The minutes of the meeting of March 10, 1958, were_
approved as distributed.
Cancellation of Taxes
Letters -were -received from the State Division of Highways
'requesting'.the;:.cancellation -of taxes on certain properties acquired
by the Sta.te_for.freeway.purposes, being a portion of Lot 20, Block
3., Tract *No. 15 1,:.Edgewood and portions of city property contain-
--; ing: 0,536 of an acre and :.0.528 of an acre. On motion of Mitchell
a.nd Ruppenthal.,--the request was approved and it was directed that
said taxes b:e cancelled.
Letters were a:1so' received from the Santa Clara County
Flood :Control 'and Water Conservation District requesting cancellation
of taxes -on properties 'acquired for flood c. ntrol purposes (the
:Clarke. and Middlefield .Investment Company properties on. -Ma.tadero
;Creek) : ; On -motion` of Rodgers and Cresol), the taxes on .said proper-

-Mrs. Manion :Thomas ,:.Presiden of the Woman's Club of 'Palo
Alto, whichsponsored the cir..culation'of the petition, told the
Council that they want ,the -question to go on "the, ballot so the
'Council will know :thee feelings of the people, but they have no -ob=
.section to having : it on "the .November ballot instead' of the June
ballot:. .
During the ensuin$_;discussion, several council members
expressed oppos'itlon to delaying. the, election until November. It
was': pointed- out: that ref erra:l . of the matter to the special Citizens'
Committee would: --expand the functions of:the committee to includes '
study of the existing library buiiding:and its ,possible rehabilita
tion for the uses mentioned-, in>the petition.. Councilman Byxoee,
Chairman of .the. special: Citizens': -Committee, advised that the cam -
mitten; had; agreed to cake a'broader study than that indicated in the
7 i:yor's letter to the members -of the committee.
The motion to refer the matter to Committee No. 1 and the
Citizens' Committee to, Study Downtown Problems was carried by the
following vote on'.roll call:

Resolution No. 2974 providing, for the submission of an
advisory proposition to the electors at a special election on

Street Development
A letter was received from W E. Drewes, in behalf of
W . H: Voorhies, 'Fra.nk R.. Jarvis _ ;and himself, whose lot division
applications involving :property ix the vicinity of Ross Road and
IN3atadero Creek, portion .of: Lot. ll1, Wooster Subdivision, have been
;denied, stating- that: they: wish to improve their properties as soon
as' possible and, asking; when '.;they- might, expect action to be taken on
the ;formation,'of -an Assessment ditrict for the development of ' a- .
street ..to serve the area
The City<!q nager.recommended.'-that this street development
be included in the'rnext assessment>:district ;+roceedings to be es-
tablished by. the_City, pointirg out that it would probably work a •.
hardship: on the property own' rs if an:assessment district was formed
• for this particular street o'.)ly.. The; C .ty Manager stated that the
,propertyowners could put in the street themselves at any time, with-
out the formation' of a district,-. as long as they comply with city
requirements:
On motion of Ruppenthal and`Navis, it was directed that
the:_ development of a street, to serve: the properties in question be
included in.the next assessment district proceedings, which will
probably be started in the summer of 1958, and that the property
owners be notified.that they have the right to construct the street
by,private contract, according` to city`` specifications, if they -do
not wish to`wa.it for the establishment of the next assessment district.
Bids on,Deep Well Turbine Pump
A report, was made by the City Manager on bids received on
March 2Q ,1958 for furnishing, delivering and installing a deep well
turbine pump, with they- information that a.11 bidders with the excep-
tion of: the Western Pump Company..took exception to the last sentence
of the :second paragraph of the `specifications which provides that
the- successful bidder shall file a guarantee to replace any such
_defective materialat no expense to the.City, and for every day
during":which the pump is out of operation shall pay the City the
su a cf $150.00 as.:arid far..liquidated damages. It was: pointed out
thatthis wrs placed` ,in the specifications to provide some insurance
against:pump failures.such-as experienced by the City -last year.
The dif,.ference between.the low bid of 0. E. Hatley Pump Company and
'the second low bid of Western Pump Company is $190.00.
The City Manager reported that the staff recommends
- acceptance of the:bid. of"the Western Pump Company, which met all
;specifications, in the amount of $8,866.00.
It Was.moved.by Byxbee, seconded and carried by unanimous
voice: on :r'.�11 call, that ',the bid of Western Pump be accepted and that
the Mayor be authorized.: to sign the contract.
-Bids'an'ShermanAvenue Parking Lot, Project 55-5
A report was submitted by the City Manager on the bids
,received on March=21, 1958.,.for the construction of parking lot on
;Sherman Avenue, Project 55-5, with the recommendation that the low
:bid of Bahr and Ledoyen in the amount of $6,212.37 be accepted.
- -The City'Manager advised that acceptance of.this bid will
run the project a.pprox.imately:..$1.600.00 in the red, and that it is
the recommendation; -of the staff that a: transfer of this , amount be
made, from: theSpeciaa Projects Fund to a Revolving Fund so that
there wil].-be now delay,in-_-going ahead with the project, a determina-
tion -to be made later as"to reimbursement of the Special Projects
Funclor the financing of this deficit in whatever manner the Council
chooses.
On motion of Rodgers and Byxbee, and by unanimous vote on
roll ca 11, the1ow_-bid of -Bahr and Ledoyen was accepted and the Mayo
was authorized to sign the contract for this work.
On motion of Bishop and Byxbee, the sum of $1600.00 was
;transferred from. the Special -„Projects Fund to the Revolving Fund for
:Project 5"5-5, by;unanimous vote on roll call, and Committee No. 3

The.Clty.Man ger reported that he had intended to bring to

'Freeway Maintenance Agreements
TheCity Manager presented an agreement with the State
`Department o'f Public: Works,: Division of Highways, for maintenance
of the Bays`nore', Freeway, State. Highway.; Route 6d, at University Avenu
Viand. San F.ra.ncisquito Creek;. ;,w'hi.ch" commits the City to maintaining- thq
paving to the "center of ", the Creek and: maintaining the right-of-way orx
the City's,side:, It was :explained that the Freeway Agreement entered
into on September 17,, 1953, provided that the City would resume i
.control' :and: maintenance over: each of .the- relocated or reconstructed

A motion was made by Mitche;1:1, seconded by Woodward;, that
the recommendation of Committee'No. 4 -be adopted that the rote
schedule ea .s:ubmitted be;`tapproved., and that the $2.50 per day'subsidy

During the discussion which: followed, Vice MayorMarshall
Suggeeted consideration ern differential in rates ' of $3.75, pointing
out thet ,the -original schedule., presented by the Hospital Board to
Committee- No. 4;; would,, provide for a, monthly increase in revenue of
approXim tely $11,000 end that -the- schedule presented this evening
would increse the monthly revenue by -over $15,000.

Mr. Ra1pheHendrickson, Controller of the Hospital; explainedthat
salary' inc:rea's:es, are. necessary to: bring the salariesof hospital
employees in line with sala.ri•es paid by other hospitals in the area.
Councilman Evans anoved to,amenc the previousmotion to
state:tnat the Counoil.would:approve a schedule which -would make the
differential $3,75 'instead of -the schedule presented this evening.
The amendment was seconded ;by ; Rodgers .
During further discussion Councilman Nevis, the Council's
representative on the Board of Hospital Director's, reported that
not all the increased revenue, which would be provided if the rates
as recommended are adopted, is needed for salary increases, but
:would provide some of the funds needed in the future to finance the
imove to the' new building;end the. renovation of the existing building1
`:He' advised that the:Hospital Board hopes to present a five-year pro -
;gram to the Council:- in the near future. Mr. Nevis also. stated that
sstepe' have been taken to correct the bed distribution problem which
!1md resulted .lee a declining occ parcy rate.
Mr. Jack Berman, 832`,Richardson Court, made some comments
'regarding ; oepitai ` operations and asked, the Council to' gi�'e further
-study: beforee, it 'approves rate' changes.

laundry at the Hospital was adopted.
Zoning-Easterly'Carner Middlefield and Charleston Roads
A ,report wa rece.l.ved from the Planning Commission recom-
mending on"its own initiative, by a vote of five to two, that the.
property oh the easterly corner of Middlefield° Road and Charleston
.Road - be rezoned from P -C to
Mr.. Al Witt, President of t e Charleston .Development'
- Conm ny, Inc„ , owners of the property in question, ' addressed the
Council:i kixrg that the present zoning of P -C. be retained. He
stated that, this company also owns"'the ,southerly corner of Middle -
.field and Charleston Roads and is :at present' constructing a shopping
center on the. southerly: corner,• that they expect to complete the.
shopping center this year.and-:plan to'develop garden apartments on
the easterly corner in 1959. Mr.. Witt asked that there be no change.

last six months.

carried that an ordinance providing :for the rezoning of this

the. recommendations of the` Planning .Commmission be accepted and that.
the property -be: -rezoned from P -C, to•"R-1:B-7 .
Planning Commissioner, Arbuckle expressed the views of the
e 'iority' of" the Commisaior,.stati.ng that they felt the P -C with
garden apartment use: Awas a mistake`=and .that single family homes
should `be 'built -onz the property, that"thee parcel had been zoned P -C
since 1953' and. the owner had,., made :.no development up to the present
time.. Commiseioner Sharpe made:• further. comments, stating that. the
Commission`' had s;tarted to review_ the General: Plan, and that this
was one' of 'the -areas which ;they feltt had an inappropriate zoning.
It ' was..pointed out' that Mr Witt had not filed a P -C:.. ;. .
Development ,Plan dr'schedule because that 'Was =not' required at the
tip the. P -C zone was :.established on his property. Mr.'. Witt stated
that . he hid, not:, been notffi'ed ; there was , any deadline for development
ofthe ' e property;.

Mr. Robert Nicoleon, President of the Southern Palo Alto
Civic League,; told the.: Council that the group he represents feels
that five-: years:was sufficient time. in which to have developedthe
;property; and that the zoning should be changed as recommended by
the ,?lanning Commission. Several, -people in the audience -stated that
they are,. not in favor af" apartments of two stories or more in the
areaYa' d asked that: the: property be rezoned to R-1.`
The matter was discussed by the Council; and several mem-
bers indicated; `that .they„ would oppose the rezoning,, that z.ince
Mr. Witt. had .not : been requiredto provide a plan or meet a time
schedule, it wouWbe unfair to him to charge the zone.: without . .
giving. him the opportunity --to submit plans: Mr. Witt said that the
company he ;represents:would`be willing to submit a development plan
and a time -'schedule, and would like "_to go ahead with the orderly
development; of'`. the -property. He said they would like to : have 90
days . in ; which _to bring in plans and- an additional six months for the
development:.

Ordinance No. 1790:, amending Section 9.01 of Codified
Ordinance No 5i-'Paragrap`s b, -and c,, regulating hours at which
bowling alleys _may be; kept .:open, was given second reading, and on
;motion, of Mitchell and Byxbee, was ,adopted by unanimous vote on

A report' wa.s 'received from the:. City Attorney concerning

$53.80. for" damage, ;susts;9 ned . on his property on January 22, 1958, by
a flooding;;:which'he claims was: caused by Q. break in' the water main

vestigated the matter with` the assistance .of the Water -Gas -Sewer
Department and could ;find no negligence on the part of the City nor

A report was subwitted`,by ;the City Attorney concerning- the
claim, filed by theCalifornia' State, -;Automobile Association in` the
amount of • $48.35' inbehalf of' A. _ Gage,: for' damages
sustained 'by Mr. Gege's ;autoimobil"e on December 13, 1957, on Alma
Street near California. Avenue .when it, collided with a ;City vehicle.
The City 'Attorney ad -wised that he had investigated this claim and
in his opinion there was contributory- negligence on the part:of
both parties, .and die therefore recommended the claim be denied
0n Motion of Mitchell and Byxbee, the report of the City
Attorney was ecc,epted:;and- the cla"im. denied.
Settlement -Of C?aims 1g.: rgrallo and Milrermon)
The City Attorney reported on two claims which hadre-
sulted in litigation. A suit was brought by Adeline L. Bergamo
in the mount of $20:;500 for injuries sustained in a fall. on March
21, 1957, on the sidewalk• in front of 1:60 Santa Rita Avenue. The
City Attorney recommended that this case be settled for $800.00::
On motion of Rodgers and ,Mitchell, the settlement of $800.00
in this case was approved by unanimous -vote on roll call
The City Attorney also reported that a suit had been
brought by ,dward A. Millermon in- the amount of $10,000 for injuries
sustained in a fall on, September 21, 1956, at Ramona Street and
Univerolty Avenue. He recommended settlement of this case for
$750.00
On motion : of Rodgers and,' Mitchell, the Council authorized.:
this case to be settled for $750.00 by unanimous vote on roll call.
North County Building
A large number: of people interested in the site of the
proposed North County Building, and who oppose the site now owned
by the County at Middlefield and Charleston Roads, asked questions
about -.the status of the, =matter.; The City Manager replied that he
had been asked to investigate: severalsites and forward prices to
the County;. that he had 'given this information to the County end
they are exploring a ntrmber'of sites:
It was reported that the County is interested in a site
on Sherman Avenue, a portion of which is owned by the City.
Councilman_'Byxbee suggested that the City aid the County in develop-
ing the project on the Sherman Avenue site which he feels is desir-
able from an economic standpoint. He moved that the matter be re-
ferred to Committee No.3: to consider the possibility of the City's
buying the other hall' of.the block for the County courthouse site
and perhaps other area for parking purposes, and to review the
financing so that :a firm ,offer could"- be' made to the County before
March 31, 1958, the date the County has.': set for making a" decision
as to whether a change in the site for the building is to be made.
The motion was seconded by Woodward.
The City Attorney advised that the City can not condemn
land for the use of: the County; that the City can not donate the
land it now owns to. the County or acquire land and give it to the
County as this would"be :a gift of public funds; that it would be
legal for the City to provide' a parking lot in thatarea for the
use of the public if it' wisshes':"but can not give property to the
County:
