HomeMy WebLinkAboutRESO 43371 • ORIGINAL RESOLUTION NO. 4337 RESOLUTION OF THE COUNC/L OF THE CITY OF PALO ALTO FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN LAND AND AUTHORIZING THE FILING OF EMINENT DOMAIN PROCEEDINGS The Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. That the Council of the City of Palo Alto has found and determined and hereby does find, determine and declare that the public interest and necessity require the acquisition by the City of Palo Alto of the real property described in Section 2 hereof for public purpose and use of providing dwellings, apart- ments or other living accommodations for persons or families who lack the amount of income which is necessary to enable them to live in decent, safe and sanitary dwellings without overcrowding, pursuant to Code of Civil Procedure Section 1238(21), and that the taking of the fee title is necessary therefor. SECTION 2. That the taking of the fee title of the property more particularly described in EXHIBIT A attached hereto and by this reference made a part hereof, is necessary for such public purposes. SECTION 3. That the proposed acquisition and improvements are planned and located in a manner which will be most compatible with the greatest public good and the least private injury, and all of said acquisitions are situate within the boundaries of the County of Santa Clara, State of California. SECTION 4. That the Council of the City of Palo Alto hereby declares its intention to acquire the fee title to said land as described in said EXHIBIT A under eminent domain proceedings and the City Attorney of the City of Palo Alto and the law firm of Wilson, Jones, Morton & Lynch, employed for that purpose, are -1- 2'C; -� . � i' • • hereby authorized to institute and conduct to conclusion an action in eminent domain for the acquisition of the estates and interests aforesaid and to take such action as is necessary therein. SECTION 5. The City Manager is hereby authorized and directed, as an alternative to trial of any action in eminent domain initi- ated hereunder, to purchase for such reasonable sums as he may deem appropriate the land aforesaid and to cause to be drafted, executed and delivered on behalf of the City all documents either to be used within or without the condemnation proceeding afore- said from necessary or convenient to accomplish this purpose. SECTION 6. The City Manager is further authorized to general funds of the City heretofore appropriated for spend such purposes such monies as are necessary and as, in his opinion, may constitute the fair market value of said parcels based upon appraisals of duly qualified and competent real estate appraisers. Lytton Avenue (60 feet wide); thence southeasterly along the northeasterly line of Lot 4 and of Lot 3 of said Block 43, a distance of 400.00 feet, to the most easterly corner of said Lot 3; thence southwesterly, along the southeasterly line of said Lot 3, a distance of 200.00 feet; thence northwesterly, parallel to said northeasterly lines of Lots 3 and 4, a distance of 200.00 feet to a point on the southeasterly line of said Lot 4; thence southwesterly along said southeasterly line and along the southeasterly line .of Lot 1 of said Block 43, a distance of 100.00 feet; thence northwesterly, parallel to the northeasterly line of said Lot 1, a distance of 200.00 feet, to a point on the northwesterly line of said Lot 1, spid line also being the southeasterly line of said Lytton Avenu€. thence northeasterly along said last named line, 300.00 feet, to the point of beginning, being all of Lot 4 and a portion of Lots 1 and 3 of said Block 43 and containing 2.296 acres of land, more or less.
