HomeMy WebLinkAboutRESO 4392ORIGINAL RESOLUTION NO. 4392 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO GRANTING CONDITION7IL EXCEPTIONS TO TITLE 21 OF THE PALO ALTO MUNICIPAL CODE AND APPROVING A TENTATIVE MAP UPON CERTAIN CONDITIONS FOR CERTAIN PROPERTY LOCATED AT 960 OLD TRACE ROAD Pursuant to Chapter 21.28 of the Palo Alto Municipal Code, the Council of the City of Palo Alto finds as follows: 1. The City Council approved a final ma.p for the above property on February 9, 1970. Said property contains a total of 7.67 acres. 2. Four of said lots are one acre each, plus or minus, and the fifth lot is 3.6 acres. All taxes and assessments have been or will be paid on the fifth lot. 3. Applicant wishes to segregate assessments not yet payable for lots one through four= said assessments to be paid by sub- sequent grantees of said lots. 4. ThePalo Alto Municipal Code permits assessments to be segregated for divisions of land irk;,;four lots or less. To require payment in iullof assessments notyet payable will be a hardship upon the owner of the above property. 5. Applicant's proposal will not result in change of character of development in this area, and will not be injurious or detri- mentalto the public welfare. NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: Applicant's petition for conditional exceptions is granted and the proposed final map is: approved provided that evidence -of payment of all city and county taxes due and payable at the time of the filing of the final map be received by the City.
