The Council of the City of Palo Alto met pursuant to ad,journ-
�eat cf June 9, 1913, at 8 p.m., on this date with Mayor Jordan pre-
siding. Roll call as follows:
Present: Ackley, Allen, Congdon, Henry, Hettinger, Jordan.- La2eire ,
Mosher, T hoits, Wing.

A protest against paving Forest avenue, signed by property
o :ere representing a majority of the frontage on said avenue, and
also a protest against paving Middlefield road at the present time,
sig:.ed by property owners representing a majority of the frortae or
said road, were received.

streeto be postponed for ninety days. The motion was seconded„ soy

Sewer in Block 101 —Hopkins.
A communication was received from; Charles & Schnei e
attorneys for Timothy :Hopkins, requesting that a sewer on private
property in Block 101 be removed. The ma::tter, was referred to the
',board of Public forks.
Resclucion--Rniiroad Commission.
A resolution expressing the appreciation of the Council
for the prompt action of the Railroad Commission of the State of
Caidfornia in. the matter of fixing rates for the sale of ;as in
Palo Alto, and in other matters referred to said Commission. oy the
-ity, was introduced and on motion of Allen and Thoits, was adopted
by.unanir,ous vote on roll call.
Resolution in re Subway at Palo Alto Avenue.
A resolution approving City Bngineer Byxbee's preiirr;i!.a.ry
plans and estimates for the City of Palo Alto':, shore of the cot
fora sub -grade crossing at Palo Alto avenue and the Southern Pac-
ific railroad was introduced and passed by unanimous vote on rol.:

Vii ng moved that an ordinance previously introduced, repeal -
Ordinance #83 relating to impounding fees, do not �ase. The
motion was seconded by Mosher and passed'on roll call, Myi.ettin 'ea

A rYport was received from Auditor; Jordarr showing the
co:dition of the budget appropriations on June 1, 1913. 0n motion
of ;°Trig and Condon, the matter of the transfer of funds, and ap-
'pa°opriations -from the general fund if necessary, was referred to
Co?.itt'ee #5 with power to act.

The minutes of the adjourned regular meeting of June
26, 1913, were read and approved as read.
Councilman T. B. Downing thanked the Council for the
leniency shown it granting him frequent leave of aese ace and said
that in retiring from the Council he. was pleased to give place to
a younger man who* he trusted would give the city more efficient
service than he had given.
Mayor Jordan expressed his thanks and appreciation for
the courtesy and kin_dnese of his fellow -councilmen during
tear. as Mayor, and declared the Council adjourned.

The Council of the City of Palo Alto met on the above
mate at 8;15 p.m., in accordance with the provisions of the
Charter and Codified Ordinance No. 1 ow .the City, of Palo Alto.
The City Clerk called the Council to order and . mated

Election of
The Clerk stated that the first business would be the
election of a. Mayor and that the vote would be by secret ballot.
Ackley and Swain were appointed tellers.
The ballot resulted as follows:

Yr. Thoits asked that he be allowed to decline the of-
fice, as other duties demanded his time.
On motion of Wine, and Mosher, the election of :.•: .Thoits
was made unanimous. City Attorney Malcolm was named to conduct
the Mayor -elect to his chair, and the Mayor on taking his seat,
expresses: his appreciation of the honor and promised to z'_,L fill
the duties of the office to the best of his' ability.

The Mayor called for the appointment of city officials
by secret ballot, the results wein6 as follows:

Assessment Roll Suorrli „ ed.
The City Clerk presented a report submitting to the
Council the Assessment Roll for the fiscal year 19/3-1914, 4n ac-
cordance with the provisions of the Charter and Codified Ordinance
S0.1 of the City of Palo Alto.
On motion of Mosher and "vein ' the report was accepted
and the Clerk was instructed to publish a notice that the Council
will sit as s Board of Equalization on Monday, - Au, ust 4th, 1913,
at 10 a.m.
Mayor Thoits stated that he would announce the personnel
of the Council committees at a later date, and declared the neet-
i ng of the Council adjourned.
