Palo Alto, California for, the, purpose of `adoptinga resolution acknowledging receipt of a copy of ;the notice:of intentionnto circulate petition for the annexation. of -territory' designated as Foothills Annexation No. 2, and affidavit: ,of,,pub1icatiozzthereof, and approving the circulation of the petition.' "The'. City Clerk is directed to send a notice of this meeting to:.each. member Of the City Council'and'to enter this order on the minutes. of said specifil meeting." Mayor Porter presidedand roll call was as follows: Bishop,-Byxbee, Cresap,: Evans, Marshall, Mitchell,,,, Navis, Porter, Rodgers, Ruppenthal, Woodward. bsent: 'Corcoran, : Davis, .Giffin, Stephens. The Mayor asked the City. Manager to review the situation. The City Manager reported that all Council members had been notified of this special meeting, and: that the four Council members not present had indicated willingness to attend if their presence was needed for a quorum; that Mrs. Corcoran said she would be available on call f needed; that Mr. Giffin is in Seacliff and was called' by phone and indicatedhe would come if his presence was necessary; that he is familiar with the subject to be discussed and is in favor of the resolution; that Dr. Davis, when told there would be a quorum, indicated he would probably not be present because ofanother commitment; and that Mr._` Stephens who had just returned from an out-of-town trip said he would come if necessary but was assured there would be a quorum. without him. The City Manager reported that the matter before the Council for discussion "was brought to the City's`,attention`for the first time by a representa- tine of the Palo Alto Times who called and informed the City of the action of the Los Altos Hills. City Council on January 5, 1959, when it referred to the Los Altos Hills Planning Commission a petition from residents of the western portion of the proposed Foothills Annexation No., 2 to be annexed to Los Altos Hills :and adjourned, the Council meeting to January 8, 1959 to further consider the matter. The City Manager advised that he had tried several times to get touch -:with the Mayor of Los Altos Hills but was unable to reach him. The City Manager then read a letter whichhe sent to Mayor Porter today, a copy of whichhad also been sent to ,each, Council member.. The letter called attention -to the fact: that during the past several months, the City has worked with Proponents < of annexation of the area known as Foothills No. 2 to. the City of Palo Alto: It referred to the action of the Town of Los Altos Hills and to the fact that;.our City Attorney has' advised that through the use of special meetings, Los Altos Hills can take action which .could result in the dissolution of the entire annexation progranknown as Foothills No. 2, and require the proponents of annexation to reinitiate proceedings. . The City Manager reported in his- letter that his office had received numerous; telephone calls from residents, in the :area involved in the western section,' being considered as an annexation 41 to Los;'Altos• Hills, stating that contrary to information appearing in 'the news- , paper.,: 'they do not want to be annexed to.'Los Altos Dills and prefer.to become a part<of Palo Alto. 'The 'City Manager stated in his letter to the Mayor that it had become apparent that the Council should meet in special session' to consider adoption of a::re,eolutior approving circulation of the petition by the proponents .of the Foothills .No;. 2 annexation. discussing the matter, the_ City Manager called attention to the problem faced by the,School District .n: providing sewers for new schools in the area, and that the Districthopes at some future time to be able to connect with''the. Arastradero Road sewer line. He advised that no agreement: has been entered intobetween the School District and the City, but they need sewer. facilitie. and if the area: iaannexed to Palo Alto, the facilities wouldbe available for use by the School District later. A .map showing- the area of Foothills No. 2, and the portion of the area in question` containing about 75 acres adjoining the city limits of Los Altos Hills,I was :Presented: Revolution No. 3062, acknowledging receipt of a copy of Notice of Intentionto'.Circulate Petitionfor the Annexation of Territory, Designated. as Foothills Annexation No. 2 to the City of Palo Alto, and affidavit of publication thereof, and approving ;the circulation of the petition, was . introduced, and on motion of Mitchell and.
