HomeMy WebLinkAboutRESO 44000 .1 • ORIGINAL WJML: KIJ : P 11/10/70 50 )r'EC i1•', RESOLUTION NO. 4400 A RESOLUTION APPOINTING TIME AND PLACE OF HEARING PROTESTS IN RELATION TO PROPOSED ACQUISITIONS AND IMPROVEMENTS, AND DIRECTING NOTICE UNIVERSITY AVENUE DISTRICT BEAUTIFICATION PROJECT NO. 70-95 ASSESSMENT DISTRICT RESOLVED, by the Council of the City of Palo Alto, California, that WHEREAS, pursuant to Resolution No. x+386, A Resolution of Pre- liminary Determination and of Intention, adopted on October 19, 1970, by the Council of said City, pursuant to the Palo Alto Municipal Code, the City Engineer of said City has filed with the City Clerk of this City the written report called for under said Code and by said Resolu- tion of Preliminary Determination and of Intention, which report has been presented by said Clerk to this Council for consideration, and this Council has considered and preliminarily approved and confirmed said report and ordered that the same stand as the report for the purpose of all subsequent proceedings had pursuant to said Resolution of Preliminary Determination and of Intention; NOW, THEREFORE, IT IS ORDERED, that Monday, the llth day of January; 1971, at the hour of 7:30 o'clock P.M., in the regular meet- ing place of said Council, Council Chambers, City Hall, 250 Hamilton Avenue, Palo Alto, California, be, and the same are hereby appointed and fixed as the time and place when and where the Council will con- sider and finally determine whether the public interest, convenience: and necessity require said acquisitions and improvements, and when and where it will consider and finally act upon the Engineer's report under said Resolution of Preliminary Determination and of Intention. IT IS FURTHER ORDERED that the City Clerk of this City be, and she is hereby, directed to give notice of said hearing by publication twice in the Palo Alto Times, a newspaper published and circulated in .1 • Os said City, and by conspicuously posting a notice thereof along all open streets within the assessment district at not more than three hundred feet apart, and not less than three in all; said posting and first publication to be had and completed at least ten days before the date herein set for hearing of protests. IT IS FURTHER ORDERED that said notices shall be headed "Notice of Improvement" in letters of not less than one-half inch_in height - and shall, in legible characters, state the fact and date of the passage of said Resolution of Preliminary Determination and of Inten- tion and of the filing of said report and of the date, hour and place set for the hearing of said protests, and briefly describe the ac- quisitions and improvements proposed.to be made, and refer to said Resolution of Preliminary Determination and (f Intention and report for further particulars. IT IS FURTHER ORDERED that the City Clerk of said City shall mail or cause to be mailed notice of the adoption of said Resolution of Preliminary Determination and of Intention and the filing of said report, postage prepaid, at least ten days uefore the date set for hearing of said protests as follows: (1) TO all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for city taxes, including the utility roll, at said addresses. (2) In cases of transfers of land, or parts thereof, subse- quent to the date on which the last assessor's roll was prepared, to such transferee, at.his name and address, as the same appear on the records in the assessor's office which the assessor will use to pre- pare the next ensuing assessor's roll. (3) To each person, including the owner or person having an interest in property assessed,by the state under Section 14 of Article XIII of the California Constitution, who have filed with the county assessor for the current fiscal year, a statement of his name, address and a description of the property owned by him, requesting that a notice of all proposals affecting such property shall be mailed to him (Gov. Code 58905), at said address. (4) To such person at his address or as otherwise known to the clerk. (5) In ease of doubt as to the name and address of any owner, the clerk shall cause said notice to be conspicuously posted on the 1 property of such person in the assessment district, at or near the entrance thereto, so that it will be visible to persons on, entering, leaving or passing said property. Said notice shall contain a statement of the time, place and r••►nrpose of the hearing on said Resolution of Preliminary Determination and of Intention and report and a statement of the total estimated cost of the proposed acquisitions and improvements, together with a statement that any person interested may file a protest in writing as provided in said Code. * * * * * * * * I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the Council of the City of Palo Alto, California, at a meeting thereof held on the 16th day of November thereof: , 1970, by the following vote of the members AYES, and in favor thereof, Councilmen!
