RESOLUTION NO. 4386
A RESOLUTION OF PRELIMINARY DETERMINATION AND OF INTENTION TO
ACQUIRE AND CONSTRUCT IMPROVEMENTS AND TO FORM THE UNIVERSITY
AVENUE DISTRICT BEAUTIFICATION MAINTENANCE DISTRICT
-UNIVERSITY AVENUE DISTRICT
BEAUTIFICATION PROJECT NO. 70-92
RESOLVED, by the Council of the City of Palo Alto, California,
as follows:
1. That it does hereby preliminarily determine that the public
interest, convenience and necessity require, and that it intends to
order the following work to be done, acquisitions and improveiaents
to be made, to wit:
Beautification of the University Avenue business
district, including trees 1.n sidewalk areas, a
planted median in University Avenue and provision
of raised planters, benches:, and special sidewalk
surfaces adjacent to existing .curbs at street inter-
sections and other appropriate locations together
with street lighting improvement b,; providing orna-
mental luminaires and by repetitive use of a dis
tinctive -Structure capable of incorporating street
lights, . traffic signals, street signs, waste con-
tainers, drinking fountains, and other decorative
and utilitarian street furniture...

3. Whenever any public licar is herein referred to as running
between two public ways, or from or to any publin-wai, the intersec-
tions of the public ways referred to are included to the extent that
work shall be shown on the plans to', be: done herein.

5. There is to be excepted from the work above described any
of such work already done to line and grade and marked excepted or
shown not to be done on said pans, profiles and specifications.
6. Said Council does hereby adopt and establish as the offi-
cial grades for said work thegradesand elevations to be shown upon
said plans, profiles and specifications. All such grades and eleva-
tions are to be In feet and decimals thereof with reference to the
datum plane -of the City of Palo Alto.
7. Notice is hereby given of the fact that in many cases said
work and improvement will bring -the finished work to a grade different
from that formerly existing, and , that to said extent said grades are
hereby changed and that Said w►trk willbe done to said .-.hanged grades.
8. The descriptions of the acquisitions and improvements__and
the termini of the work contained in this resolution are general in
nature. All items of work do not necessarily extend for the full
length of the description thereof. The plans and-profilea.of the
work and the map and descriptions of the acquisitions, as contained

10. Said Council further declares that all public streets,
highways, lanes and alleys and other publtic],y and otherwise

non-taxable property within said assessment district shall be omitted
from the annual ad valorem assessments -hereafter to be made to pay
principal and interest on bonds to be issued to finance the cost of
said acquisitions and improvements.
11. Notice is hereby given that serial bonds to represent the
total cost of the project to be financed by the assessment district,
to bear interest at the rate of not to exceed seven percent (7%) per
annum; shall be issued pursuant to Bond Plan E, . Section 13.16.140; of
said Code, the last installment of which bonds- shall mature not to
exceed twenty-four (24) years from the 2nd day of July next succeed-
ing ten months from their date.
12. The Council may annually, at or prior to the time the levy
of ad valorem assessments to service said bonds' is made, _car _1 t such

15. NOTICE IS HEREBY GIVEN that, in the opinion of this Council, _
the areas contained within said proposed assessment district are the
properties which will be benefited by the maintenance and operation
of the proposed beautification improvements to be constructed herein,
and that the public interest and convenience require and that it is
the intention of this Council to fora said area into a beautification
maintenance district under and pursuant to Section 13.12.040 of said
Code, to be known as the "University Avenue District Beautification
Maintenance District," for the _•.rpose of maintaining and operating
said beautification improvements, and that a hearing will be had on
said matter by this .Conu oil at the same time as the hearing. on the
Engineer's eeport hereunder, at which time any and alh persons
interested may be heard.
