City Hall, Palo Alto, California, April 11, 1955. proved. Barron Park Annexation This was the time and place for hearing protests by property owners against the.proposed Annexation of Barron Park to. the City of Palo Alto. It was reported that the City Clerk has filed. an,aff;idavit of publication ;of thenotice of this hearing, as required .by.. law, and an affidavit of the ' mailing of the notice of this hearing to' the Barron Park -Fire Protection District. It wan noted,:at this time that under the provisions of 'the . Annexation Act of, =1913,, , if . a protest is made by the owners, of a majority of_the separate -parcels of` property within the area, the Council must :terminate the proceedings; and if a protest is not amide by the ownera of a majority of the separate parcels of property within the area, the' Council has no alternative but to call a special election in the area. The City Clerk reported that written protests had been filed- prior to the time ' fixed for this hearing, and that ap— parently 816; parcels of property were' represented by the protests, although the ownerships and descriptions had; not been checked', as. the.protestahad justbeen filed'on this date. The City Clerk also'. reportedthat-no withdrawals of protests had been filed prior to the time` settor the hearing. The; City. Attorney presented a certificate from three city enp1oyees, Clarence Farmer,-Louis`Pourcroy and Ephraim Chavez, certifying that they had computed. the* number of separate parcels of,property in the'territory,deslgnated as "Barron Park Annexation"`. by examining the maps :of said .territory and the assessment roll, in the 'office' of the County Assessor, and their computations had re-: vealed that there -are 1,450 separate parcels of property in the territory The Council of the City.of Palo Alto met in regular session on this date at,7:30;P.M.,-with Mayor Simpson ;residing. Roll call as follows: Present: Bishop, Byxbee, Cashel, Corcoran, Cummings, Drys- dale, Huston, Marshall, Mitchell, Porter, Rodgers, Ruppenthal, Simpson, Wickett. Absent; Hanley.. Corrections to Minutes of March 28 .: kaa Councilman Rodgers asked that the second paragraph on the fourth page of the minutes of the meeting of March 28, 1955 (Page 2012 Volume 11, Council Minuted) be ..corrected by deleting the word sufficient' and by stating in the record that Rodgers voted No on the motion. The makers of the motion, Huston and Mitchell, agreed to.the changes, requested. It was :roved by Mit- chell, seconded by Byxbee, that these corrections be made to the. minutes of March 28th. After discussion, the motion was carried by 'the following vote on roll call: Ayes: Bishop, Byxbee, Cashel, Drysdale, Huston, Mitchell, Rodgers, - Simpson, Wickett . Noes Corcoran, Cummings Marshall, Porter. Not Voting: Ruppenthal. The City Attorney advised that the Council must either accept or reject the map unless the subdivider consents to an extension of time. Mr. George S. Nolte, engineer representing the sub- divider, consented to two weeks' extension of time, to April 25, 1955: 0n motion of_Corcoran and Marshall, the matter was re- ferred to Committee.No. l for further consideration, and the time in which to act on the map was extended for two weeks to April 25th, wita`the consent of the subdivider. Abandonment of -Easement (Elmdale Tract) The City Attorney presented a resolution to amend Reso- lution No. 2604 adopted on March 14, 1954, abandoning easement in Elmdale UnitANo. 2,. Tract No. 1353, explaining that a.typographi- cal error in the original resolution ahould be corrected.. Resolution No. 2612 ordering abandonment of easement was introduced, and on motion of Wickett, duly seconded, was adopted by. unanimous vote on roll call. Height Limits in R-3-O'and R -3-P Districts Ordinance No. 1602, amending Sections 8.20 and 88-.19 of the Zoning Ordinance regarding height lirriite in R -3-G and, R --3-P Districts,.was given second reading, and on motion of: Porter, - duly seconded, was adopted by unanimous vote on roll call. Amendment to Building Code (Free Standing Signs} The roposed ordinance amending Section 4602 of the Building Code by adding a new section to read "There shall be no mere tharn one ,billboard; or independent free standing Sign:at any place of business or etre:et:exposure," was• presented for second reading. A motion was ; made, : by Cummings for adoption of: the or- dinance :Ruppenthal.moved to amend the ordinance so'that it should not:apply--to signs erected for the direction of traffic_or for safety.. • There was no second to the motion, and after further dis cuseion, the ordinance: was. referred back to Committee No. 1 and the City Attorney for further consideration and clarification. Amendment to Business License Ordinance Ordinance'No. 1603`amending Dart 11 of Codified. Ordinance No. 5 on Business Licenses was given second reading, and on motion of Mitchell and Wickett, was adopted on roll call with 13 Ayes,' Cashel, voting No. Change of Street Name (Charleston Road) Ordinance No..1604designating portions of Charleston Road as "East., Charleston Road" and as "West Charleston Road" was given second reading, and'on motion of Wickett and Bishop, was adopted by":unanimous. vote on roll call. Street Meadow -an Ethbarcaderol_Churchill, California; The Mayor,called attention to the ordinance accepted for first reading at the'last meeting, to provide for "East" and "West" designations on portions; of Embarcadero Road, Churchill Avenue, Ca"lifernia Avenue ., Meadow Drive and San Antonio Avenue. He stated that its -.has been.agreed_'to defer second reading of this ordinance and determine an effective date for these street name changes later 1 so there would be"a minimum of inconvenience to the people concerned,. Monthly.Reports The monthly.. report of ;the ,Planning Officer on action taken in -March; on applications for rediviaion of lots, the monthly report: of the Zoning.Adainistrator on action taken'in March on applications for variances and use permits, and the monthly report of the. Controller,forMarch were received and placed on file.. Tax Refunds A requestwas received from:, the Controller for authori- zation':to refund duplicate tax payments of the second installment of Tax 'Bill No. 8827 in the -amount of $24.39 and the second in- stallment of Tax Bill No. :'10920`in the amount of $14.87. 'On ' motioon of Byxbee and Ruppentha l these tax refunds were authorized by unanimous: vote on roll call.. Pro-ject 52-16, California Avenue Off -Street Parking All matters :in connection with Project` 52-16 had been continued to this date 'The City Manager reported that .the negotiator,. Mike Golick, has 'informed him that he has: completed his negotiations with property owners and :is now :ready to meet wi?h Committee No. 2 and' review his.findings He recommended that the matter be con- tinued 'to May 9, 1955, ' that at :tip,. next meeting of Committee No. 2,Mr: 4olick'be invited to.reet.with the coMmittee and review his negotiations with the property owners concerned. 0n motion of Bishop aril Ctammings, all matters in conneo- tion' with Project 52-16;were :,contintied to May 9, 1955, with the reservation that -the project may -come up sooner if necessary.
