RESOLUTION GIVINO CONSENT TO RESCISSION AND ABROGATION
OP DECLARATION OP ESUBLISHMENT OP' RUNTRICTIONS AND
COVENANTS FOR OAF -STREET PA NR
WHEREAS, on February 4, 1953, Pine and Co., a co -partnership
composed of Laurence Tharp, R. R. Zellick, A. V. Martin and A. J.
WarrAck, executed a Declaration of Establishment of Restrictions
and Covenants Affecting Certain Raul Property in the City Of Palo
Alto as Required for 0ffsctreet Parking by the Palo Alto Zoning
Ordinance, which declaration was recorded on March 17, 1953, in
Book 2600, Official Records of Santa Clara County, California, at
page 96, et seq.; and
WHEREAS, said declaration provided by its terms that the owners
of more than one-half of the total area of the real property therein
described could rescind said declaration by a declaration in writing,
signed and acknowledged by said owners, together with the consent of
the City of Palo A)to evidenced by a certified copy of a resolution
of the Council of said City or Palo Alto giving coneent to such
resciaaion; and
WHEREAS, the owners of more than one-half of the total area of
the real property described in said declaration of restrictions as
Parcel A have executed a rescission of such restrictions; and
WHEREAS, the City of Palo Alto desires to consent to such
rescission;
NOW, THEREFORE, the Council of the City of Palo Alto does
resolve as follows:
1. That the City of Palo Alto hereby oonsents to the rescis-
sion of a Declaration of Establishment of Restrictions and Covenants
Affecting Certain Real Property in the City of Palo Alto as Required
for Offetreet Parking by the Palo Alto Zoning Ordinance, dated
February 4, 1953.

2. That the Mayor of the City of Palo Alto be and he hereby
is authorized and directed to exec,te such rescission for and in
behalf of the City indicating the City's consent thereto.
The above and foregoing resolution was duly and regularly intro-
duced and passed at a regular meeting of the Council of the Citj of
Palo Alto on Monday, the llthi day of ilkuary , 1957, by the
following vote:
AYES:
Bishop, Byxbee, Corcoran, Cr'esap, Cummings, Davis,
Giffin, Marshall, Mitchell, Navis, Porter, Rodgers,
Ruppenthal, Simpson.
NOES: None.
ABSENT; Drysdale.
