1 • W :KJmh 7-25-69-25 r RESOLUTION NO. 4288 ORIGINAL A RESOLUTION DETERMINING UNPAID ASSESSMENTS AND PROVIDING . FOR ISSUANCE OF BONDS MISCELLANEOUS STREETS PROJECT NO. 67-3 RESOLVED, by the Council of the City of Palo Alto, California, that WHEREAS, said Council did, on May 6, 1968, pass and adopt its Resolution No. 4122 of Preliminary Determination and of Intention, relating to the acquisition and construction of public improvements in said City under and pursuant to the provisions of the Municipal Improvement Act of 1913, and did therein provide that serial bonds would be issued thereunder pursuant to the provisions of the Improve- ment Bond Act of 1915, reference to said Resolution of Preliminary Determination and of Intention hereby being expressly made for further. particulars; WHEREAS, notice of the recordation of the assessment and of the • time within which assessments may be paid in cash has bee haa'been duly published and mailed in the manner provided by, law, and the time so provided for, receiving the payment of assessments in cash has ex- pired, and the City Treasurer has filed in -his office a list of all assessments which now .remain unpaidl amWt, WHEREAS, the Ccarncil.has duly !onsidered said list and has determined that: the sib is an accurate statement thereof; NOW, '. 0R, IT - IS RIMY ORDERED, as follows: 1. That the assessments in sand unpaidlist which now remain. unpaid, and the eggregste thereof, are as shown. on Exhibit "e hereto attachedOnd by reference made a part hereof. 2. That for a'particular description as the lots bearing the respective assessment numbers set forth in said unpaid list and upon which assessments remain Uitpeld, severally and respectively, refer- ence is hereby sad s to :.theassessment and to : the diagram recorded in ed. L,zwat Atr.7 424.4444449, the office of the Superintendent of Streets of said City after con- firmation by said Council, the several lots represented by said assess- ment numbers being so numbered and designated upon said diagram and assessment as so confirmed and recorded, severally and respectively. 3. The unpaid list is in the amount of $410,287.15, and the assessments therein have been classified as to maturities as set forth in Exhibit "B" hereto attached and made a part hereof by reference. Bonds shall be issued upon the security of said unpaid assessments in said amount in accordance with the provisions of the Improvement Bond Act of 1915 (Division 10 of the Streets and Highways Code) and under and pursuant to the provisions of said Resolution of Preliminary Determination and of Intention and the proceedings thereunder duly had and taken; that said bonds shall be four hundred eleven (411) in number, shall be dated September 2, 1969, and bear interest from their date at the rate of not to exceed seven:percent (7%) per annum, and -the denomination of said bonds with their respective numbers and date of maturity are as shown -on Exhibit "C" hereto attached and made a, part hereof by reference. 4. That' said bands shell:.be` issued in . series, and the unpaid assessments as shown on . said- ]. tt tiled with :tom `City Treasurer , and determined by: said Council, together with the tttterest thereon shall remain and constitute a trust fund for the redemPtion and payment o!' said bonds and of the interest Which may be due thereon, which unpaid assessments shall be taxable in annual series corresponding in number. to the number of Series of bonds issued, and an annual proportion of each assess eat shell`` be .payable in each year precedingthe 'date of the maturity for each of the several bonds issued, and such propor- tion of each assessment coming due in arq .year, together with the annual interest there, shall in turn be paysble in Installments as the general taxes of said City on real property are ,payable, and shall become delinquent at the sae time and in the same proportionate amounts and bear the seee`proportionate penalties for delinquency. • • 5. The bonds shall be executed on behalf of the City and under its official seal by the Clerk and Treasurer of the City. The Clerk's signature and the seal may be affixed by engraved., printed, lithographed or other reproduction thereof. The interest coupons affixed thereto shall be signed by said Treasurer and for such pur- poses the Treasurer may use an engraved, printed or lithographed facsimile signature in lieu of signature by hand. Such signing and sealing of said bonds by said officers and signing of said coupons by said Treasurer shall constitute and be a sufficient and binding execu- tion of each and every one of said bonds and all of the coupons there- of, respectively. Said bonds shall be substantially in the form set forth in the Improvement.Bond Act of 1915. Said Treasurer and Clerk of said City are hereby authorized and directed to sign said bonds. 6. The interest coupons attached to each of said bonds and evidencing the interest to accrue thereon shall be numbered consecu- tively and be substantially in the following form, to wit: The CITY OF PALO ALTO will pay to On the 2nd day of bearer hereof at the Bank of America N.T. & S.A., Main Office, San Francisco, , 19 California, paying agent of the City, or at the offices of the co -paying agent in New York, New York, and Chicago, Illinois, the sum shown hereon, being interest then due on Improvement Coupon No. Bond& Miscellaneous Streets Project No. 67-3, Series C. Bond No. Treasurer of the City of Pgfo Alto 7. The City Clerk of this City shall forward to the City.
