RESOLUTION NO. 4254
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
DECLARING ITS INTENTION TO ORDER THE VACATION OF AN
EASEMENT AND SETTING A PUBLIC HEARING THEREON
The Council of the City of Palo Alto does RESOLVE as fol-
lows:
SECTION 1. It is the intention of the Council of the City
of Palo Alto, subject to certain conditions set forth hereinafter
to vacate a non-exclusive easement acquired for the purpose of
installation, maintenance, repair and replacement of sanitary
sewer pipeline and any and all appurtenances thereto, under and
upon those certain parcels of land situate in the City of Palo
Alto, County of Santa Clara, State of California as described in
EXHIBIT A and as set forth on a map entitled EXHIBIT B, both
attached hereto and by reference made a part hereof.
SECTION 2. Monday. the 9th day of June, 1969, at 7:30 p.m.
in the Council Chambers, City Hall, Palo Alto, California, is
set as the time and place of hearing where and when any person
having an interest in such proceedings may appear and be heard
either for or against such vacation.
SECTION 3. It is further the intention of the Council that
vacation of the present easement is to be conditioned on the
affected owners' Obtaining and furnishing to the City new ease-
ments and relocation of the sewer line concerned within said new
easements, at their own expense, subject to the approval of the
Water -Gas -Sewer Department, and payment of all other costs related
to this vacation.
SECTION 4. All the proceedings for the vacation of said
easement shall be conducted pursuant to Title 5, Division 1,
Article 5 of the Government Code of the State of California.
SECTION 5. The City Engineer is directed to post notices
of this interest to vacate conspicuously along the easement to
be vacated as described in Section 1 hereof at least 10 days
before the hearing, posting them no more than 300 feet apart,
but there shall be at least three notices posted. Such notices
shall state the passage of this Resolution of Intention, and the
time and place of the hearing.
SECTION 6. The City Clerk is directed to publish a copy
of this resolution in the Palo Alto Times once each week prior
to the date of hearing.

A non-exclusive easement for the purpose of installation,
maintenance, repair and replacement of sanitary sewer pipeline
and any and all appurtenances thereto, under and upon that
certain parcel of land situate in the City of Palo Alto,
County of Santa Clara, State of California, said easement
being more particularly described as follows:
PA::CEL 1
BEGINNING at a point on the common line between Parcel B and
C as shown on "Record of Survey being a resubdivision of Lots
3, 5 and 6, Tract 3890, Country Club Ranchos" recorded
February 25, 1966 in Book 205 of Maps at Page 47, Santa Clara
County Records, which bears South 470 11' 12" East 35.00 feet
from the northwesterly corner of Parcel 'C"; thence continuing
along said common line South 47°11' 12' East 30.84 feet; thence
North 31° 29'15" West 39.30 feet to the southeasterly line of
the 10 foot sanitary sewer easement through Lot 6 as shown
upon the map of "Tract No. 3890 Country Club Ranchos", recorded
April 28, 1965 in Book 194 of Maps at Pages 1 and 2, Santa
Clara County Records; thence South 9° 29'04" West 12.73 feet to
the point of beginning.
PARCEL 2
BEGINNING at the common corner of Lots 3, 4 and 5 as shown upon
the map of "Tract No. 3890, Country Club Ranchos", recorded
April 28, 1965 in Book 194 of Maps at Pages 1 and 2, Santa Clara
County Records; thence North 45°10' 36" East 141.05 feet; thence
parallel to and 10.00 feet distant northeasterly, measured at
right angles, from the common line between Lots 5 and 6 of said
Tract No. 3890 North 31° 29' 15" West 86.20 feet to the line
dividing Parcel "B" and Parcel "C", as shown on that certain
Record of Survey recorded in Book 205 of Maps at page 47, Santa
Clara County Records; thence northwesterly along said line
North 47011'12" West 30.84 feet; thence southeasterly along the
common line between said Lots 5 and 6 South 31029' 15" East 106.08
feet; thence South 45°10'36" West 127.10 feet to the line dividing
Lots 4 and 5 as shown on said map of Tract No. 3890; thence along
said dividing line between Lots 4 and 5 South 130 40' 35" East
11.68 feet to the point of beginning.
PARCEL 3
BEGINNING at the --'o'nt 'f intersection of the common line between
Lots 3 and 4 with the westerly line of Lot 5 as shown upon the map
of "Tract No. 3890, Country Club Ranchos," recorded April 28, 1965
in Book 194 of Maps at Pages 1 and 2, Santa Clara County Records;
thence along the common line between Lot 4 and Parcel "B" as shown
on "Record of Survey being a resubdivision of Lots 3, 5 and 6, Tract
No. 3890, Country Club Ranchos" recorded February 25, 1966 ,n Book
205 of Maps at Page 47, Santa C1ra County Records North 13`'40'35"
West 11.68 feet; thence South 45u10' 36 " West 15.05 feet to a point
on the common line between Lot 4: and Parcel "A" as shown on said
Record of Survey; thence along said common line South 86051'30"
East 13.46 feet to the point of beginning.
