HomeMy WebLinkAboutRESO 4358• • ORIGINAL lows: RESOLUTION NO. 4358 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING AGREEMENT WITH THE DEPARTMENT OF CONSER- VATION, DIVISION OF FORESTRY, STATE OF CALIFORNIA (FOR BASIC WATERSHED FIRE PROTECTION) The Council of the City of Palo Alto does RESOLVE as fol- That the Agreement for Basic Watershed Fire Protection attached hereto between the CITY OF PALO ALTO and the DEPARTMENT OF CONSERVATION, DIVISION OF FORESTRY, STATE OF CALIFORNIA be and the same hereby is approved, that the Mayor be and he hereby is authorized and directed to execute the same for and in behalf of the City, and the City Clerk is authorized and directed to attest his signature. INTRODUCED AND PASSED: June 15, 1970 AYES: Beahrs, Berwald, Clark, Comstock, Dias, Gallagher, Norton, Pearson, Wheatley NOES: None ABSENT: Arnold, Spaeth ATTEST wl 1 C ty Cler APPROVED AS TO FORM: City Attorney i Mayor • IORIGINAL ACREi:r::IiT THIS AGR:;ME T, made this 30th day of June, 1970, Ly and between the :state of California, Departi::ent of Coneervetion, Division of Forestry, through its duly appointed, qualified, and acting State Forester, hereinafter called r ORE::TRY, and the City of Palo Alto, County of Santa Clara, State of California, herein -- after called CITY, WITNESSET1: WHEREAS, pursuant to Section 4142 of the Public Resources Code and under the provisions of Division 2, Part 2, Article 3, Paragraph 5, of the Board of Forestry policies, the State Forester may enter into cooperative agreement; with local jurisdictions for the purpose of providing interim forest fire protection in recognition of the rapid -transition of property from a forest and rural character to urban; and WHEREAS, City has the responsibility for protection of a watershed, wildla.nd, and forested area comprising 6,C22 acres of land as indicated in red on the plat attached hereto and marked "Exhibit A", which was formerly State fire responsibility, and desires the assistance of Forestry in providing forest fire protection to said area until such time as the City is able to perform such activities itself. NOW, THEREFORE, it is mutually agreed ae follows: 1. Forestry shall continue in accordance with it_ policy to provide forest fire protection for said arca, of t?.c type and degree which it now provides or from -time to tila may provide in the future for comparable adjacent arc etc . 2. The term of this agreement shall be for one (1) year, commencing July 1, 1970, and ending on June 30, 1971. 4. This agreement may be terminated at and; time or any provision herein contained may be amended or modified upon the mutual consent of the parties hereto. 5. City does hereby waive any and all demands, claims, or cause of action against the State of California, arising out of this agreement of Forestry's performance. IN WITNESS WHEREOF, the parties hereto have executed this agreement as of the date first hereinabove written.
