HomeMy WebLinkAboutRESO 3130ISHW:Smh 9-11-59-9 RESOLUTION NO. 3430 A RESOLUTION OVERRULING PROTESTS AND DETERMINING TO PROCEED WITHOUT COMPLIANCE WITH INVESTIGATION ACT PROJECT NO. 58-1 RESOLVED, by the Council of the City of Palo Alto, California, that WHEREAS, on August 24th, 1959, this Council adopted its Reso- lution No. 3129 of Preliminary Determination to make certain acqui- sitions and improvements more particularly described therein and did fix Monday, September 14, 1959, at the Council Chambers in the City Hall, as the time and place when and where any and all persons interested may appear and show cause, if any they have, why the Council should not find and determine the.t the public convenience and necessity require the acquisitions and improvements described and referred to in said resolution, without compliance with the Special Assessment Investigation, Limitation and Majority Protest Aat of 1931; WHEREAS, notice of the adoption of said preliminary resolution and of said time and place of hearing was given by the City Clerk by publication and posting for the time and in the manner provided in said Resolution of Preliminary Determination and Article 1 of the Palo Alto Improvement Procedure Code, as appears from affi- davits on file with the City Clerk; WHEREAS, no written objections to the undertaking of said proceedings without first complying with the provisions of said Investigation Act have been filed with the City Clerk at or before the time fixed for this hearing by persons interested, own- ing or having an interest in real property within the proposed assessment district, bearing their signature, a description of their property, and a statement of the nature of their interest therein; and • WHEREAS, all persons interested have been given an oppor- tunity to be and were fully heard, and said Coun it has duly con- sidered any and all objections and protests made, and the said proposed acquisitions and improvements, and the pc.alic convenience and necessity for making same. NOW, THERiFOitE, I't IS FOUND, DETERMINED and ORDERED, as follows: 1. The public convenience and necessity,,Z,equire the acqui- sition -And improvements described in Laid Resbir iet of Preliminary Determination; 2. Any and all objections and protests made pursuant to said Resolution of Preliminary Determination are hereby, overruled and denied; 3. The acquisitions and improvements described in said Resolution shall be made under and pursuant to the provisions of the PaIO Alto Improvement Procedure Code more particularly referred to in said Resolution, and the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 shall not apply to said proceedings.
