RESOLUTION NO. 4353
RESOLUTION CF THE COUNCIL OF THE CITY OF PALO ALTO
ORDERING THE VACATION .OF A PORTION OF AN EASEMENT FOR
PUBLIC UTILITY PURPOSES (CRESCENT PARK SUBDIVISION)
WHEREAS, a public utilities easement in the City of Palo
Alto, County of Santa Clara, State of California, five (5) feet
in width was acquired for public utilities purposes in connection
with the Crescent Park Subdivision recorded as Crescent Park
Map No. 2, on February 19, 1929 in Book "X" of Maas at pages 26
and 27 Records of Santa Clara County, California; and
WHEREAS, the Council of the City of Palo Alto does hereby
find that that portion of the aforesaid easement traversing Lots
1 and 2 of Block 121 of said Subdivision has not been used for
the purposes for which it was dedicated or acquired for five
consecutive years next preceding the date of this resolution; and
WHEREAS, from all the evidence submitted to the Council of
the City of Palo Alto, it is found that said portion of an
easement as described above is unnecessary for present or pros-
pective public utilities purposes.
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. That pursuant to the provisions of Section 50443
of the Government Code of the State of California, the Council of
the City of Palo Alto does hereby order that said public utilities
easement as described above, traversing Lots 1 and 2 of Block 121,
as shown on Crescent Park Map #2, be, and the same is, vacated.
SECTION 2. That the Council of the City of Palo Alto hereby
reserves and retains any and all other easements and/or any right
or rights, license or licenses, in, over, under across and along
said land which may exist, and the remaining portion of said
public utilities easement not expressly vacated herein.

SECTION 3. The City Clerk shall cause a certified copy
of this resolution to be recorded in the Office of the County
Recorder of Santa Clara County.
