Roll call as follows: Present: Arnold, Bishop, Byxbee, Cresap, Debs, Dias, H:.ight, Marshall„ Porter, Rodgers, Rohrs, Rus, Stephens, Woodward. Absent: Zweng. The minutesof the meeting of June 25, 1962, were approved as distributed. Election of May.. or:: ang V}fie Mayor It' #as: announced that the following procedure, which ' traditionally has been used for the election of Mayor and Vice Mz.yor, would be ised tonight unless there is an objection from a rnajorxt,r of the Council:, the Mayor and Vice Mayor to be elected for one--yeuar terms; the Mayor to be elected first; no nominations to be made;; vote to be by'secret ballot; eight votes to be necessary to elect e'.ch officer, and successive ballots to be taken until one councilman receives the necessary:; eight votes. There being no objection, l:e Council proceeded accordingly. The Mayor appointed Councilmen Byxbee and Ste phenti to act as ballot clerks. The first ballot for Mayor for 1962-63 was as follows i` Haight Bishop Debs.. Porter Rodgers 10 votes 1 1. 1 1 with one blank ballot. • As there, were 15 ballots in the box, including one blank,. and only 14 council members present, on advice of the City Attorney another ballot was taken. The result was as follows: Haight 9 vote s Bishop 1 Rodgers 1 Porter 1 Debs 2 Mayor Haight, having received the necessary rnajorit) of votes, was declared re-elected Mayor for the fiscal year 1962..63. i The Council then balloted for the election of a Vice Mayor for 1962-63, The first ballot was as follows: Rodgers 11 votes Mrs. Dias 1 Debs 1 Cresap 1 Vice Mayor Rodgers, having received the necessar f majority of votes was decZared re-elected Vice Mayo.: for 19+,2-6 Mayor Haight maat::a statement in accepting the off,ce of Mayor for another'year•, calling attention to many problems, facing thee' City which .should i:,e solved during :.he next fiscal year, including -=:a,. bus transportation system, the need for :additional' administrative office space. for City departments, completion of the Master 'Plan, utility improvements, and development of Fcotiiills Park. Project- 60.-6 Ar Lstradr*ro $mod. et a� This was the time set for a hearing on Resolution ND. 3496 of Preliminary Determination and of Intention to make aci;luisi- tions and improvements, Project 60-6, Arastradero Road, et el. The Mayorread an opening statement advising that ihe: purpose of the hearing is twofold; a) to determine whether the public convenience and necessity in general require the propos d widening and improvement,` and b) to fully hear any and ail pretests or, endorsements, of the project from property owners directly' concerned and from these protests or endorsements and from the testimony of the City Administrative Staff to determine whetheo the properties within the assessment district will be berefitee by t:ie proposed acquisitions and improvements and whether the asset sments have been spread in accordance with such benefits. The Mayor acknowledged receipt of written protest; from the following: Christian.Reformed Palo Alto' Christi Reformed Church, 68' Arastradero Road; Edward C. and Claire J. Vier.ra, 693 Arastradero Road; Michael MontaLbano, 611 Arastradero Road; San Francis co. Water Department, Peninsula, Division; Alexander Thain, 414e El • Camino Real; petition from Mrs. Verna H. DeWitt and others against the widening and improvement of Arastradero Road; petition s ibmitted' by Walter Petitdidier., 607 Arastradero Road, in behalf of a group ofpropertyowners in the Arastradero Road area; and a protest signed by several property owners against the proposed impro 'ement of Laura. Lane (the latter protest Was filed by Criss, Peters, Donegan & Brenner). Acknowledgment was also made of a letter from S. T. Tan, property owner on Arastradero Road, in favor of the pro, ect but making certain comments regarding the basis of assessment. A report was. -read by the City Manager with. background information on A. astradero:.Road,• reviewing the scope of the proposed • improvements and the method of financing the improvements. He pointed out that a substantial contribution of general city funds will be made to the, .project, and the City's participation will require as estimated S252,25,4.00 toward the total cost,. the balance of the cost ($350, 906.00) to be bcirne by the assessment district. The City Manager's report also.`iracluded a chronological summary of ac:ions on Project 60-6 fr.'onm Junta 24, 1959 to the present. time. T.he City Engineer now read a petition dated May 10, .1960 requesting: the City to consider the opening and improving of Laura - Lane„. a private road, as a public street, as part of the next assetis= irientc1 mist program. It was so ordered. (The Council took a. recess at this time, 9:45 p. rn , and reconvened at 10:00 p.m.) (Councilman Porter did not return after the recess; and was absent for the rest of the meeting.) The Mayor announced that the public hearing on Project 60-6 is closed. - A motion was made by Cresap and seconded that this 1 matter be -continued to the: next regular meeting on July 23, 1962..• In making the motion Councilman'Cresap stated that he has questibnsl regarding :the formula followed in the spread of assessments. Councilman Bishop -requested that information be furyi; hec! by the staff r.:egaruing costs of comparable projects, and the City Manager advised that he:would have the engineers prepare a report and provide this information. ► -Councilman Stephens suggested that the staff review the formula for assessments on such projects, and perhaps come back' to the Council with some suggestions for consideration; that it might be time to consider. the -establishment of a new formula for assess ng. properties for improvements on such streets as Arastradero R\oac . Mr. Byxbee also advised that expenditures for parks and recreation under the cap:tal improvement'program will be held in abeyance until a proposal for a bond issue for this purpose`` is considered, a.nd that no funds; l for the development of Foothills :Park will be expended until plan; .ng for the park has been completed.. Dies moved to amend the previous motion for approval of the budget by excluding from approval the capital:; irnpr.ovement program' as outlined on Pages 27 and 28 of the budget The amendment was seconded by Debs. Mrs. Dias stated that she has'many questions' regarding allocations of the ca.pita.l improvement funds which she would like to discuss further in II committee; that she questions the $150, 000 proposed for a downtoa,n library, and wishes to discuss the development: of Foothills Park' which she hoped could proceed faster than proposed in the capital' program;. .M,rs. Dias suggested the operating budget be accepted' at this time but the capital improvement program be excluded. The City Manager advised that there would be no problem in adopting the budget as recommended by Committee No. 3; that none of the capital improvement projects listed on Pages 27 and 218 of the budget could be carried out and expenditures could not be ` made on any of these items, without approval of the Council; that �r;e believed the intention of the committee was to include the capital improvement program in the budget with the understanding the Council willdetermine allocations and priority of funds during the` coming fiscal year.
