Ro11 call as follows: Present Ball, Bishop, Byxbee, Davis, Evans, Giffin, Marshall, Mitchell, Nevis, Porter, Rodgers, Stephens, Woodward, Zweng. Absents Haight. The minutes of the meeting of October 12, 1959, were approved as distributed. Project'58.-i: ..arr..aw.f . This was the time set for a hearing on proposed acquisitions and improvements. under Project 58-1. A brief review of the project was presented by the Assistant City Manager, who showed slides of themajor areas: contemplated for improvement. The: Assistant City Manager reported on the bids received on the project on October 21, 1959, the low bid being, submitted; by Bahr & .Ledoyen, Inc. in the amount of $282, 193.13, which was about $5,000.00 less than the Engineer's estimate. It was reported that all property owners in the assessment_ district -had been notified in writing of the hearing and of their estimated assea sments, The hearing was declared open. Several written protests and communications regsrding the project were read. • One letter was: from Mrs.. Jeanne Barnett, President. of the 'Parents' 'NW? eery ".School::requesting that the hearing relative to improvement on. Garland Drive..along their property be postponed until' their' legal counsel can be present. He is presently out of the country. The proposed improvement includes construction of sidewalk: on Garland Drive aloniethe nursery school property, 'requiring the removal' or relocation of the existing fence. answer to'a question `from the Mayor as to whether part of the project could be+;held up.without delaying the whole project, Kenneth :;Jones of Kirkbride, Wilson, °Herzfeld & Wallace, the City's; attorneys. on,the:improvement proceedings, adviaed,that it is their racommendation that the project go,forward on the; basis proposed, and that a<t the same time the staff be asked to investigate any .particular~problems such as: the one affecting the nursery' school; and report back to the Council it itsnext regular meeting. Y. E. Peterson, 882 Garland Drive, asked that the Council take action atrthis time to proceed with the project.' it was: brought out that ,the question involving the Parents' Niirsery.SSchool property is whether the fence is to be moved back 5.feet'er 10 feet, and it was agreed to withhold this particular problem` for fut_ther` consideration. 11X ,.A letter was read frorn. Guy D. Mazncarti and Frances lti. Mancarti,;' 490,,,Gary :Court, objecting to the proposed assessment for installation of 'street, lighting on Gary Court. Letters `were received from Glean L. Wayne. and Mrs. Bonnie Jean Wayne, axid :from Harry . W. Uthe ., prote eting the. method, of spreading ; the .assessments for the proposed improvements consisting -of sidewalks, cur.bs,and gutters, on the easterly side of High Street .between California land Oregon Avemies. Theypointed out that High Street'is:=the secondary frontage for their properties,. and intheir �pinlon it is unfair to assess them for the full coot of the improvement. The attorney, Mr. Zones, explained the method' ofas aessment used for, the High Street improvement and also for: the improvement on Grinda.Street, where several of the lots have side=frorstages.: He recommended that an additional study and -analysis be`rnade of the -High Street assessments, :based on the bids received,:.- to determine what the comparative inequities are and to -see' if any relief can equitably be given to the protestants Mr. Uthe spoke •briefly to:`sUppi:errnent his written protest. A letter was received from Patrick E. Logue protesting the amount of, assessmenton his property which is adjacent to the right of way separating El Camino Way from El Camino Real Mr. L. M. Guslarai, attorney representing A. L. e-rrancsvae addressed the Council requesting that the extension of Wilkie Way be held up or omittedfrom theproject until a final determination has been made regarding the alignment of Wilkie Way. Mr. Philip "A. Di Maria, representing Mr. Yamashita, also asked that the proposed extensi:a:x a.rd improvement of Wilkie Way be eliminated.t:ntil:a decision has been made regarding the development of the property, and street pattern. It was agreed thatthis item enotdd be studied by the staff and a report made at the next meeting. Mr. Alexander Thain, 4146 El Camino Real, protested the improvements as planned for El Camino Way, and submitted a proposal for a. redesign of the south side of El Camino Way, suggesting there be smaller sidewalks and improvexnenta sizziilar: to those on West;: Meadow Drive. He asked that if the request for a change in the plans is -not granted, that El Camino Way be eliminated from the project and given further study. Mr, Gardner Bullis, attorney for Mr. Herman Lerner, owner of property on El Camino Way, alsopresented a protest .. Mr.:.. Wayne .°Kaners oto, representing Mr. Kumagai and other property owners along East Bayshore Road, spoke to the Council regarding their assessments for installation of sewer., advising that they realize the sewer line is necessary but would like to have a more --equitable assessment or to have the amount spread over a longer period of time, as they feel the assessment is an excessive burden on their property. Mr. Alf Brandin<represerting Stanford University addressed the Council regarding the proposed improvement of. Arboretum' Road between', Willow and Quarry Roads from a two-lane to a,four-lane road. He pointed out that the State is considering plans for the future development of Willow Road, and felt that it would be unwise to widen Arboretum Road until the studies on Willow Road have been completed. Mr. Br.annin advised that in ,laisropxmon the pre,sert.traff9c on Arboretum does not justify a four -lane ,road and asked that this part, of the project be held in, abeyance The A8sistant City Managerreviewed the proposed improvement for the portion of Arboretuxn Road, which is 700 feet iss length, inside the=:city limits, pointing out that as it exists it: is..practically a half street; that while the traffic on Arboretum has not,reached its peak, it has been sufficient to warrant a traffic signal at ;Qaarry; and Arbor ettixn, and there will be heavier demands placed on;.the . street. Thera being no others who wished to speak on the matter, the hearing was declared closed. It was reported to the Council that a resolution has been ved.-from the Board of Supervisors of Santa Clara County g " g consent to the City of Palo Alto to acquire and construct p ..., improvements ; and to provide that the costs thereof shall be assessed upon a special district. The project includes 200 feet of Arboretum:Road outside the city limits.' It was moved, seconded and carried that the:resoluution be accepted and that the Mayor be authorized to sign the acceptance. Resolution No. 3148, overruling protests on the Resolu- tion of Intention, was introduced, and on motion of Woodward and Mitchell, , was adopted by unanimous vote on roll call. Resolution No. 3149, ordering acquisitions and Improve- ments and confirming assessment, was introduced and on motion of, Woodward, duly seconded, was was adopted by unanimous vote on roll. call. Resolution No 3150, awarding the contract for Project No. 58-1 to Bahr and:L`doyen, Inc., in accordance with prices named in their bid, was introduced, and on motion of Woodward, duly seconded, was adopted by vr'axiimous vote on roll call. Clifton Woodh s, 1449 University Avenue, read a letter to the Council _ which; she had addressed to the Editor of the Palo Alto. Times, concerning the need for a larger and more suitable auditoria -n inwhich'to.hold concerts of the Youth .Symphony Orchestra The Mayor advised Mrs. Woodhams that if she would' address her' letter to the City Council, he would refer it to the Capital Iniproveinents` Committee soon to be appointed. . Sto Si ns niytraity. azsd Lincoln A letter was received .from Gordon Wiley. 554 Hawthorne Avenue, "complimenting the City Council, for not yielding to a pressure group in thecase of the stop signs at University and Lincoln: Avenues." Itwasannounced- 'that this subject of stop signs at the intersection of University;arld Lincoln will be discussed at a meet- ing of Committee No. 1 tomorrow evening, October 27, 1959. Pa R elation's Letters were received from Huettig & Schramm, 304 Bryant Street, and from SchmT ling & Stenbit, 300 Bryant Street, requesting that'the two-hour parking restriction be reinstated in the 30,0 block of Br, ant Street.aa there is no parking space available for their customers -since the parking lixnit was removed. The Assistant City .Manager called attention to the fact that, by action of the Council, 'a four months' trial period was established beginning September 1, 1959, for unlimited parking,: in certain areas".north of. Lytton Avenue,, acid -.he program provides forthe situation to be reviewed before .an4ary 1, 1960. He advised that the staff -does not have a recommendation to make at this time. Re uest to -Amend Code .re lei 'ht of Tennis. Court Fences Letters were received from Paul N. McCloskey, Jr., - in behalf of the Eichier Swim :& Tennis Club, and from Eichler Homes, Inc. , ,apologising for, the error in starting construction of a 15 -foot fence aromid the. tennis courts at the Eichler Swim & Tennis .Club before their request for an amendment to the .building ; code was considered -by' the; Council. They asked that the matter:: of amending the code to permit higher open type fencing be recoznsi dered on its merits. It was roved by Navis, seconded and carried that the: matter be referred to the staff for study first and then to. Committee No.''I for review; Annexations to Mountains View and Los Altos Notices were .received from the County Boundary Commission, for information of the Council, of the proposed annexation of "Pear No.. 1" to the Cry of Mountain View, and of "El Monte No. 3" to the City of Los Altos. Traffic and Parking Regulations The Assistant City Manager submitted several recommends tions from the Staff Traffic: Committee for amendments to Resolution No. 2971 regulating parking and the use of certain streets. Resolution No. 3151 making Pasteur Drive a through street` at its intersection with WeIc:h. Road, was introduced, and on motionofNavis; and Mitchell, was adopted on roll call, with 13 Ayes, Bishop not voting on the motion. Re s olution :No. 3152, prohibiting parking at any time on the northerly side of Stanford Avenue from El Camino Real to the westerly city limits, was introduced and on motion of Navis and Mitchell, was adopted on roll call, with 13 Ayes, Bishop not voting on the motion. Resolution No. 3.15.3,: making -Birch Street a through street from Ca1]fornla Avenue to Page Mill Road, at its inter- sections with Sherman Avenue, Grant Avenue and Sheridan Avenue, was introduced,, and on Motionof'Navis and Mitchell, was adopted on roll call With 13 Ayes, Bishop not voting on the motion. Mutual Aid_ Agreement's for Fire Protection An;'agreement ,with ;the State of California, Department of Natural Resources,;; Division of Forestry, for Mutual Fire Protection Aid was presented for :consideration, and on motion of Mitchell and Marshall, a resolution approving the atgreexnent and authorizing its execution by the Mayor was adopted by unanimous vote an roll. call. The claim involved. logs of food, income and wages, and the cost of replacement of the cable The City Attorney advised that the Club had agreed to accept in .full settlement the sum of $878.50, that he believed this to be a re:asora,ble compromise settlement and recommended ° its acceptance. On motion of Byxbee and Marshall, the settlement was authorized in accordance; with the, City Attorney's recommendation, by the following vote on roll call: Ayes: Bishop, Byxbee, Marshall, Mitchell, Navis, Stephens, Woodward, Zweng. Noes: Giffin.' Not Voting: Ball, Evans, Porter, Rodgers. Claim .for Darriages (Stale?). A report was receivedfrom the City Attorney on the claim of Isabel Stofko in the sum of $20.00 for asserted damages to: a sign, iocated`at ManueTl:s Avenue and Arastradero Road. He advised that investigation indicates that none of the City forces had anything to do with the damaged sign and that it was intact and in place after the work was completed. He recommended denial of the claim It.was moved by Ravi,, seconded and carried that the City Mtorxxey's report be, accepted, and the claim be denied. Liquor License ,Applicationsr, 3918 Middlefield Road A report was -received from the City Attorney advising that he had received notice' of an application for an off -sale beer and wine license by Saul V. and Nette R.ayow, 3918 Middlefield Road. He pointed out that a protest had been presented by the City in connection with the application of the Mayfair Market which is two doors nearer to the Cubberley High School than thepremises of the applicant, and that the Department of Alcoholic Beverage Control had granted the Mayfair. Market license over the City's protest, that he had no reason to believe they would not grant this application, and unless instructed otherwise by the Council, he would not enter an official protest.: No.instructio:,.s were given by the Council: in - this case.
