RESOLUTION NO. 4396
A RESOLUTION APPOINTING TIME AND PLACE OF HEARING
PROTESTS IN RELATION TO PROPOSED ACQUISITIONS AND
IMPROVEMENTS, AND DIRECTING NOTICE -
UNIVERSITY AVENUE DISTRICT
BRYANT STREET OFFSTREET PARKING PROJECT
ASSESSMENT DISTRICT NO. 70-93
RESOLVED, by the Council of the City of Palo Alto, California,
that
SAS, pursuant to Resolution No: 4385, A Resolution of Inten-
tion to Levy Assessments to Make Rental Payments adopted on October
19, 1970, by the Council of said City, pursuant to the Palo Alto
Municipal Code, the City Engineer of said City has filed with the
City Clerk of this City the written report called for under said
Code and by said Resolution of Intention which report has been pre-
sented by said City Clerk to this Council for consideration, end this
Council has considered and preliminarily approved and confirmed said
report and ordered that the same stand as the report for the purpose
of all subsequent proceedings had pursuant to said Resolution of
Intention.
NOW, THEREFORE, IT IS ORDERED, that Monday, the llth day of
January, 1971, at the hour of 7:30 o'clock P.M., in the regular
meeting place of said Council, Council Chambers, City Hall, 250
Hamilton Avenue, Palo Alto, California, be, and the same are hereby
appointed and fixed as the time and place when and where the Council
will consider and finally act upon the Engineer's report under said
Resolution of Intention.
IT IS FURTHER ORDERED that the City Clerk of this City be, and
she is hereby, directed t� give notice of said hearing by publication
twice in the Palo Alto Times, a newspaper published and circulated
in said City, and by conspicuously posting a notice thereof along

all the open streets within the assessment district at not -more -than
three hundred -feet apart, and not less than three in all; said post-
ing aLd first publication to be had and completed at least ten days
before the date herein set for hearing of protests.
IT IS FURTHER ORDERED that said notices shall be headed "Notice
of Improvement" in letters of. not less than one-half inch in height
and shall, in legible characters, state the fact and date of the
passage of said Resolution of Intention and of the filing of said
report and of the date, hour and place set for the hearing of said
protests, and briefly describe the acquisitions and improvements
proposed to be made, and refer to said Resolution of Intention and
report for further particulars.
IT IS FURTHER ORDERED that the City Clerk of said City shall
mail or cause to be.mailed notice of the adoption of said Resolution
of Intention and the filing of said report, postage prepaid, at least
ten days before the date set'for hearing of said protests, as follows:
(1) To all persons owning real property proposed to be assessed,
whose names and addresses appear on the last equalized assessment
roll for city taxes, including the utility roll, at said addresses.
(2) In cases of transfers of land, or parts thereof, subsequent
to the date on which the last assessor's roll was prepared, to such
transferee, at his name and address, as the same appear on the records
in the assessor's office which the assessor will use to prepare the
next ensuing assessor's roll.
(3) To each person, including the owner or person having an
interest in property assessed by the state under Section 14 of
Article XIII of the California Constitution, who have filed with
the county assessor for the current fiscal year, a*statement of his
name, address, and a description of the,property owned by him, re-
questing that a notice of all proposals -affecting such property shall
be mailed to him (Gov. Code 58905), at said address.

(4) To such person at his address or as otherwise known to
the clerk.
(5) In case of doubt as to the name and address of any owner,
the clerk shall cause said notice to be conspicuously posted on the
property of such person in the assessment district, at or near the
entrance thereto, so that it will be visible to persons on, entering,
leaving or passing said property.
Said notice shall contain a statement of the time, place and
purpose of the hearing on said Resolution of Intention and report
and a statement of the total estimated cost of the proposed acquisi-
tions and improvements, the amount, to the extent possible, of the
estimated annual assessment against the particular parcel covered
bg the notice, together with a statement that any person interested
may.:ile a protest in writing as provided in said Code.

I hereby certify that the foregoing is a full, trua and correct
copy of a resolution duly passed and adopted by the Council of the
City of Palo Alto, California, at a meeting thereof held on the 16fli
day of November , 1970, by the following vote of the members
thereof:
