Foothills Park Re rt Letter from AAUW A communication was received from the Palo Alto Branch of theAmericanAssociation of University Women commend- ing the Foothills' Park 'Citizens' Advisory Committee for their report. LaderaDarn Project;. The. City Manager read a letter from Con=gressman Charles S ; Gubser .concerning the Ladera Dam project and noting- theopposition which has arisen to the project. Mr. James Morgan, President of the Board of Trustees. of the First Southern', Baptist Church, stppiennented their written protest with etatemeate to the Ccuncil at this time. He, stated that the use permit for the church they proposed to build on their property provides that the church shall have no • access, either pedeetrian'.or.vehicular, to Christine Drive, and requires them to constrJct a permanent fence at a distance. of 16 feet from the property line and to landscape and maintain the area between the fence and the street: Mr. Morgan advised that the, Church is being assessed about $13,000, and they felt it,was unfair: and unjust to assess them for a street improvement when they were denied use of the street, The;P'la.nning Officeradvisedthat the Planning Commission had worked out a street pattern to give property in the area a street throw' "o Middlefield road to permit a reasonable division and development of the property. He reviewed the - 'I conditions under which the use permit for the First Southern: Baptist Church was granted, advising that access to Christine Drive was reetricted`so that church members would not park on that street. Mr. Jones pointed out that a particuLar use to which the property &s to be put, . such as a church in this instance, does not form the basis for reliving the property of assessments,, as theus'e:. of property can change in the future. Councilman.. Porter noted that there is a bulge in the proposed street adjacent to the church property where the street Makes a turn, and moved that the opening of Christine Drive be approved but -that the bulge be removed,. resulting in soine saving in costs:. The motion was seconded and carried, and it was directed that Resolution No. 3493 previously adopted be amended to include this further change and modification on which hearing will be held May 28, 1962. A.representative: of the Pentecostal Church of God, owner; of property' ore Middlefield Road, told the Council that they are in favor of the opening -of Christine Drive and are willing to pay the assessment if required to do so, but they are denied access, to :Christine Drive and for this reason had thought that they would not have to pay an assessment. The construction of` street lighting along Page Mill Road, Hansen Way and . Hillview Avenue. _: , Wesley Ayres representing Melabs, 3300 Hillview Avenue, objected to an assessment for street lighting. He stated that; the firms on Hillview do not believe there is need for the "proposed lighting on that street. 7., The .opening: and'improvement. of Miranda Green frorn Miranda Avenue easterly about 530 feet. r. Clinton. Dorn -bush, 840 Miranda Green, read the letter of protest submitted previously by Mr. and Mrs. Dorn. bush Mr. and Mrs. George H. Guenther, 820 Miranda Green, and by:. Mr. and Mrs, ` Lloyd J. Schafer, 830 Miranda Green. They asked that the improvement of Miranda Green be removed frorn the project, stati.g that they feel. Miranda Green as it now exists is adequate to serve the people there. Mr. Dornbush pointed out that Miranda Avenue is not improved and in his opinion it is _neither necessary nordesirable to bring the cul-de sac of. Miranda Green to city standards until such time as Miranda Avenue is brought to city standards. A motion. was inade by Byxbee, seconded by Porter, that Miranda Green be excluded from the project with the under- standing that it will be opened and improved at the time Miranda Avenue is improved. During" ;the 'discussion the Planning Officer advised that the opening=of Miranda Green had been recommended because lot divisions`' were -involved. Mr. Allan: Reid, 880 Miranda Green, spoke in favor of the project of opening_ -and improving Miranda Green. Headvised that he is the owner of Lots 29, 3] and 32. that the owner of L01-30 is aiso in Savor of the improvement, and together they represent over 50 per cent of the area involved. Mr. Reid called attention tothe sewerline installed by the City to serve: the property and statedthat because of the high assessments: for sewers the property' istoo valuable to be used as orchard land and should be developed for residential purposes: that in order'' to develop the :land the street must be opened to provide access to the :property;. It; was pointed out in discussion that Miranda. Avenue will. be involved in the: -proposed Foothill Expressway but it is not known at this unit when :;it will be improved. The comment was rnade, that the cost -of the improvement ement of, Miranda Green .would no doubt increase_, it the work is delayed. Mr George Guenther told the Council that he will be agreeable 'to the improvement of Miranda Green when adequate access' to Miranda Avenue is provided, but was opposed to the• project at; this time. Councilman.
