s Czt.41) RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING AMENDMENT TO NCPA AGREEMENT
The Council of the City of Palo Alto does RESOLVE as follows:
SECTION 1. That the following amendment to the Northern
California Power Agency Joint Powers Agreement, as heretofore
amended, is hereby approved:
Amendment No. 4
A new section 3 is added to Article III, to read as
follows:
"3. None of the debts, liabilities, or obligations
of NCPA shall be the debts, liabilities or obligations
of any of the members of NCPA unless assumed in a par-
ticular case by resolution of the governing body of the
member to be charged."
SECTION 2. The effective date of the aforesaid amendment
shall be the date on which the Secretary of Northern California
Power Agency certifies to each member of the Agency that each
member thereof has adopted said amendment to the Joint Powers
Agreement.
SECTION 3. The City Clerk is hereby directed to transmit a
fully conformed, certified copy of this resolution to the Secretary
of the Northern California Power Agency.
