HomeMy WebLinkAboutRESO 4251RESOLUTION NO. 4251 ORIGINAL RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD ON MAY 13, 1969 WHEREAS, on May 13, 1969, a general municipal election was duly held in the City of Palo Alto pursuant to the provisions of Section 3 of Article III of the Charter of the City of Palo Alto for the purpose of electing five Councilmen for full terms of four years expiring June 30, 1973, and WHEREAS, pursuant to Resolution No. 4209 of the Council of the City of Palo Alto adopted February 17, 1969, the Council, on its own motion, submitted to the electors at the 1969 general municipal election eight propositions, designated Propositions 1, 2, 3, 4, 5, 6, 7 and 8 respectively, amending the Charter of the City of Palo Alto on the subjects of: signature requirements for franchise elections; compensation for Councilmen; purchasing procedures, designation of candidates on ballot; initiative and referendum procedures; park dedication; and procedure for amending the Charter, and WHEREAS, pursuant to Resolution No. 4212 of the Council of the City of Palo Alto adopted March 3, 1969, the Council, on its own motion, submitted to the electors at the 1969 general municipal election one proposition, designated Proposition No. 9, amending Section 1 (Recall) of Article VI of the Charter of the City of Palo Alto, as recommended by the 1968 Citizens Charter Review Cr-• mittee , and WHEREAS, pursuant to Resolution No. 4213 of the Council of the City of Palo Alto adopted March 3, 1969, the Council, on its own motion, submitted to the electors at the 1969 general municipal election one proposition, designated Proposition No. 10, amending Section 1 of Article VI of the Charter of the City of Palo Alto 1 • • to incorporate in substantial form the recall provisions of general law, and WHEREAS, due and legal notice of said general municipal election was given as required by law, and WHEREAS, on the 13th day of May 1969 at the hour of 7:00 o'clock in the morning of said day the polls were duly and regularly opened for said general municipal election in said city and said polls were continuously kept open for said purpose from the time they were so opened until 8:00 o'clock in the evening of said day, and WHEREAS, on May 19, 1969, the Council of the City of Palo Alto met at their usual place of meeting and did then and there canvass the returns of said general municipal election and declare the results thereof, NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The Council finds and declares that: (a) A general municipal election was duly and regularly held on May 13, 1969 in all things according to the Charter of the City of Palo Alto, Resolutions No. 4209, No. 4212 and No. 4213, and the election laws of the State of California; (b) The whole number of votes cast in the City at said general municipal election, including votes cast upon absentee ballots was 10.414 (c) The total number of votes given and cast at said general municipal election, including votes cast upon absentee ballots, was as follows for the candidates for City Council: JOHN V. RICHMOND, JR. 2,079 (d) The total number of votes given and cast at said general municipal election upon Proposition 1, including votes cast upon absentee ballots, was 9,503 , of which total number of votes given and cast 8,580 i were in favor of said proposition and 923 were against said proposition; (e) The total number of votes given and cast at said general municipal election upon Proposition 2, including votes cast upon absentee ballots, was 9576 , of which total number of votes given and cast 5,851 were in favor of said proposition and 3,725 were against said proposition; (f) The total number of votes given and cast at said general municipal election upon Proposition 3, including votes cast upon absentee ballots, was 8,870 , of which total number of votes given and cast 7,990 were in favor of said proposition and 880 were against said proposition; (g) The total number of votes given and cast at said general municipal election upon Proposition 4, including votes cast upon absentee ballots, was 9,385 , of which total number of votes given and cast 7,914 were in favor of said proposition and 1,471 were against said proposition; (h) The total number of votes given and cast at said general municipal election upon Proposition 5, including votes cast upon absentee ballots, was 9,370 , of which total number of votes given and cast 8,020 were in favor of said proposition and 1,350 were against said proposition; - 3 - • • (i) The total number of votes given and cast at sad general municipal election upon Proposition 6, including votes cast upon absentee ballots, was 9,248 , of which total number of votes given and cast 5,897 were in favor of said proposition and 3,351 were against said proposition; (j) The total number of votes given and cast at said general municipal election upon Proposition 7, including votes cast upon absentee ballots, was 9,248 , of which total number of votes given and cast 8,450 were in favor of said proposition and 798 were against said proposition; (k) The total number of votes given and cast at said general municipal election upon Proposition 8, including votes cast upon absentee ballots, was 9,083 , of which total number of votes given and cast 8,182 were in favor of said proposition and 901 were against said proposition; (1) The total number of votes given and cast at said general municipal election upon Proposition 9, including votes cast upon absentee ballots, was 9,458 , of which total number of votes given and cast 2,263 were in favor of said proposition and 7,195 were against said proposition; (m) The total number of votes given and cast at said general municipal election upon Proposition 10, including votes cast upon absentee ballots, was 9,518 , of which total number of votes given and cast 6.799 were in favor of said proposition and 2719 were against Said proposition; SECTION 2. John J. Berwald, William H. Clark, Kirke W. Comstock, Stanley R. Norton and John V. Beahrs, being the five candidates receiving the highest number of votes for the office of Councilman for a full four-year term, were duly and regularly elected for terms of four years commencing July 1, 1969 to serve as Councilmen of the City of Palo Alto. SECTION 3. A majority of the qualified electors voting in said general municipal election having cast their ballots in favor of said Propositions 1, 2, 3, 4, 5, 6, 7, 8, and 10 amending the Charter of the City of Palo Alto, said amendments shall be deemed duly ratified as provided in Section 8(i) of Article XI of the Constitution of the State of California and shall be submitted to the State Legislature for approval or rejection. SECTION 4. A majority of the qualified electors voting in said general municipal election having cast their ballots against said Proposition 9 amending the Charter of the City of Palo Alto, said amendment is hereby declared defeated. SECTION 5. The City Attorney is hereby authorized and dir- ected to prepare a resolution setting forth said charter amendments so ratified to be certified by the Mayor and City Clerk for intro- duction and passage as a Concurrent Resolution by the Legislature of the State of California approving said amendments. SECTION 6. Attached hereto and incorporated herein as EXHIBIT 1 is the statement of the result, as required by Section 22933 of the Elections Code of the State of California.
