Messrs. Spalattzoaand Roeetti, attorneys for L.Porizini,
garage collector, addressed the Council in the interests of
their client.
`Councilxn n Vail stated that he had been absent when
Ordinance #105 was passed and that he did not approve of the
provisions of the ordinance. He -moved that the o rdi^ance be
repealed and the. subject be referred back to committee. The mo-
tion was declared put of order.
Councilmen Hettinger and Latin favored a reconsidera-
tion of the ordiaianc°.e. H, J, Snyder addressed the Council in op-
position to the ordinance.

fication or repeal of Ordinance "105 was referred to Connittee
#2 for report at the next meeting.,

The annual reports of the Board of Public Library and

A communication was read from the Board of Public WorkS
relative to a proposal from Joseph Larkin to su'nlease 8.58
acres of the land leased by the city from Stanfo~d 'University.
On motion of Thoits and Mosher the matter was referred to Com-
mittee 1'`4.
Ordinance (Smoke and Dust Nuisance) x.72 y %•c;= ed.
An ordinance entitled "An ordinance relating to the
discharge or escape into the open air of smoke, dust, steam or
offensive odors" was introduced and read as an ener,;e^cy meas-
ure. Lakin ands ,usher moved that the ordinance be adopted, and
the motion was .lost by the following vote on roll call:
vez: Congdon, Jordan, 'Lakin, Miller. ?..:o Sher, Swain, Thoits,
Vail.
Noes; Hettinger, LaPeire.
Lakin. and Miller Moved that the City Clerk be instruct-
ed to notify the signera of the protest egainst the operation
of the pavin4,z, plant of the Federal Construction Co. under con-
ditions, creating a z i lance' that with the ai c. of t: e city at-
torney they may bring suit free of charge to enjoin the opera-
tion of said plant. The motion was lost by the following vote
on roll call:
Ayes: Lakin, LaPeire, Miller, Mosher, Vail.
Noes: Congdon, 'Hettinger, Jordan, Swain, Thoits.
