Lee be approved. The Mayor suggested:that the City Manager review the proposal for the acquisition of 1 194 acres of..land, a portion of the Boronda Farm}, under .a lease -purchase arrangexnent, and also read the communications which have been received onthe matter, after which proponents and opponents of the project would'be given an opportunity to • be heard. The City Manager reported that in accordance with instructions of. the Council, revis oris have been made to the proposed agreement, and that some additional changes havebeen made which were thought advisable, and that the revisions -are satisfactory to;Dr: Lee The City Attorney reviewed the changes„ having distributed copies of the revised agreement to council members.. It, was explained that the:most important :changes are a new clause protecting the; city in the. exerciseof'"its option to purchase any of the parcels in the event of a legal' .action, and the revision of the agreement to eliminate the provision that - would, have given Dr Lee the right to.repurc asseany of the property if the City should terriiinate .the purchase:program prior to completion of the entire- , acquisition.. The City Manager referred to the question raised at the last meeting regarding the value of; the 'land He advised that Dr. David Ingram, a qualified appraiser, had: previously' beenhired, and that the, services, of another appraiser, Mr .T Ebner had also been retained.' Letters of protest were received from Paul G. Gibson, 1590 Webster Street, and.from Mrs. S. W. Tyng Ross, 1246 Emerson Street. Letters in support of the;proposed:land acquisition and plans for a foothxkls park, and urging the Council to proceed with the purchase of the property, were read from, the President. and Board of Directors of the PALO CLUB, Mr. and Mrs. George E. Forsythe, 809 Newell Road, George S. Parks, Jr. , 475 El Capitan Place;. -r - eeeeteattseeeeeetee Mr. and Mrs,G: B. Miller, 3195 South Court; the Palo Alto Junior Chamber of Commerce; and frorn _Elisabeth Gaudreau, 540-B University Avenue. The latter, a realtor, advised' that she ,had had occasion to present Dr. Lee with an offer ` for the -purchase of his property at a figure fax in excess of the $1,.000 per acre which is, the price offered to the City, and that developers have made offers: up to $3 000 per acre for the land. A letter was :also read from Robert J.• Debs, 3486 Murdock Court, reconirnending:the immediate :appointment of a Citizens' Park Project Committee as an adv�isory.'body' to. the Council, the committee to have full power of review of any. plans Made for the park for: the purpose of approving, recommending' or denying :such plans as`:may be proposed; that at least three -fourths of the -memberahip of the .Citizens' Comrnittee' be composed of small: home owners selected from neighborhood associations;; that any possible conflict of interest by way of profession or business be avoided, and that no councilman or city 'employee be a voting member of the Committee. The Mayor;then-gave people in the audience an opportunity to be heard, `arid asked that the opposition be heard, :first. Mr."John' A.`'Sinclair, .anattorney residing. at 1501, Bryant Street, addressed'the Council. He stated that after the project for the land acquisition was proposed, --.he found a::'sense of frustration and fear on the part of. citizens; that he felt the Council has not given the citizens a fair deal.. He referred to the taxpayers' suit which hr plane to file in behalf of a number of plaintiffs, advising•:that when the suit, is' filedhe intends to give notice to the City, and that he iswalling to "meet the city legal staff in court andhave the matter determ.ined on its merits ', .Mr. Sinclair referred to a statement of the City Attorney that if a preliminary injenction is granted he would request a bond of one million -dollars froni"-.the plaintiffs to protect the City from loss on the • transaction > while injunction proceedings are carried on and a trial on the tax- payers' suit is held: Mr. Sinclair stated that in his opinion this is not a baselesfs snits; that other lawyers agree with him that there is cause for -action.: He termed the City Attorney's request for a bond "ridiculous" and stated further that if a preliminary injunction .should be granted and if the Court should ask that a bond be filed, no such bond would be filed as he would not ask the plaintiffs inthe suit to take that liability. During further remarks, Mr. Sinclair advised that he thinks the suit is of such importance, and his clients agree, that if necessary the case will be appealed to the Supreme Court. Mr. Sinclair referred to his first letter and petition to the Council, asking that the matter of the -land purchase be put to a vote of the people. He suggested that the Council study the problem and determine what the ultimate costs will be to provide utilities, roads and other services to the area and to develop the proposed park, and.put the question on the ballot in May, 1959, in the form of a bond issue and let the matter be decided by a. vote of the people. Mr. Siaclair stated that he would not take legal action if the question is put on the ballot. Others, who spoke in opposition to the project were Dean G. Weller, 132 Lincoln Avenue, Mrs.' M. Stevens, 800 Dixon Way., Los Altos; John G. Olson, 549 Stanford. Avenue; L' B. JeBien, 100 Baywood Avenue, Menlo Park; Jackson Stalder, 837."Eei Greenwich."Place; and Harold Kay, 240 Washington Avenue. Several of tbese speakers asked that: the question be submitted to the voters. Mrs.. -Stevens stated that she istChairrnan of Conservation Unlimited and is much interested in the flood control problem; that if some of the land is sub - :divided for residences, Palo Alto and -other areas will befaced with increased costs" for ,•flood' control:' JeBien advised that he owns 5:,1/2 acres near the Boronda Farm, and Was concerned with the use of the park. Several of those who opposed the.: project asked.::q'uestions regarding the plans and costs for development 'af "'the• park, and .asked forinforrnation as to how rnuch of the area to be acquired will be used for.the'proposed park and how much will be used for subdivision,purposea. The City: Manager replied that the most'important: thing at the present time is to retain open=area•for the future and pointed out, that the General Plan.. prepared'several years ago recommended the acquisition of a, site' for a mountain park He advised that a deterrzninatioci. of the parkarea and the park development plans will not,be made until qualified planners have been hired to make a study,and advise; the Council -on these matters. The Mayor then called on proponents of the project to state their views: Paul Huston, ,President of the Chamber of Commerce, endorsed the proposed acquisition of land and:, the park. He advised that the. Board of Directorsof the Chamber of. Commerce have unanimously and enthusiastically endorsed the project,,: and pointed out<that one. of the major objectives of the- Chamber of Commerce: hasbeen to provide a rural park. Mr. Huston advised that representatives of the Area Beautification Committee and the Garden Club were present m support of the :proposal. Joseph Ehrlich, _.speaking in behalf of the Coast Valley Chapter of the American Institute of Architects, urged citizens to support the project for immediate acquisition and development, ofthe property. Leland Brown, 1235 Webster Street, spoke' in favor of the proposal and felt the Council should act immediately to acquire the property: Richard Towle, 3863 Nathan Way, stated that .he thoughtpart of the objection resulted from the lack of good public relations on the: part of the Council and because of theway, the problem has been handled. He had opposed the project -.:previously but indicated approval now.. Robert J.. Debs, ;3486`.Murdock,Court, told the Council that he is in favor of the park but at the sarne'time ;has :sympathy .for the views of the opponents. He made comments to._ supplement the suggestion made in his letter, which,was read earlier, .:that a.Citizens' Committee be organizedto consider the park plans, the committee to be cOmposed of persons who have no connection with the city government and have no' business . OTprofessional interests involved in the project. He said he thought such action Might satisfy both, opponents and proponents. It was brought out in discussion that, the proposed agreement provides for: the purchase by the City immediately of, 600 acres for $300, 000, and for the leasing by the City of the six remaining parcels for $_.00 per parcel per year,. with option to .purchase a parcel each: year At the suggestion of the Mayor eachcouncil member made a statement expressing his views on the project, all favoringimmediate action to acquire. the property in accordance with'the terms -of the agreement. On motion of Byxbee, seconded by Mr=s. Corcoran,the agreement. between"Russel V. Lee .and Dorothy Womack" Lee, his -wife, and the .City of.
