RESOLUTION NO. 4266
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
URGING THE LEAGUE OF CALIFORNIA CITIES TO SUPPORT
LEGISLATION THAT WOULD RESTRICT THE NUMBER OF
ALCOHOLIC BEVERAGE CONTROL LICENSES ISSUED IN CITIES
WHEREAS, the number of Alcoholic Beverage Control licenses
being issued in the City of Palo Alto is steadily increasing,
and
WHEREAS, Section 23816 of the Business and Professions Code
provides that the number of onsale general licenses authorized to
be issued in each county shall be limited to one for each 2,000,
or fraction thereof, inhabitants of the county in which the
premises are situated, and
WHEREAS, Section 23817 of said code provides that the number
of offsale general licenses authorized to be issued in each county
shall be limited to one for each 2,500, or fraction thereof, in-
habitants of the county in which the premises are situated, and
WHEREAS, said limitations established by Sections 23816 and
23817 fail to prevent by their terms the issuance within any city
of licenses in excess of said ratio established for the county,
and
WHEREAS, Section 23815 of said code determines in its state-
ment of policy that "the public welfare and morals require that
there be a limitation on the number of premises licensed for the
sale of distilled spirits," and
WHEREAS, the principle of limiting the issuance of licenses
using city boundaries as a basis was established in the Alcoholic
Beverage Control Act as early as the year 1953(Section 23781,
repealed in 1961), and
WHEREAS, the sharp population increases occurring in urban
areas all over California do not necessarily correspond to the
boundaries of any city in such areas, and thus leave each city

exposed under the present county -based ratios to an undesirable
concentration of such licenses, with attendant police problems.
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. That the Council of the City of Palo Alto does
hereby request the League of California Cities to prepare and
sponsor legislation that would amend Sections 23816 and 23817 of
the Business and Professions Code to further extend application
of the existing population -based ratios for the issuance of
onsale and offsale general licenses from the present countywide
level to include cities as such,
SECTION 2. That the City Clerk send a copy of this resolution
to -the president and legal counsel of the League of California
Cities.
