Mr..Anthony Lagor o, attorney for Sanford H. Sanger,
operator of the Barron Cab Company, also spoke to the Council','
stating that this: company, does., not basically disagree with the
proposal but does object to the fact that, as written, the proposed
ordinance would allow the..>Barron,:Cab Coinpany to operate only ;two
to scabs 'while the Yellow Cab -Company would be perxritted. to have
24,-c•abs, ;the number' being operated at the present time.
La.gor•io advised -that; the Barron Cab Company expects to have
three =ore cabs ready for„ operation within a few days. He stated
that in his .opinion the ordinance, if adopted as proposed, would in
effect provide:ca.:- Monopoly fOr''the Yellow Cab Company.
Ordinance No. ' 1890, 'amending Article 11 of Codified,
Ordinance ,N6. 5, providing for the issuance of Certificates of
Pubic "Convenienceand Necessity., was given second reading, and
a motion was made.by Stephens, seconded by Rodgers, that the
ordinance be adopted.
Councilman Byxbee moved an amendment to the motion
to provide that Section 11r"2; :of the proposed ordinance be amended
to permit: the ` Barron Cab' _Company to operate five cabs instead of -
two . by the time the ordinance becomes effective. The amendment.

Supervisors. of Santa Clara County advising that the Foothill
Expressway as proposed would utilize the Southern. Pacific Railroad

that `.the'Board intends to make application to the Southern Pacific
Company, to abandon this_ ''portion, of the railroad right-of-way.
The Board: requested the City Council to be represented at a meeting
on' Octobe.r'.13,. 1959 'at 4:00 P.M. in the chambers of the Board
of Supervisors :in San`Jose for discussion of the proposal.
The Council felt.that, as Palo Alto is not affected by
the proposal, it isnot necessary to be represented at the meeting
and therefore took:no action.
Re uest to Amend Code re Hei ht of .Tennis Court Fences
A letter was received from Pau; N. McCloskey, Jr. ,
attorney, .in, behalf of the `Eichler Swim and Tennis Club, requesting
consideration of an arnendraent to Section 1506 of the Building Code
to increase the, perinitted height of tennis court fences from ten to
fifteen' feet.
The:City;Manager, reported that the staff had checked the
site of the tennis courts on .the club's property at 3539 Louis Road,<
and had. discovered that the. fence posts had already been erected to
a height of fifteen feet in violation of the code, and that no permit
had been applied for Pictures of the courts and the partially

Du:ing the ensuing discussion, in answer to a question
from Vice Mayor vans, the City; Manager advised that the
installation- of traffic lights at the intersection of University and.
Lincoln is not high on the priority list because of more critical
intersections. He stated that a study could be made of various
alternatives for Signals, including cost estimates. It was
suggested that consideration might be given to having signals,
if authorized., at Center Driveinstead of Lincoln Avenue, inasmuch
as most of the childrenusing the crossing would be going to the
Crescent Park $chool, and the school is on Center.
Mrs. Paul Pearson, 1200 Bryant Street, chairman of the
traffic committee of the Palo Alto .esiderts Association, spoke
to the Council; stating that the association concurs with the
residents who protest the removalof the stop signs. Mrs. Pearson
recommended that the Council defer any farther action on traffic
matters until the citizens's traffic committee to be appointed has had
an opportunity to study such matters.
Mrs. aohn;Hamxn, .1.242 Greenwood Avenue, presented a
petition signed by around 200 people of the area protesting the
removal of the stop signs and;, asking that they be replaced
immediately as a safety crossing precaution for the children.
Mr. ''`A Emerson Myer, 1425 University Avenue
told the Council that he approved; of the suggestion. to have signals
placed at the intersection of University and Center Drive. He filed
a letter from Mrs. Re;gina'ld Lamb, 1125 University Avenue,
concerning the traffic situation on University Avenue and asking
that additional safety precautions be taken.
After further discussion, it was moved, seconded and.,
carried that the ;matter be referred to Committee No. 1, and.. the
staff .was requested to submit at the committee meeting a report
on alternative -types of signals and costs, and to consider wh.ether
signals, if installed, should' be placed at Center. or another inter-
section rather than at Lincoln.
Letter -from Garden Terrace Residents
A letter was received from Richard B. Stone, 4392
Miller Avenue, and `D: G. Harmon, 4393 Mille:. Avenue, express-
ing appreciation for the welcome extended to residents of the
Garden Terrace area recently annexed to the City.
Resolutions, for Retiring Employees
On rnotion'of Mitchell, duly seconded, and by unanimous
vote on roll call, the. Council; adopted resolutions of appreciation

-Resolution .: No. 3145, .designating certain streets as
majorcity streets, was, introduced, and on motion of Navis and
Woodward, was adopted by vote on roll call, with. 12 Ayes, Bishop
not voting on the motion.

Resolution .No.,:°3146,, recommended bythe Staff Traffic
Committee, providing for "a two-hour unmeterea parking limitation
on Cowper, Street between Hamilton and Forest Avenues, was
introduced, and;on: motion of Mitchell and Woodward, was adopted
by unanimous'. vote `on roll call.
«AAri endment to Buil din Code
The City Manager presented a proposed ordinance
amending. the ;Buil ding code to increase the fee for filing an
application :for. moving or; relocation of a bui l ding to a site within
the- City from $10 00 to $100.'0:0, and for moving a building to :a
site outside the City,to'_$25 :00. He spokeof the procedure
and problems involved in :moving of buildings, and advisedthat
the'- staff -felt that- -a higher • fee would tend to discourage people,
except those seriatis-ly'interested in moving and improving their
buildings, from making' applications.
After discussion, it- was moved by. Byxbee, seconded -
by Haight, and carried on roll call that the proposed ordinance
amending ,:the Building Code ,and, setting fees for applications to.
move or, demolish buildings be accepted for first reading. There
were 12. Ayes on the - motion, Porter voting No.
Library
osits and Lendin Code.
The City >Manager presented a proposed schedule of
Library Department Fees, Fines and Deposits and Lending Code,
which is recommended by the Librarian . He advised that this
schedule, dated September; 25, 1959, provides regulations for use
of the, Library's new phonorecord collection, and includes the
lending privileges accorded patrons of the Library. She City Manager
recommended adoption., of the schedule, copies of which were
distributed to council members;
'On .motion of Marshall. and Haight, the Schedule of Fees,
Fines and Deposits, and Lending. Code for the Library Department,
dated September 25, 1959, was adopted.
Transfer of Funds
Upon. recommendation of the City Manager, and on motion
of Navis and Mitchell, a transfer of $10, 000 from the Unappropriated
Reserve of the General Funnd:wa:s authorized as a loan to Improvement
Fund 55-5, the California Avenue Off -Street Parking Project, by
vote on roll. can., with 12 Ayes, Bishop not voting on the motion.
Retention of Mr. Moore to November 30 1959
The City Manager referred to authorization given at the
last Council meeting to:retain Maurice Moore to assist in the turn-
over_ of the hospital records and accounts to the new Palo. Alto -
Stanford'
.Hospital Center, and to his statement at that meeting that
he would'be'better prepared to advise the Council later as to a
termination date for Mr. Moore's ser ices The City Manager
advised that he.:had.met :with representatives of Stanford University
and the Managers of Construction, and it was their opinion that
all outstanding bills on the hospital project should be available. by
November 15, 1959 and that the turn -over of accounts and records
to the new hospital center shouldbe completed by that time..
The City Manager,: suggested that, because of possible delays in the
project, November: 30th might be an appropriate termination date
for Mr .. Moore's '`services.
It was moved by Marshall,seconded by Rodgers, and
carried that the services of Maurice Moore be extended to November 30,
1959.

±A report was received from Committee No. 3 recommend-
ing that the Firefighters Union;' Local 1319, be not recognized.
-On motion of `Navis and Woodward, the recommendation
was adopted by -voice. vote, Giffin voting No.
Re uest of Com=nunit Council of Northern Santa Clara Co.
A report was received from Committee No. 3 recommend-
ing approval in principle of the proposal to appropriate funds to help
finance the work of the Community Council of Northern Santa Clara
County, but that action be deferred until a contract for the expenditure
of such funds has been prepared and reviewed.
Councilman Navin, Chairman of Committee No. 3,
referred to opinions of the City Attorney on the matter advising that
such an appropriation by the City must be used for welfare purposes
and must be spent :within the city limits, and that there had been
discussion - in_ committee as to whether it would be possible to draw
up a contr,act::, that the committee felt the Council should first
make a decision as to whether they are interested and willing to
approve the proposal in principle beforea contract is prepared for
consideration.'
Onmotion of Navis and Rodgers, the recommendation of
Committee No.` 3 was adopted:
Amendments to Administrative Code
A report was submitted by Committee No. 3 recommend-
ing adoption of ,an; ordinance amending the Administrative Code by
the addition of Paragraph 6 to Section 202 relating to duties of the
City Attorney, to read -that "he 'shall defend any officer oremployee
of the City in any action arising Out of the performance of the.
official duties of such officer or employee." The committee also
recommended adoption of anordinance amending the Administrative:
Code by adding Section 408.8 regarding filing of claims for `damages
against city officers or employees.
It was moved by Mavis, seconded and carried by unanimous
vote on roll: call, that a proposed ordinance amending the Administra-
tive Code by amending Section 202 and by adding Section408.8 be
accepted for first reading

Public Transportation Study
A report was received from Committee No. 3 recommend
ing that a. separate citizens' committee be set up to make the public
transportation study; that itfunction as a steering committee
supported by expert. help; and that there be Council representation
on the cons nittee.
Councilman Nevis, Chairman of Committee No. 3,
advised that it was the.intent of the committee thatthe extra help
be hired by the City, and that the citizens' committee itself would
not have:. authority to enter' into contracts or hire help.
On motion: of Nevis . and Giffin,: the recommendation was
adopted as „a' guiding principle. It was directed that it be stated in
the record: that it is the, intent that the expert help be hired by the
Council.
Clarke
A`report wasreceived from the Planning Commis Bien
unanimously recommending denial of the application of James and
Violet R. Clarke for change of &strict from. R -1:B-8 to R-3 of
Lots 6 and 7, Tract No. F9 of Mayview Honaesites, otherwise known,
as 3779 Middlefield Road.
After: review of the matter by the Planning Officer,
it was moved by Nevis, ; seconded by Haight, and carried that the
recommendation of the Planning Commission for denial of the
application be adopted.
Landscaping Electrical- Substation Sites.
The Planning Commissi:.on suggested to the Council that
consideration be given to landscaping or otherwise screening the
electrical substation on Middlefield Road.
The City Manager advised that this suggestion has been
noted and that the staff intends to' submit a plan for more adequate
fencing and landscaping of substation sites.

Areport; was received from the Planning Commission
unanimously recommendingdenial of the application of Leland
Nicholas for a change of district -from R -1:B-8 to P -C (for pro-
fessional offices) of a portion of Lot 5, Santa. Rita Rancho, other-
wise known as 705 Charleston Road, northerly corner of Charleston
and Middlefield Roads.
The matter was reviewed by the Planning Officer, and a
motion was made by:'Byxbee, seconded by Nevis, that the recommend-

A report was received from the City Attorney regarding
the suit filed•
by the City against Sidney McAlpine and Cla'idie Lee
Haynie for damage to power pole at the corner of. Page Mill Road
and Hanover -Street in the amount of $1.651..22. The City Attorney
advised that by sharing w th other claimants in the insurance
coverage, the City -will -receive ::$1467.32 or approximately 89%
of its claim, and he requested authority to settle the case on this.

Conference Attendance Policy
The City Manager called attention to the Council's
policy with relation to attendance at municipal conferences which
is as follows. Thatsix members of the Council and the mayor be
authorized to attend -the United States Conference of Mayors, that
six council members and the mayor be authorized to attend the,
conference of the, American Municipal Association, and that two
council members be authorized to attend the National Municipal,
League conference.
The City Manager, spoke of the problem with regard to
the conference of the- American Municipal Association to be held
in Denver November 28 -December 2, 1959, since seven councilmen,
ave indicated a desire to attend. He commented that only two
councilmen attended the U ",$. Conference of Mayors this year
and it is questionable ;whether" any will attend the National
A�fuxaicxpal' League meeting.
The City Manager advised that a decision: must be made
so that reservations and travel,arrangements can be completed,.
and asked whetherthe Council wished to give authorization to seven
council members to; attend the :American. Municipal Association.

policy be established that at' any given conference all council members
who are able to go and who wish to attend be appointed as delegates
