RESOLUTION NO. 4340
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING SECTION 4 OF ORDINANCE NO. 2365 APPLYING
TO PROPERTY KNOWN AS 1766 EMBARCADERO ROAD
WHEREAS, Ordinance No. 2365 adopted July 24, 1967,
established a P -C zoned district for certain property known as
1766 Embarcadero Road, and
WHEREAS, the Council of the City of Palo Alto, based upon_
the findings and recommendations of the Planning Commission,
wishes to amend the Development Plan and Development Schedule
established by the aforementioned ordinance to permit changes
to the present improvements and to permit the construction of
further improvements.
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. Section 3 of Ordinance 2365 applying to
property known as 1766 Embarcadero Road is hereby amended to
read as follows:
"SECTION 3. The plans entitled:
(a) "Buildings for Project #733, Palo Alto,
California, Site Plan" Drawing No. P-1
of 3 sheets;
(b) "Buildings for Project #733, Sales and
Service Building, Used Car Office",
Drawing No. P-2'
(c) "Buildings for Project #733, Body Shop,
Auto Museum", Drawing No. P-3;
(d) "Mozart -Porsche -Audi Combined Site Plan,
Existing VW Agency and Proposed Project",
Drawing No. P-3, March 24, 1970;
(e) "Landscape Improvement Plan, Mozart -
Volkswagen";
affixed hereto and by reference made a part hereof, are
hereby made the Development Plan for the parcel described
in Section 1 hereof."

SECTION 2. The Development Plan referred to in Section 3
of Ordinance No. 2365 as amended is approved subject to the
following conditions:
1. The signs on the existing buildings shall be removed
except that the large V.W. sign on the roof of the existing
building shall be removed within three (3) years of com-
pletion of the new building and shall be replaced by a new
sign comparable to the free-standing Porsche -Audi sign to
be constructed on the property at 1730 Embarcadero Road
with neither sign to exceed twenty-five (25) feet in overall
height. Other smaller signs for the used cars and direction
signs shall be as indicated on the Plan. Sign lighting
shall be turned off at 10:00 p.m.
2. Access agreements .Eor the common entrance driveway
at the property line between 1730 Embarcadero Road and 1766
Embarcadero Road and the access from 1730 Embarcadero Road
to Faber Place across the property at 1766 Embarcadero Road
shall include the City as the third party beneficiary in
accordance with Section 18.84.030 of the Zoning Ordinance
and as approved by the City Attorney.
3. There shall be an irrigation system for all planted
areas.
4. One-way spikes the full width of the driveways shall
be provided in the driveways on Embarcadero Road to prevent
exit onto Embarcadero Road.
5. The most northerly ingress -egress driveway on Faber
Place shall be permanently closed.
6. There shall be no tree limb, shrub, plant, fence,
wall or berm reaching a height more than three (3) feet above
the curb grade except tree trunks having no limbs lower than
nine (9) feet above curb grade within the thirty-five (35)
foot triangle measured from the projected curb lines at the
intersection of Embarcadero Road and Faber Place.

7. The driveways and traffic -ways through the property
shall be unmistakably marked in a manner similar to the
traffic -way markings of the San Francisco airport.
8. The landscape plan shall be completed and consistent
with the site plan.
9. Development schedule:
(a) Start of construction within six (6) months
after City Council approval;
(b) Completion of all construction and develop-
ment within one (1) year of start of con-
struction with the exception of the sign
modification which shall be in conformity
with condition 1.
10. The chain -link fence along Faber Place from the
last building on Faber Place to the rear property corner
shall be made to be view obscuring.
11. The requirements of Ordinance No. 2365 for chains
on the entrance driveways on Embarcadero Road shall be
deleted.
12. There shall be no roof mechanical equipment visible
from the street.
13. Applicant shall build and develop according to
the fire and building codes in force at the date each
building permit is issued, any design feature of the
Development Plan approved hereby to the contrary notwith-
standing.

14. All provision of Ordinance No. 2365 not in con-
flict herewith shall remain in full force and effect.
15. No loudspeaker shall be so placed as to be audible
beyond the property line.
