• City Hall, Palo Alto, California September 14, 1959 The Council of the City of Palo Alto met in regular session on this date at 7:30 P.M. with Mayor Porter presiding. Roll call as follows: Present: Bishop, Byxbee, Davis, Evans, Giffin, Haight, Marshall, Mitchell, Navis, Porter, Rodgers, Stephens, Woodward, Zweng. The minutes .of the meeting of August 24, 1959, were approved as distributed. This was t1 a time for a hearing on Resolution No. 3129 of Preliminary Determination for improvements on various city streets. No written protests were receive. There was no one present to speak on the matter and the hearing was closed. Resolution No. 3130 determining to proceed without compliance with the Investigation Act was introduced, and on motion of Woodward and Navis, was adopted by unanimous vote on roll call. Resolution No. 3131 directing the preparation of Engineer- ing Documents: was introduced, and on motion of Woodward and Bishop, was adopted by unanimous vote on roll call. League of Women Voters .Observers A letter was read from Mrs. Arthur A. Spar, President of the League of Women Voters, introducing Mr s . ,; o s eph Herr and Mrs Seymour. Cohn: who are serving as observers of the League at City Council meetings for the, year 1959-60. Re nest' to Alter Frame Buildin Z00 Homer Avenue A letter was .received. from Harry B. Sturgeon, proprietor of the American De Luxe Dry Cleaners, requesting permission to make alterations to the front of the building at 200 Homer Avenue, including the removal of the corner of the building to provide customer, parking off the street. It was reported that the building in question is a Type V wood frame building in Fire . Zone No. 1, and that the Building Code prohibits alterations of exterior walls of such business or commercial buildings in Fire Zone No. 1. The City Attorney advised that it is not possible,for the Council to grant an exception to the Code, but it is possiblefor the Council to amend the Code if it so desires to allow the applicant or any other person who makes a similar request to make alterations to their buildings. On motion of Bishop and Zweng, the matter was referred to Committee No. 1 for consideration and report. '174,711":",:+741t • Annexation: to Mountain View A. notice was',received from the County Boundary Commission; of the proposed annexation of an area to the City of Mountain View, designated as "'Middlefield No. 11". Water. Problems: A; letter was received from the Santa Clara Valley Water Conservation District referring; to their previous request in July that the Council .'appoint a representative to serve on an advisory cornmittee'to consult with. the District on water problems, and asking that the Council appoint its representative at an early date. The City Manager reported that this matter had been discussed at a Meeting of the Inter -City Council of. Santa Clara County, and that it was voted unanimously to take ro action on the request to appoint representatives to serve on an. advisory committee. He also called attention to the water advisory committee set up by the Board of. Supervisors whi'ch was organized to try to determine how to handle water. Aroblenis, and to the fact that Councilman Davis is the City's representative on this committee. The .Council"decided to take no action on the request of the Santa Clara Valley Water Conse,evation Disteict. Chamber of Commerce Re uests Traffic"Intercianges �� SeniorCitizen Recreation Center nW A letter was received from the Palo Alto Cheariber of Commerce renewing their statement of policy concerning the reed for advance planning of traffic interchanges at c.r•iticalcity inter- sections' included in the City and County piaster traffic studies to take advantage of possible participation by other government agencies. A letter was also received from the Chamber of Commerce recommending that the Council re -activate studies .for. a Senior Citizen Recreanon. Center., On motion. of Zwerg, this matter was referred to Committee No. 2 for further study. Amendrnent to'Yacht. Harbor Fee Schedule A recommendation. was made by the City Manager for an addition, to the Yacht .Harbor. Fee Schedule to provide for a temporary mooring fee of $1.00 per day, to be applicable to craft staying temporarily in the harbor'. area longer than three days but less than thirty days the fee to be collected by the Harbormaster. On xnot"ion of Bytxbee. and Navis, this addition to the Yacht Harbor Fee Schedule was approved. Redemption.; Fee. on Tax -Deeded Property A: recommendation was made by the City Manager that the redemption fee charged for each parcel of tax -sold or tax- deeded property be reduced from $2.50 to $2.00, to conform to the provisions of the State Revenue Code. On motion of Navis and Byxbee, this recommendation was approved. A report was submitted from Joint Committees No. 1 and No. 3, stating that after consideration of the tentative subdivision map of ",'.Walnut:,Grove" located -on Alma Street near Charleston Road,' ; in light of plan:' for -a. future grade separation at this intersection, the joint committees recommended that the City of Palo Alto's representative to the Santa Clara. Mr. Joseph Ehrlich, 4225 Park Boulevard, spoke briefly, referring to the De Leuw, Lather report which propose& a six-laneoverpass. at Charleston Road, to which people in: his area object Mr.. John Beckman, 229 Ely Place, urged that the zoning and general plan be not changed. and Opposed aay plan for a grade separation at this- location. Zonin and Street Pattern - 2990 3040-3060 -Middlefield Road A. report was submitted by the Planning Co;rmission. unanimously recommending that the properties of Ravenswood Realty Company (the former Sequoia Insurance property), Leonetti and Bliss, located on; the southwesterly side of Middlefield Road adjacent to Matadero Canal': otherwise known as 2990, 3040 and 3060 Middle- field Road, be changed from A -R to R -3:G and R-1; that a general subdivision, zoning and street pattern be adopted as shown on map entitled "Pattern No. 2' and a reasonable length of time be given to the respective property owners to develop. If this is not achieved within a reasonable time, the Commission recommended that the City include ;the streets "in a ;street project assessment district in order to assure reasionable and orderly development. The proposed zoning and street pattern: were reviewed by the Planning Officer. Mr.,Andrew Spears, attorney for Mr. Burton Blackwell of the Ravenswood Realty Company, owner of rrnost of the property. involved,addressed the. Council stating that the plan is not acceptable to .Mr. Blackwell who objected to having his land taken for street purposes and to being assessed for the cost of the street improvement. He advised that Mr. Blackwell does not need the proposed street, and asked that there "be no change in the present A.R. zoning. Mrs, Philip' Towle, Chairman of the Planning Commission;; coznmented that there axe three separate ownerships in the area proposed to be 'rezoned; that when the property was zoned A -R negotiations ;were 'pen -ding fats combining the two 80 -foot parcels, but these .negotiations were not completed and the property could not be developed. She pointed out that there has also been a problem of the street pattern. and traffic 'circulation which the. Planning Commission- has been trying' to solve over a three-year period. Mr. Edouard Guldoux, representing members of his family who own property at the rear of the parcels proposed for rezoning, spoke to -the Council in favor of the proposed- general" subdivision and street pattern which would permit the Guidoux family to develop their property. It was moved by Byxbee, seconded by Woodward, that the report and r.ecoxnmendations of the Planning Commission be accepted:, Councilman Navis stated that he is in accord with the recommendeapropasak but was:; concerned with the street pattern and felt that, in order to assure the development of the property, an attempt should be made to work out with the property owners a.program whereby the burden of the street improvement costs could be shared equitably. , It was moved by Navis, seconded by Stephens', and carried that the matter be referred to Committee No. 1.. Record of Survey eFraser; A report was received from the Planning Commission unanimously` recommending approval of the Record of Survey as submitted byDaisy M., Fraser covering a portion of Lot 125, Wooster Subdivision, being a parcel on the easterly corner of Louis Road and Colorado Avenue, subject to: a) Granting a 5 x 20 ft. anchor' `.easement: as shown the cost of relocating pole and anchor to be borne by, subdivider if work is required; and b) payment' orsegregation of Assessment Nos. 335-C and 335-D, Bond Series "YY",.and furnishing evidence of payment of all payable city and county taxes and weed abatement charges. County all illegal lot splits as they are brought to light.
