Gale in the amount of $250..00 for asserted damages by reason of a_fall on the sidewalk in front of 321 California Avenue, recommending denial. It was moved, seconded and carried that the Attorney's report be accepted andthe claim be denied. Claim for Dama s (Donohoe, A report was received from the City Attorney on the claim of Robert B. Donoho for asserted damages in the amount of $1;7.50 for removal of`pabit "sprayed on right front fender and hood" during painting of parkisgmeter posts in front of 115 Hamilton Avenue. The 'City Attorney advised that such work is done by the City in its governmental function and the City is not responsible for the negligence of its employees; . that if there is liability to the claimant, it is solely that of the employee involved. He recommended the claim be denied. It was moved, seconded and carried that the City Attorney's, recommendation be not accepted and that this claim be referred to Committee, No., 3 to determine whether or' not the City may lawfully pay the claim.
