Roil call as follows: Present: Bishop, ,Byxbee, Corcoran, Cresap,. Councilwoman Corcoran asked that an addition, bemade to the minutes of the Special, .rmeeting 'of October 20, 1958, in which reference was made on Page 42'6 to a discussion regarding the use of the Stanford Pavilion of rthe new Palo. Alto -Stanford Hospital by Palo Alto patients when the Palo: Alto Pavilion is filled capacity; Mrs. Corcoran pointed oat that there was con- siderable discussion on the conditions under which Palo Alto patients could occupy the Stanford Pavilion, and that she had asked the question as to whether, Palo Alto patients, if they entered the Stanford Pavilion,, would be teaching subjects and the answer given. by Dr. Barnett, the Hospital Administrator, and ;Mr: ,Hewlett, Presidentof the Hospital Board of Directors, was not very clear, • but that Councilman Navis,;a member of the Hospital Board, had assured the :Council that Palo Alto had the right to use the Stanford Pavilion without such a condition, • and it was upon this understanding that she had voted for the motion to approve changes in the Hospital construction and transfer of funds to finance the City's share of the coat. Mrs. Corcoran further stated that she felt this was an important part of the proceedings and requested that these statements be entered in the record.., lt was so ordered and the minutes of the meeting of October 20, 1958 were amended accordingly. As thus amended, the minutes of said meeting were approved. Zone Clianste Application (Cornish & Carey) A report was received from the Planning Commission unanimously recommending denial of the application of Cornish & Carey for a change of district from L-M:S to M 1:S for approximately 50 acres of property having a .frontage -Of .appro2danately 2, 350 feet on Bayshore Highway, and generally bounded `by Bayshore, Highway, Lorna Verde Avenue, Tract No. 1556, Dry Creek, Tract No. 1597. and Adobe Creek. The Mayor announced that a letter has been received from Cornish & ,Carey withdrawing their application, and that there is therefore no need for any further action on the matter. The letter stated that it was their conclusion that they did not wish to ask the Council to consider a rezoning whichwould mean overriding a:unanimous decision:byr the Planning Commission, and that it was their ,considered judgment that by making a further study of the area and its :relation ' -to adjacent properties and' by working in cooperation with the proper city officials in advance, they would be able to produce an acceptable plan. The Planning Officer= advised that he :does not feel there is any need for clarification of the ordinance affecting; Fabian Way Acquisition_ of Land Mountain Park A. letter was received from John A. Sinclair protesting the action of. the Council at a previous meeting when authorization was given for the acquisition of approximately 1200 acres of land from Dr. Russel V. Lee.. Mr.Sinclair stated that he represents- several taxpayers who object to the purchase of the property andthe expenditure of funds forthe purpose.. He referred to the proposed annexation rf the land: which would be connected with the present city > limits by' a narrow strip.' The City Manager pointed out that the Council has gone on: record favoring the:annexation of Stanford lands as .they are developed, and that the:. strip mentioned would be eliminated when further annexations of Stanford lands are completed: A further communication wasfiled late this afternoon by Mr. Sinclair, transmitting a petition with 193 signaturesprotestingprotesting the Council's action in relation to• - the proposed purchase of land for park purposes without .submitting:;the matter to a vote of the people. Reference was made to the Council's previous action authorizing the City Manager to proceed with the acquisition of the land in accordance with the "terms offered by Dr. Lee. The „City Manager advised that the proposal was:; submitted by the ;ownerwith the understanding thatthe transaction would be completed by the firet of next year, and: that the necessary papers would_ be presented to the Council for action, as soon as they are ready. A petition:: was :rece:ived fromDr Russel V. Lee and others request ing annexation of :certain territory contaixting 2,.569 acres, rriore or less, in accordaneewith the Annexation of `Uninhabited Territory Act of 1.939. Annexation of Ba Lands in San Mateo Count y The City Manager broughtup the problem of city -owned lands in San Mateo County of approximately 819 acres, including moat of the airport property and the golf course, and other area adjacent to San Francisco Bay, and spoke of the advantage& to the Cityif this .land were located inside the city limits. The City Managerstated that it wala; his ;understanding that this land would be included in the proposed:East. PaloAlto Police District, and that there s a possibility that -it could be included in other districts which might be established in the future. He referred to the _factthat some time ago San Mateo: Countywas asked to consider the 'possibility of relocating the county boundaries and, using the present San Franciaquito Creek as the new boundary but no action was taken. He pointed out that as far as the policing ofthe area is concerned, the Palo Alto Police Department can take care of the needs on city-owned.lands. The City Manager advised that he and the. City Attorney have dis- cussed the matter and suggest that an effort be made to solve the problem by taking steps- to;annex the land to the City of Palo Alto; that in discussing the matter with a number of city attorneys they agree that there is a good possibility that the annexation can be accomplished under the present law, and it was theadvice of the City Attorneyand the :City Manager that the Councilcommence proceedings by. filing descriptions -of the property proposed for annexation with the Boundary Commissions of Santa Clara. Agreement -with SchoolDistrict re Hoover Park The City Manager submitted an agreement between the City and the Palo Alto Unified School District concerning cooperative development and use of Hoover Park in =conjunction withthe adjacent Hoover Elementary School. This agreement was approved by the School Board at a meeting earlier`. this evening. On motion of Byxbee, duly seconded, and by unanimous vote on roll call, a resolution approving the agreement and authorizing its execution by the Mayor was adopted.
