HomeMy WebLinkAboutRESO 4380• ORIGINAL RESOLUTION NO. 4380 RESOLUTION 01' THE COUNCIL OF THE CITY OF PALO ALTO FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY OF SAID CITY REQUIRE, FOR PUBLIC USE FOR PUBLIC GROUNDS, CERTAIN LAND LOCATED IN THE CITY OF PALO ALTO, COUNTY OF SANTA CLARA, STATE OF CALIFORNIA OR PARK BOULEVARD ELECTRIC SUBSTATION The Council of the City of Palo Alto does RESOLVE as follows: SECTION I. That the Council of the City of Palo Alto has found and determined, and hereby does find, determine declare, that the public interest and- necessity require the acquisition, construction and ompietion by the City of Palo Alto of the following public improvement, to wit: public grounds for the electric power station known as Lambert Substation. SECTION 2. That the taking in fee simple of the property described as Parcel 1 in EXHIBIT A attached hereto and delineated on the map marked EXHIBIT B attached hereto and by reference made a part hereof, situated in the City of Palo Alto, County of Santa Clara, State of California, is necessary for such improvement. SECTION 3. That said proposed acquisition and improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury, and all of such acquisition is located within the territorial limits of the City of Palo Alto. SECTION 4. That the Council of the City of Palo Alto hereby declares its intention of acq-aire title in fee simple in said land described in EXHIBIT A under eminent domain proceedings, and the Office of the City Attorney of the City of Palo Alto and the law firm of Messrs. Wilson, Janes, Morton & Lynch, employed for that purpose; are hereby directed to institute and cond"ct to conclusion an action in eminent domain for the acquisition of said property in fee simple, and to take such action as is necessary therein. SECTION 5. The City Manager is hereby authorised and directed, as an alternative to trial of any action in eminent domain initiated hereunder, to purchase for such reasonable sum as he may deem appropriate, the real property described in said EXHIBIT A, and to cause to be drafted, executed and delivered on behalf of the City all documents, either to be used within or without the condemnation proceedings aforesaid, necessary or convenient to accomplish this purpose. 4 SECTION 6. The City Manager is frrther authorized to spend from general funds of the City appropriated for such purposes such monies as are necessary and in his opinion may constitute the fair market value of said parcel based upon appraisals of duly qualified and competent real estate appraisers. SECTION 7. The City Clerk shall certify to the adoption of this reso- lution by a vote of two-thirds of all of the members of the City Council. I hereby certify that the whole number of members of the Council of the -City of Palo Alto is -:lever_ and that the foregoing resolution was adopted by a vote of two-thirds or more of all of the members of said Council at its meeting held on the 5th day of October vote: , 1970, by the following AYES: Arnold, Beahrs, Berwald, Clark, Comstock, Dias, Gallagher, Norton, Pearson, Spaeth, Wheatley NOES: None ABSENT' None , 1970. (now Park Boulevard), distant thereon 60.00 feet Northwesterly from the point of intersection of the Northeasterly line of Third Street (now Park Boulevard) with the center line of Lambert Avenue, as shown upon the Map hereinafter referred to; thence running Northeasterly and parallel with the centerline of Lambert Avenue, 124.16 feet, more or less, to a point on the Northeasterly line of Lot 8 of the resubdivision of Block 8 as shown upon said Map; thence running Northwesterly and along the Northeasterly line of Lot 8, 7 and 6, as shown upon said Map, 120.38 feet, more or less, to the most Northerly corner of said Lot 6; thence running Southwesterly and along the dividing lines between Lots 5 and 6, 134.24 feet to a point on the Northeasterly line of Third Street, (now Park Boulevard), thence running Southeasterly along said last named line 119.81 feet to the point of beginning, and being all of Lots 6 anti 7 and a portion of Lot 8 in Block 8, as shown upon that certain Map en. titled, "Map of a Re -subdivision of Lots 1 and 2 in Block 8 and Lot 9 in Block 14 in Sonayside Addition to the Town of Mayfield, Santa Clara Co., California, as recorded in Book L of Map; at page 12, which said Map is of record in the office of the Recorder of the County of Santa Clara.
