger depot.
Recommendation Taken from Table.
Peterson moved that the recomm_cnc: tior_ of the Board of
Public Works that the Council declare forty-five trees ? isted it
the recommendation nuisances and rescind all former action of the
Council relating to the removal of trees from the streets and
avenues be taken from the table. The motion was seconded by
Mosher and passed.

Peterson then made the following motion:
"Whereas this Council has received a recommendation
duly passed bY the Board of Public Works of the City of Palo
Alto recommending that certain trees be declared a public nui-
sance;
Now, therefore, it is found and declared that the trees
listed in the recommendation of the Board of Public Works con-
stitute nuisances on the streets and avenues of this City, and
that the recommendation made by the Board of Public Works for
the immediate removal of said trees be and the same is hereby
approved, and that all former motions and resolutions of the
Council of the City of Palo Alto relating to the removal of
trees standing in the streets and avenues be rr.scinded."

lowing vote on roll call:

Cramer and. Ackley moved that $50 be appropriated to pay
the damage claim of E. Bleibler.

the Council as to the purchase of unsold bonds of the iisuc of

Mosher and Henry moved that the matter be referred to
Comittee #4.
Thoits and Crammer made a substitute motion that the City
Treasurer oe authorized to sell five bonds of $l4CO each of said is-
sue and the substitute motion was passed by unanimous vote on roll
call:
