RESOLUTION NO. 4258
A RESOLUTION DETERMINING THAT CERTAIN IJNDERGROUNDING
OF UTILITY FACILITIES IS IN THE GENERAL PUBLIC
INTEREST AND AUTHORIZING EXECUTION OF AGREEMENT
WITH THE PACIFIC TELEPHONE AND TELEGRAPH COMPANY
MISCELLANEOUS STREETS PROJECT N0. 67-3
RESOLVED, by the Council of the City of Palo Alto, California,
that
WHEREAS, after proceedings to that end duly had and taken, the
Council did,, on the 3rd day of March, 1969, duly adopt its Ordinance
No, 2490,- An Ordinance Amending Section 1216.020 of Chapter 12.16
of Title 12 of the Palo Alto Municipal Code by Establishing Underground
Utility Districts Nos. 9 and 10;
WHEREAS, in order to accomplish the conversion to underground
locations of utility structures within said underground utility dis-
tricts, it is necessary that a cooperative agreement be made with
The Pacific Telephone and Telegraph Company, being the public utility
responsible for communications service within said areas;
WHEREAS, a form of agreement which would accomplish these pur-
poses has been prepared and submitted to this Council;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. The removal of poles and overhead lines and associated
overhead structures and their conversion to underground locations
within that certain area described as Underground Utility District
Noe 9, in said Ordinance No, 2490, is in the general public interest
for the following reasons:
Such undergrounding will avoid or eliminate an
unusually heavy concentration of overhead distri-
bution facilities; and
Said streets or roads are extensively used by the
general public and carry a heavy volume of pedis-
trian and vehicular traffic.
2. That the City make and enter into an agreement with The
Pacific Telephone and Telegraph Company, dated and in form this day
presented to this Council, and the Mayor is hereby authorized to

execute said Agreement, in triplicate, and the City Clerk is hereby
authorized to attest his signature and to affix the corporate seal
of the City thereto. -
3. That the amount of $3,300 which will become payable by the
City to the Company under paragraph 3 of said Agreement shall be paid,
when due, to the Company from the Construction Fund established in
the proceedings being conducted pursuant to Resolution No. 4122, A
Resolution of Preliminary Determination and of Intention, adopted by
the City Council on May 6, 1968, and charged to the contingency item
included within such fund.

I hereby certify that the foregoing is a full true and correct
copy of a resolution duly passed and adopted by the Council of tine
City of Palo Alto, California, at a meeting thereof held on the
2nd day of June , 1969, by the following vote of the
members thereof:

Telephone Company Agreement
Enclosed for the agenda of the next Council meeting, please
find a resolution determining that certain undergrounding of utility
facilities is in the general public interest and authorizing execu-
tion of agreement with The Pacific Telephone and Telegraph Company.
Also enclosed please find three copies of the Agreement
referred to in the resolution.
